The story that distraught Maria Mendez told doctors and detectives at Harbor-UCLA Medical Center seven years ago has never varied, not even on the day she rejected a chance at probation by refusing to say she'd killed her grandson.

Shortly before Christmas 2006, as she told authorities, one moment her strapping, 22-pound, 9-month-old grandson was on the sofa at her home in South L.A. while she straightened up and prepared snacks for four of her children — who would soon be home from McKinley Elementary School and a nearby continuation high school. The next moment, she found the baby, Emmanuel Martinez, facedown on the floor turning purple, and she screamed for help.

The baby remained in a coma for a week and was declared brain-dead on Dec. 20. Medical examiner Yulai Wang said the cause was "traumatic head injuries" leading to massive brain swelling, and ruled the baby's death a homicide. But Wang failed to take photographs of the brain damage — an omission that has come back to dog him.

A man accused of shaking his baby son to death was sentenced to 51 years in
prison.

A Davidson County jury found Russell Maze guilty of first-degree felony
murder and aggravated child abuse after a four-day trial that featured
dueling expert testimony on ''shaken baby syndrome.''

The baby, 5-week-old Alex, died in October 2000, 18 months after he was
shaken, prosecutors said.

During this week's trial, the father's defense attorney questioned the
''shaken baby syndrome'' theory and argued that the boy, who had been born
prematurely, was quite sick and had pre-existing bleeding on the brain.
Attorney Dwight Scott also raised the possibility that the child had a
reaction to a vaccine.

Jurors in Criminal Court Judge Steve Dozier's courtroom had to wade through
a large dose of complex medical material. One of the prosecutors said
jurors deliberated for about two hours before they rendered a verdict
Thursday night.

''Jurors don't understand all the complexity of the science and too often
experts get in with bogus claims that are very difficult to try and
refute,'' said Davidson County Assistant District Attorney Brian Holmgren.

During the trial, a pediatrician testified that the only thing that could
have caused the swelling and bleeding and trauma to the baby's brain was
from violent shaking.

During the trial, Dr. Suzanne Starling, a pediatrician who examined the
baby, testified that there was no link between the baby's symptoms and the
hepatitis B vaccine, as the defense team claimed.

Toni Blake, a consultant who has questioned some cases prosecuted under the
shaken baby theory, says she's worked on about 300 cases around the country
and came to the trial to help Maze. Blake said she couldn't say with
absolute certainty that the hepatitis B vaccine caused Bryan's injuries but
said there had been problems with it with certain medically fragile
children. The vaccine contained thimersol, a preservative containing mercury.

Opponents of use of thimersol in vaccines claim it causes higher rates of
autism and other neurological disorders.

Maze, 38, was originally tried in this case and convicted of aggravated
child abuse in 2000, but the Court of Criminal Appeals reversed the
conviction and ordered a new trial because the judge had failed to give the
jury instructions on lesser offenses.

Later that year, however, the child died, and the charges were upgraded to
felony murder.

This week, the jury sentenced him to serve life in prison, which means 51
calendar years. Dozier will sentence him for the aggravated child abuse at
a hearing next month. The baby's mother, Kaye Maze, entered a best-interest
plea to a charge of failure to protect the child and was sentenced to serve
two years in jail and three years' probation, court documents said.

In my travels... I have met more people who have dropped out of the public indoctrination system who are quite intelligent, quite thought provoking and more articulate, and use common sense much more. It was even a public indoctrination drop-out who woke me up some 20 years ago--I am thankful he did.
 
Bone Density Test Can Disprove Shaken Baby Syndrome

As a consumer health care researcher and journalist, one of my pet projects is something I think the medical and legal professions may have taken the low road in dealing with caretakers charged with Shaken Baby Syndrome, a medical-legal term that devastates those prosecuted with it and also destroys families due to inaccuracies involved that require children to be removed from parents’ care and placed in foster homes or up for adoption.

