Apparently the EO declares that sex is based on sex at conception, but humans don't sexually differentiate until more than 6 weeks into gestation, until then we are all biologically sexually female.

Bio 101 much? Maybe he should have watched that "what is a woman" documentary?

 
Are you saying that it is not true that some sperm cells carry only a Y chromosome and other sperm cells carry only an X chromosome, such that at conception, a zygote is typically either XX or XY?

The XX-is-female / XY-is-male paradigm works in something over 98.5% of the population. But nobody really knows how large that remaining percentage is. Genetically, you need the SRY Gene region in order to develop male physiology. Generally the SRY gene region is found on the Y-Chromosome, but it sometimes (rarely) occurs on the X chromosome. Individuals with XX chromosome containing SRY Genes may develop male physiology, though their sperm count is seldom high enough to procreate. There is also the possibility that the SRY gene may be missing from the Y chromosome, so you could get an XY individual that won't develop male physiology and will instead develop as the default sex physiology (which as idiom pointed out, is female). While these individuals have a uterus and ovaries, the ovaries are seldom capable of generating viable eggs. They can sometimes carry a child to birth by the use of donated eggs and fertility procedures ... ergo, XY individuals giving birth.

There are other disorders of sex development as well (read here). And it's not all just chromosomes and genes. If the right hormones are not present in sufficient quantities at the appropriate times (as idiom said, sex differentiation occurs at about six weeks) then sexual physiology will not develop in accordance with the XX-is-female/XY-is-male paradigm. The incidence is really low (1 in 80,000) but it's non-zero.

If you know of individuals who are having fertility problems, there's a chance they fall into the realm of people with disorders of sex development.

So if you have an XX individual with a penis and testicles, which bathroom do you want that individual to use (granted, there's probably fewer than 4,000 of them in the US)?

I'm happy with the way it's been done since before I was born. The OB/GYN looks at the kid coming out of the chute and says "Male physiology means male child" or "Female physiology means female child" - the old sex assigned at birth paradigm.

I understand. It doesn't work 100% of the time. But there's a big difference between saying that and saying it doesn't work at all.

Everything you described is determined at conception, and the order further clarifies physiologically the large reproductive cell (the egg) and the small reproductive cell (the sperm). So an XY with defective SRY that develops uterus and ovaries will be classified as Female. The most important aspect of the order is gender is NOT based on "feelings", it is based on chromosomes at conception.

Yeah, I remember when I was born, the doctor said, "The baby has his mother's features and his father's fixtures."

Not necessarily. You can have a perfectly constructed SRY on an XY, and if the uterus is overwhelmed with estrogen during the period of sex differentiation, you'll end up with a female physiology. Most often, that's not the case - but it does occur. The individual probably won't be generating either large reproductive cells (the egg) or small reproductive cells (the sperm), but will probably have a female physiology. Again, really small numbers involved, but not zero - and not from genetics, but rather the mother's endocrine system.

Biology, Psychology, Sociology and Physiology have all agreed for almost a half century that sex and gender are different. Sex is that immutable thing you're born with. Gender is a social construct that refers to the norms, roles, behaviors, and attitudes that a culture or society associates with being normal for a person of a given sex. I can live with that because I can see a need for that "social construct" spectrum; but I wish they had come up with a new term rather than repurposing "gender", which had always been a synonym for sex. But that's water over the dam at this point. Still - bathrooms, sports, prisons, verb conjugation (for languages like French and Spanish), pronouns and so forth should be based on sex (like they were when gender and sex meant the same thing) rather than this new thing they're now calling gender. My problem is not so much with the terms being different, but rather with what they mean by transitioning gender when gender is a social construct (as well as why would you need surgery, hormones or puberty blockers to transition a social construct).

There is a effort being made by small groups within Physiology to include transgender physiology - which seems ridiculous to me. It makes as much sense as including silicon/saline bags to complete the physiology of women who have had breast implants, or appliances that compensate for loss of limbs or are designed to replace worn-out knees and hips.

Anyting working in america at 98.5 percent is pretty good if compares to work force participation rate of 62 or congress approval at of 17

My point would be that you can't be certain until sex differentiation occurs (around the six week mark). It's probably better to say we're all non-binary until sex differentiation occurs. I mean, no one has sexual characteristics until that point anyway.

And we'd have a right-handed baseball league separate from the left-handed baseball league, and neither would allow trans-handedness (right-handed batters are only going to be facing right-handed pitchers ... likewise for the south paws). No more of those advantages that left-handed batters have against right-handed pitchers; or that right-handed batters have against left-handed pitchers. I'm glad to hear that Trump is finally doing something about that. ;)
