And he expects it to be ruled in favor of due process / court rights for ILLEGAL ALIENS.

He rightfully expects a lower court to rule in favor of due process on an individual basis.

That court is going to have to CITE either an existing law in code or an interpretation of a law or the Constitution.

The administration will then elevate this to the SCOTUS, who will take the case.

SCOTUS will decide if ILLEGAL ALIENS have an automatic "right" for due process.

To be accurate about the terminology, it should NOT even be referred to as "due process" because the only process DUE
is that DUE to CITIZENS of the United States and/or legally-abiding residents, etc. - not those who DE FACTO are criminals
just by being here.

Now, the question IS can they be treated AS CRIMINALS before due process? Well, of course they can.
The Exective Branch is charged with border security and enforcement of immigration policy.

SCOTUS will have to rule that there is no DUE process for everyone on the planet. If they do not, we don't have a country.

Can you read? They are not entitled to due process. The open border movement is ABUSING the Bill of Rights with its alterations of meaning.

The Fifth Amendment was written to protect AMERICANS FROM COURTS (no person shall be held to answer...)
Not to bring them to courts. Also, it clearly states this DUE PROCESS accorded is accorded so that WE are not to
"be deprived of life, liberty, or property" -- which has NOTHING TO DO with hordes of foreigners marching into our country against its laws.

Those deported are REPATRIATED to their country of origin. Of which they are CITIZENS, and if that country refuses them, they are in effect
stateless and may be situated elsewhere at the discretion of the United States.

They are determined to be Non-Citizens and/or Illegal by exploratory acquisition of STATUS, which is a process, but not the SAME process as the "Due Process" mentioned in the Fifth Amendment.
 
If a Citizen is deported, they have the right to a case against the goverment. Again, that process neither has anything to do with the "due process" of the Fifth which is merely for charges of crimes against citizens.

It matters NOT whether a foreigner committed any crime. They are not even being charged with a crime.

To what extent they are criminals is up to their OWN government to address.

They need not even BE criminals to be denied residence in the United States. We do not offer that right to every beating heart on the planet.

This was why, for example, it required the Magnuson Act to repeal (in Congress, signed by FDR) the Chinese Exclusion Act.

But nobody at the time was arguing that the U.S. didn't have the authority to deport Chinese or anyone else. That authority merely changed its position on the matter. But the authority itself was not disgorged. Many today want the authority ITSELF disgorged, and their avenue of deceit is to abuse the language of the Constitution far outside of its intended purpose.

Illegal entry is a crime. Your whole rant is invalid. When did you decide due process is a bad thing, or something that needs to be rationed? Why risk citizens not getting it out of fear some non-citizen might get some? Is there a shortage of it? Will it do a guilty trespasser any good at all?

I definitely didn't think it was this bad until states started collapsing around the world approximately 10 years ago.

As whole countries could start running out of things like water or economic collapse this becomes a compelling reason.

I remember at the time I was probably pretty good with lots of immigration but that was when the first person I knew was killed by an illegal immigrant.

He was a 20 year old with a wife and kid.

Other countries are running out and will cause failed states. Millions of people in the Western US states already don't have water.

Half the country is turning into a desert.

Mexico is running out of water and the USA stopped sending them water because we don't have enough to send them.

Water will collapse whole countries in the near future it was one of the reasons why Syria failed.

One of the reasons why the Ukraine war started was Ukraine shut off the water going to Crimea and Crimea started running out of water.

No country will want to be dependent on another country for water like oil and nations have gone to war over oil.

That's what makes it the new oil. That and desalination costs a lot of energy.

So when there is no fresh water nations use desalination and convert their oil into water.

We saw what happened in Crimea after Russia took control.

Ukraine damed up the water, turned off Crimea's water and then Russia invaded Ukraine.

There are countries looking at daming up the Nile even. That very well might be the next water war.

Nobody discusses it but Greenland has one of the largest sources of water in the world, the ice.

That coupled with their small population size makes them a soft target.

Thousands of years of history will tell you that's a crisis waiting to happen.

As other regions of the world dry up that water starts looking pretty attractive.

Historically speaking people aren't very nice and they go and take something when they want it badly enough.