Before I delve into the topic I want to discuss, perhaps you may want to know that I have co-authored several papers with Dr. Harold E. Also, I prepared a survey questionnaire about SBS for an international website. So I feel comfortable thinking I know enough about SBS as alleged child abuse to talk about a newly published paper that has me thrilled to say the least, but not quite overly excited due to what I feel may be an omission of probable contributing factors.

Matthew B. Seeley, JD, has published one of the more credible papers regarding SBS I’ve ever read that was produced by mainstream thought, e.g., the medical and/or legal professions. “Unexplained Fractures in Infants and Child Abuse: The Case for Requiring Bone-Density Testing Before Convicting Caretakers” [1] was published in the December 20, 2011 issue of the Brigham Young University Law Review. Dr. Seeley, as I understand, is a researcher and professor at BYU in its College of Life Sciences.

As background history, I’m familiar with SBS from the medical-legal aspects because of the work my collaborator Dr. Buttram has been doing for the last ten or so years, i.e., testifying as a medical expert for the defense, those parents/caretakers who are legally charged with child abuse and/or SBS—often with first degree murder. Since Dr. Buttram has over 100 such cases under his belt, our collaborating on papers about the issue has allowed me to understand more about SBS than the average person.

Dr. Seeley astutely points out that SBS probably got off on the wrong medical and legal ‘feet’ due to the theorized assessments that shaking babies could cause intracranial hemorrhages, as published in a paper by Dr. John Caffey, “On the Theory and Practice of Shaking Infants: Its Potential Residual Effects of Permanent Brain Damage and Mental Retardation” in the American Journal of Diseases of Children (1972). Caffey apparently based his theories upon whiplash studies inducing intracranial hemorrhaging in rhesus monkeys performed by Dr. Ommaya, who advised Caffey that there was no information that could substantiate that humans could generate such angular acceleration via shaking so as to induce the type of rear-end collision injuries the monkeys sustained. Caffey still maintained his theory in the published paper that apparently has become ‘gospel truth’ and prevailed in medicine and at law ever since. Could Caffey’s theory been a mistake that’s been perpetuated all this time and for which innocent parents and caretakers have paid an awful legal price?

Adding more ‘legal salt’ to the SBS injury, Dr. Caffey published “The Whiplash Shaken Infant Syndrome: Manual Shaking by the Extremities with Whiplash-Induced Intracranial Bleedings, Linked With Residual Permanent Brain Damage and Mental Retardation” in Pediatrics in 1974 wherein he gave his opinion that subdural and retinal hemorrhaging without signs of external physical abuse, would be sufficient to diagnose child abuse, medically known as pathognomonic.

For all these years child abuse charges have been prosecuted legally based upon a theory and opinion with no studies to prove or disprove child abuse, since it would be real child abuse to subject children to such actions for a study as Dr. Caffey alleged were responsible for SBS.

Sadly, innocent parents and caretakers have been prosecuted and incarcerated without any means at law to prove themselves innocent until what Dr. Seeley discusses in his exceptional paper: a Bone Density Test—something that can be done inexpensively and does not require high tech equipment, only a properly trained technician to administer.

A single-photon absorptiometry test that uses single-photon absorptiometers (SPAs) has been used for years and is well established for measuring bone density in children. That type of test could exonerate or prove SBS charges, especially if an infant were born prematurely, or when there are no signs of physical abuse presenting on the child’s body.

Additionally, a blood serum Vitamin D test should be mandated and taken of both the supposedly abused infant AND his/her post-partum mother. The mother’s test results could indicate the proclivity to in utero rickets, depending upon how long after the birth the SBS tragedy occurred, while the infant’s test results would confirm insufficient Vitamin D levels that allowed the child to have bone fractures either during the birthing process or even from normal daily baby care, since no one knew of the child’s fragile bones.

As Dr. Seeley points out, many health problems can contribute to in utero rickets; even natural vaginal births can cause broken ribs and other bones due to Osteopenia of Prematurity or other metabolic bone diseases. Infants with certain health proclivities due to poor prenatal nutrition, etc. can suffer broken bones from just being cuddled or properly handled in every day life ministrations. However, when it comes to brain inflammation, I’d like to suggest that Dr. Seeley read Dr. Buttram’s and my papers on the role that vaccines play in causing subdural brain hemorrhages and other central nervous system adverse reactions, including the possibility of contributing to the Autism Spectrum Disorder.

