In 2014, the academic journal Electoral Studiespublished a groundbreaking study by three scholars who estimated how frequently non-citizens were illegally voting. Based on data for the 2008 presidential and congressional elections, the study found that:
- “roughly one quarter of non-citizens” in the U.S. “were likely registered to vote.”
- “6.4% of non-citizens actually voted.”
- 81.8% of them “reported voting for Barack Obama.”
- illegal votes cast by non-citizens “likely” changed “important election outcomes” in favor of Democrats, “including Electoral College votes” and a “pivotal” U.S. Senate race that enabled Democrats to pass Obamacare.
The study’s voter registration rate was estimated with data from two key sources:
- A national survey in which 14.8% of non-citizens admitted that they were registered to vote.
- A database of registered voters that reveals what portion of the surveyed non-citizens “were in fact registered” even though “they claimed not to be registered.”
By combining these data, the author’s “best” estimate was that 25.1% of non-citizens were illegally registered to vote.
The authors calculated voter turnout with the same datasets, but their methodology yielded a best estimate that 6.4% of non-citizens voted in 2008—lower than the 8.0% of non-citizens who stated “I definitely voted” and explicitly named the candidate they voted for. This and other matters led Just Facts to engage in extensive correspondence with the lead author of the study to verify practically every detail of it.
Just Facts then conducted a comparable study that used the same datasets, a more straightforward methodology, and related studies to constrain assumptions. This found that roughly 27% of non-citizens were registered to vote and about 16% of them voted in the 2008 national elections.

I've already given you evidence to prove that at least some of those supposed illegal immigrant voters are white people born in America to American parents and are simply on somebody's illegal immigrant list by mistake. Others are naturalized citizens and are on an illegal immigrant list by mistake. And yes, so far, I've come up with a handful of actual illegal immigrant voters. You haven't come up with any at all. That's what's "obvious." I did the same thing that Tucker Carlson did with Sydney Powell which is demand actual evidence to support a claim. She couldn't because her claims were BS. I'm not calling this one BS yet but it's certainly unproven that illegal immigrants voted in any federal election in significant numbers. Now, we have several state AGs who've come up with lists of thousands of potential illegal immigrant voters. We'll see any of those attorney generals can prove that even hundreds of those thousands of potential illegal immigrant voters are really illegal votes. The Alabama list is about 3,000. The popuation of the U.S. is 67 times that of Alabama so that extrapolates to 210,000 possible illegal voters nationwide if those numbers hold from state to state. That's not even close to 1 milllion let alone 3 million. And again, the Alabama number has already been proven to have false positives. The Federal DA for the Northern District of Alabama is still a Trump appointee so there is no reason at all to expect she will drag her feet if there's any real prosecutions to be done. A year from now, if there's not more than 100 prosecutions coming out of Alabama, I'm calling BS on this story just like Tucker Carlson called BS on Sydney Powell's claims that the election was stolen from Trump.

In an attempted June 2024 “fact check” designed to rebut the allegation, USA Today responds:
““Michigan Secretary of State Jocelyn Benson called it a “PR campaign masquerading as a meritless lawsuit.” A similar lawsuit was dismissed in March.”
This is no “debunk” whatsoever, since the assertion of one of the sued parties that the allegations are false is not a refutation.
MI is where Secretary of State Jocelyn Benson directed election workers to “presume” all signatures on mail-in ballots were valid in 2020, an order which was struck down by Michigan courts. Nevertheless, Benson has just ignored the ruling and issued the same guidance again for 2024. So now election workers following the guidance could be criminally liable for breaking the law.
Detroit News:
“Before the 2020 election, Benson directed local clerks to presume the signatures on absentee ballot applications and ballots were valid and to further accept the signatures as valid if they contained “any redeeming qualities.”
”The Center for Election Confidence fought this attempt to change, last-minute, Michigan’s election law. The Michigan courts agreed later that the guidance was invalid. Despite this, the Benson issued the same direction again to local clerks for the 2024 election, contrary to previous court rulings and in violation of state law.
