New Mexico Attorney General Raúl Torrez sent Gov. Michelle Luan Grisham a letter telling her that his office would not defend her in the four cases so far filed in federal court challenging the Sept. 8 public health order.
The order puts a temporary ban on firearms in Albuquerque and Bernalillo County as well as imposing drug monitoring and other measures.
“Though I recognize my statutory obligation as New Mexico’s chief legal officer to defend state officials when they are sued in their official capacity, my duty to uphold and defend the constitutional rights of every citizen takes precedence,” Torrez’s letter stated. “Simply put, I do not believe that the Emergency Order will have any meaningful impact on public safety but, more importantly, I do not believe it passes constitutional muster.”
Torrez shared his anger and frustration about survivors and victims of gun violence.
“The tragic deaths of 5-year-old Galilea Samaniego in a recent drive-by shooting and 11-year-old Froylan Villegas in a road rage incident should serve as a wakeup call to everyone,” Torrez said in the letter. “I encourage you to engage in a more thoughtful and deliberative process with members of the New Mexico Legislature rather than taking unilateral action that infringes on the constitutional rights of law-abiding citizens while having little if any discernible impact on the underlying dynamics driving gun violence in our community.”
Torrez agrees with the need for a debate about the effects of gun violence, “but the issuance of an executive order in violation of core constitutional principles is not the appropriate method for bringing about such a debate, and its flawed legal foundation is likely to obscure rather than highlight, meaningful solutions.”
Bernalillo County Sheriff John Allen announced Monday that his office would not be enforcing the order citing its alleged unconstitutionality, to which Lujan Grisham responded in a statement to the NM Political Report that her administration had “given you the tools, Sheriff Allen — now stop being squeamish about using them. I will not back down from doing what’s right and I will always put the safety of the people of New Mexico first.”
The four federal lawsuits were filed by the National Association for Gun Rights, We the Patriots USA, a class action lawsuit filed by Shawn Blas, a Bernalillo County resident and Randy Donk and Gun Owners of America.
Other groups are planning to file lawsuits against Lujan Grisham and her administration.
Two of these groups are the New Mexico Shooting Sports Association and the Republican Party of New Mexico.

"The Left is dangerously smart"-blackpill died with mandates. If they were so smart, and if their smooth-brained schemes were such a threat, the mandates would not have fizzled out and we'd all be marching to FEMA camps right now, to be chipped, worked to death, then liquidated into Soylent Green for the next wave. Never underestimate the enemy, but don't lionize the enemy, either. They're obviously desperate and grasping at straws. New Mexico's governor declaring a "public health emergency" is not going to overturn the 2nd Amendment, certainly not with the sitting SCOTUS. And remember that our rights do not emanate from SCOTUS itself, as though SCOTUS could "decide" that WTP don't actually have a right to free speech, free exercise of religion or a right to bear arms. The rights we have by birth are God-given and, therefore, could only be taken away by God himself. The only way to take away another human's natural rights is to commit a crime against them. That the US government is willing to commit crimes against its citizens is a well-established fact. But, by the same token, it hates being caught red-handed and exposed for the reality of what it's doing.

BREAKING: A federal judge in New Mexico puts American lives directly in danger by blocking Democratic Governor Michelle Lujan Grisham's 30 day emergency suspension of the right to carry guns publicly in the state's largest metro area.
The governor instituted the temporary ban after a slew of recent shootings, including one that killed an 11-year-old boy as he was leaving a minor league baseball game in Albuquerque.
The executive order was intended to create a "cooling off" period to stop gun violence.
Republicans and gun fetishist freaks were immediately up in arms about the ban and it appears that U.S. District Judge David Urias has caved to the pressure. His ruling to block the governor's order is a grave dereliction of duty.
"They just want the right to carry their guns," said Urias.
Maybe so, but the rest of us just want the right to live.

It's a trial balloon to see how much opposition from the public and LEO is received to such a blatantly unconstitutional (NM state constitution, namely, since Governors are beholden to state constitutions not the US Constitution) order. Makes one wonder why such an order is being tested?

That is a really good take on it and makes sense since the federal suit was filed the very next day. It's generally not possible for a fully contemplated federal complaint to be written and filed that quickly, so it likely shows advanced knowledge of the governor's "order", not unlike how the Patriot Act was already written and ready to be introduced right after 9/11/01.