I know if he reads this article, Dr. Seeley may bristle at the thought that vaccines can contribute to SBS, but as he says, there are some unknowns yet to be discovered by medicine regarding this syndrome. There is much in the literature that points to vaccines as one of those yet unknowns.

I cannot congratulate Dr. Seeley enough for bringing a great deal of scientific sense to the SBS problem, and I suggest that the law, legal and medical professions, federal and state health agencies immediately mandate Vitamin D assays and/or Bone Density Tests for all premature babies whose parent(s) or caretaker(s) are charged with child abuse when no physical trauma presents on the child’s body.

Not only do children have to be protected from child abuse, so do innocent adults who are wrongfully charged with crimes they have not committed. Something as simple and inexpensive as a blood serum Vitamin D assay or a Bone Density Test will prove three things: 1) the condition of the child’s bones, i.e., something an X-ray can do only when 40 percent bone loss has to occurred thus the medical-legal need for a Vitamin D assay; and 2) legal proof that SBS charges are not warranted; and 3) the child needs proper medical care to build up bones that can fracture very easily that was an unknown until either the Vitamin D assay or Bone Density Test.

I’d like to see bone density investigation go a step further and become similar to the Apgar test given at birth and the unfortunate Hepatitis B vaccine, which is mandated within 24 hours of birth. That is, blood Vitamin D assays should be mandated for all premature babies to ascertain whether the infant has in utero rickets and is prone to bone fractures or possibly has fractures as a result of the birthing process.

Furthermore, I suggest that the Hepatitis B vaccine NOT be administered to premature infants before the blood Vitamin D assay is performed as the test results may indicate health anomalies that the Hep B vaccine can induce or exacerbate, especially in premature birth babies. The Pourcyrous et al study “Primary immunization of premature infants with gestational age <35 weeks: Cardiorespiratory complications and C-reactive protein responses associated with administration of single and multiple separate vaccines simultaneously” [2] details what can happen.

However, I will go so far as to say that I think a Bone Density Test, which involves ionizing radiation, just may be the lesser of the evils when a parent is charged with SBS and child abuse and no physical trauma presents on the child. If the innocent parent faces a protracted jail term, which would deprive the infant of being raised by a loving and innocent parent, then that test could prove both SBS innocence and the need for the child’s proper bone healthcare. As it stands now, innocent parents have their children taken away and placed in foster care or up for adoption. What a tragedy occurs within the justice system when the innocent are mistreated, especially because of lack of proper knowledge.

The SBS situation can be equated with other legal cases where innocent parties were exonerated by DNA tests. SBS medical-legal problems need to be reconsidered and I think what I discuss in this paper presents something for both the medical and legal professions to consider seriously.

However, Dr. Seeley’s paper has so much ‘meat’ in it that I’d like to discuss, I plan on writing more about his truly insightful paper. Thank you, Dr. Seeley. His paper titled Autoimmunity and Non-Accidental Injury in Children discusses the cases of five children suffering from brain injuries and fractures after vaccinations. After studying each case in depth, he concluded that vaccination could be responsible for the triad of injuries commonly associated with SBS. [11]

As to the study it sounds like it might be a pissing match from hmmmDoctors that have some butthurt . While they rip on the others findings they do little to actually come up with numbers of their own.

Nobody said that the medical profession was perfect. So I'm not sure what you're on about. My point was that someone who graduated from medical school is smarter than DonnaY. (She thinks they're all part of a plot to kill us.)

Your follow up proved my point. Their criticisms had merit, but you can't go there. No, you instead trash them for not doing a a different study. And if they had done another study, then you'd be saying that it was funded by the same people that want us to believe they don't make that many mistakes.

