'I care about my son getting justice:' Woman sues Stanislaus County Sheriff after her son's death

STANISLAUS COUNTY, Calif. — Dorothey Heimbach demands justice and answers after her 40-year-old son Anthony Silva’s death.

Heimbach claims Silva died as a result of being severely injured and paralyzed after an encounter with Stanislaus County Sheriff deputies on Oct. 8, 2022.

“He suffered for a whole year his lungs were collapsed. They did him wrong, very wrong. They broke his neck and his back,” Heimbach said.

Just two weeks ago, Anthony Silva’s family obtained body camera footage showing the moment when Stanislaus County deputies handcuffed Silva and took him down headfirst to the ground.

After nearly a year in the hospital, Silva died September 2023.

Now, Heimbach is suing Stanislaus County.

In a statement to KCRA 3, Stanislaus Sheriff’s said, "If this is an instance of any ongoing civil litigation, then it is the policy of our department not to provide any further public comment."

Heimbach’s lawyer, Cooper Mayne, said they are working to find answers since they still don’t know the exact charge he was being investigated with.

Mayne argues not only was the use of force unnecessary, but Silva was not given the medical help he needed.

“Instead of getting him care, stabilizing his neck. They actually move him and put him on a bench which exacerbated his injuries,” Mayne said.

Silva’s family said the video shows he could not fight back, so now they will.

“Remember that he is a good guy and he didn’t deserve what he got,” Heimbach said.

I saw that video last night. Disgusting how cops treat their fellow man. I hope his family wins.

Kind of amazing the only blurry portion of the video was when his head hit the ground. Also what was the deal with the missing audio at around 26 minutes? Why so concerned about his possessions? WTF?

Wow. Some of the dumbest cops I've ever seen in that video.

On the afternoon of October 8, 2022, Anthony Silva’s life was irrevocably altered when Stanislaus County deputies unleashed a brutal assault, leaving him quadriplegic and eventually causing his death on September 10, 2023. Renowned California Civil Rights Attorney, Dale Galipo, filed a lawsuit on Anthony’s behalf. He joined me to explain the current status of that litigation, including the outrageous fact that no government investigation ever occurred regarding the circumstances of Silva’s injury and ultimate death.