Scientific Fraud and Conflict Of Interest In Vaccine Research, Licensing & Policymaking

In Business School, (Organizational Behavior) we studied what can happen to organizations that suffer ethical management breakdowns (such as Johns Manville with asbestos, Owens Corning breast implants, etc.). Nothing illustrates the syndrome of management ethical failure more clearly than the current scandal faced by Firestone and Ford. Those companies denied and concealed deaths and injuries caused by tread separation and a high center of gravity in the Ford Explorer for years. Management knew, denied and concealed that their products were defective and were killing people -- the classic ethical breakdown.

In the vaccine industry, scientific fraud and conflicts of interest are causing a similar (but much larger) cycle of deaths and injuries that is being concealed and denied by regulators and vaccine manufacturers. However, (as with Firestone and Ford) a noose of their own making may be slowly tightening around the vaccine scandal perpetrator's necks.

Financial conflict of interest is a complex issue -- because few investors (except perhaps Tibetan Monks or Jesuit Priests) are likely to not have pharmaceutical shares in their diversified portfolios in this day and age. But financial conflicts of interest and scientific fraud (that lead to corrupt public policy) damage the public interest and could eventually bankrupt vaccine manufacturers that have perverted the regulatory process. Shareholders should investigate the issue carefully.

There's only about 100 US Deaths from Firestone tire blowouts. There are thousands of deaths and many thousands of cases of disability and neurological damage lurking in the FDA Vaccine Adverse Event Reporting System (VAERS). This is a potential legal scandal of much larger scope than the Firestone/Ford episode.

US vaccines are licensed by the FDA and immunization recommendations are made by the Advisory Committee on Immunization Practices (ACIP), which is a committee whose members are appointed by the Centers for Disease Control (CDC). ACIP immunization recommendations are enacted into law by public health departments and/or legislatures at the state level, via the energetic efforts of vaccine manufacturer sales representatives. While the ACIP does nothing more than craft and finalize the exact wording detailing recommended doses and ages for administration of vaccines, ACIP recommendations are extraordinarily influential, because they get turned into mandates at the state level.

These vaccine mandates are despotic intrusions into personal liberty and democracy. School districts and social service departments demand that: You must inject these viruses and bacteria into your body (or your child's body) or you (or your child) may not attend school, you may be charged with child abuse and your children may be removed from your home, placed in foster care and forcibly vaccinated.

Such intimidation is taking place with greater intensity and frequency as more and more ACIP recommendations and subsequent state vaccine mandates are enacted. Furthermore, parents are being wrongfully accused and convicted of shaken baby syndrome in cases where their children die immediately after vaccination and have swollen brains in the autopsy report (brain inflammation is a classic vaccine adverse reaction).

The enforcement of ACIP vaccine recommendations at the state and local level by plodding and heavy-handed health and social service department employees is a threat to the neurological systems of those vaccinated. Vaccine adverse reactions are defined as the same thing as disease complications in the medical literature -- encephalitis. "Acute disseminated encephalomyelitis (postinfectious encephalomyelitis--see also Acute Viral Encephalitis and Aseptic Meningitis) is characterized by perivascular Central Nervous System demyelination, which can occur spontaneously but usually follows a viral infection or VIRAL VACCINATION (or, very rarely, BACTERIAL VACCINATION), suggesting an immunologic cause." Thousands of reports of adverse reactions such as convulsions, brain inflammation, inconsolable screaming syndrome, SIDS and neurological diseases such as Multiple Sclerosis, Transverse Myelitis and Guillain-Barre Syndrome continue to flood into the FDA Vaccine Adverse Event Reporting System (VAERS), where they are largely ignored or tolerated as the cost of some mythical victory over disease. Children and adults are developing the same encephalitic and neurological complications after vaccination that science takes credit for eliminating through immunization -- but the CDC, ACIP and American Academy of Pediatrics all insist the vaccine adverse reactions don't exist or are coincidences.

Their double standard is: You are required to receive this vaccination so you and society don't develop encephalitic and neurological complications from disease, but if you die or develop encephalitic or neurological complications immediately after receiving the vaccine (which contains the same virus or bacteria that causes the neurological complications), then it's all in your imagination, it's a coincidence or we're still doing studies and we'll get back to you when they are done.

Unelected, unregulated and unaccountable ACIP medical bureaucrats have blatant financial conflicts of interest and are committing scientific fraud by recommending administration of vaccines that have not been tested for safety in the age groups or populations targeted. Dr. John Modlin, current Chairman of the ACIP (Merck Immunization Advisory Board 1996 - present, Merck shareholder) gave his definition of scientific validity in a March 1999 University of New Hampshire debate:

"Has the information withstood the test of peer review? Has the information been published in a respected medical or scientific journal? ... this is the standard that you should hold me to today ... has the information been published in a scientifically reputable journal?"

One month earlier at the February 1999 ACIP meeting Chairman Modlin lobbied for the ACIP to recommend the Rotavirus vaccine for premature infants, although no safety studies had been done, much less peer reviewed or published:

".. available data are insufficient to fully establish the safety and efficacy of rotavirus vaccine in premature infants ... there is a section under Adverse Events that details what little information there actually are with respect to premature infants ... To my knowledge we don't have data from a clinical trial specifically ... Some bit of information from Seattle, as I recall, that had suggested that was a slight increase in relative risk for hospitalization for premature infants ... Obviously a situation where we have to make a judgment in the absence of data, and with a vaccine that has not yet been tested in the group ..." (ACIP transcript, pages 102-112)

Modlin then held a vote and the recommendation for premature infants passed nine to one -- Modlin voted yes.

As a member of The Vaccines and Related Biological Products Advisory Committee (VRBPAC) and Chairman of the Rotavirus working group, Modlin had data showing a risk of intussusception (life threatening bowel obstructions) in clinical trials of Rotavirus vaccine before that February 1999 ACIP meeting. The Rotavirus vaccine was withdrawn from the market in October 1999 after 113 cases of intussusception. One premature baby died after getting rotavirus vaccine in a vaccine cocktail and another five-month-old infant died after developing intussusception five days after receipt of the vaccine.

By ACIP Chairman Modlin's own definition, the ACIP's recommendation was scientifically invalid. I'll go one step further and say the ACIP Chairman committed blatant scientific fraud by issuing an ACIP recommendation that Rotavirus vaccine be given to premature newborns without scientific proof that it was safe to do so. And what was the penalty? Modlin was apparently reappointed to another term as ACIP Chairman by the CDC. Commit scientific fraud that causes death and grievous injury -- and get reappointed. That is the incentive system in the US vaccine regulatory system.

Another case suggesting scientific fraud is the still-existing 1991 ACIP recommendation that every newborn baby receive the hepatitis B vaccine in the hospital within hours of birth. Samuel L. Katz, MD, who instituted that policy when he was ACIP Chairman in 1991 has admitted they had no peer-reviewed, published studies showing that it was safe to give to newborns when the ACIP made that recommendation. (Katz is former Chairman Committee on Infectious Diseases of the American Academy of Pediatrics, former Chairman of the Public Policy Council of the Infectious Diseases Society of America).

When I asked Katz in the question/answer session after his April 12, 2000 NY/Cornell Medical School lecture on "Vaccines in the New Millennium" what peer-reviewed, published safety study he used when he was ACIP Chairman to recommend at-birth immunization of newborns in 1991 he answered: "you are quite right there was no published peer-reviewed study" (tape and transcript available). Newborns have negligible risk of contracting the hepatitis B virus, unless the mother is infected. That risk can easily be determined by a maternal blood test. No US vaccine had ever been mandated for newborn babies before. But Katz and the ACIP decided it was safe to vaccinate not-at-risk for hepatitis B newborns without any proper safety study.

Shoot first and ask questions later.

The results of that uncontrolled experiment are in: upwards of 36,000 adverse reactions and more than 440 deaths (VAERS). My daughter died after receiving the hepatitis B vaccine. Katz also admitted that vaccine adverse reactions are the same thing as neurological complications from disease when I pressed him if he disagreed with that definition from the Merck Manual saying "with measles vaccine it is possible that maybe one out of 150,000 children who get the vaccine may get something that mimics measles encephalitis."

Parents report their children were perfectly normal until receiving the MMR measles/mumps/rubella vaccine, at which point the children became autistic after a neurological adverse reaction to the MMR vaccine ("something that mimics measles encephalitis"). The incidence of measles disease may be down to about 100 cases annually in the US, but the rate of Autism has soared hundreds of percent -- a disease historically called "post-encephalitic syndrome."

For vaccine manufacturers -- the ACIP is a gold mine. ACIP recommendations are a license for vaccine manufacturers to use state governments, school systems and social service systems as a marketing department for their products. With an ACIP recommendation in hand, vaccine manufacturers use the government to say "you must buy my product and inject it into your body, even if it kills you or causes brain damage."

This is a huge Anti-Trust violation. The Orwellian spectacle of monopolistic and oligopolistic pharmaceutical manufacturers subverting government agencies to ram unsafe products down children's veins is a violation of the basic principals of the Constitution and Bill of Rights.

Our forefathers said "No Taxation Without Representation" to their British oppressors. I say "No Vaccination Without Representation" to the corporate tyrants at Merck, Smithkline and other vaccine manufacturers who have so utterly subverted the US vaccine regulatory process.

Dr. John Modlin must be removed as Chairman of the ACIP and the scientifically invalid newborn hepatitis B vaccine policy instituted without safety studies by Dr. Katz must be revoked. The investors and directors of vaccine manufacturers such as Merck and Smithkline must recognize that those companies are conducting the classic ethical blunder of selling products that are killing and injuring people -- and then concealing and denying the evidence.

A Canadian doctor who treats hepatitis B vaccine adverse event victims told me when he called Merck, they told him he was the first one who had ever called them with such a problem. There are upwards of 36,000 reports in VAERS and I would be delighted to provide them to anyone who cares to investigate the issue for themselves, sorted by deaths, convulsions, screaming syndrome, liver disorder and neurological damage -- median onset one day after vaccination.

That's What They Say, Here's What They Do

The CDC misallocated funds that were targeted for chronic fatigue syndrome (a vaccine adverse event) to some other non-vaccine related pet project. The ACIP Chairman recommended the Rotavirus Vaccine for premature infants without any data whatsoever showing that it was safe. The ACIP recommended the hepatitis B vaccine for newborns without any public, peer-reviewed, published study showing it was safe. The head of epidemiology of the CDC presented a slide showing serious reactions to the hepatitis B vaccine were approximately 10 times higher than for other vaccines at the February 1999 ACIP meeting. The CDC has ignored FOIA requests for the scientific data used to justify the 1991 newborn hep B vaccine mandate.

The CDC has violated its own mission statement and current leadership needs to be replaced. Most people don't realize that the CDC is a quasi-Military organization that takes great pride in dressing up in uniforms and strutting around one day a week.

There are exceptions to every rule. But the rules exists for a reason. Some people drop out of high school because they are too intelligent. Most people drop out of high school because they aren't as smart as they think they are and some people are just stupid.

None the less, she doesn't get to post lie after lie while ignoring facts and evidence all while claiming conspiracies and plots, then tell us that we don't know how to debate. I spent a lot of time thinking she was a bully, now I know she's just too proud to admit she hasn't got a clue about what an honest debate would even look like.

The stuff we post probably looks like Latin to her.

The stack of dead liitle patients presenting with suspected SBS would represent only the most severely nutritionally deficient group of children with nutritionally deficiencies. We should also see a larger number of live babies with milder symptoms. And yet, we don't. We don't hear anything about kids who got vaccines then suddenly started showing signs of rickets or scurvy

There's a reason for that. And that it's that vaccines don't create vitamin deficiencies that maim and kill children. (Of course, diseases do indeed maim and kill children. That's why vaccines are important.)
