When the judge overseeing Donald Trump's criminal trial found on May 6 that Trump had violated a gag order for a 10th time, he told him that "the last thing I want to do is to put you in jail."

"You are the former president of the United States and possibly the next president, as well," said Justice Juan Merchan, reflecting on the momentous weight of such a decision.

Whether to jail the Republican Party's presumptive nominee for president is a choice that Merchan may soon face again, if jurors in Trump's "hush money" case vote to convict him. Closing arguments began Monday, with jury deliberations to follow.

What exactly would happen if the jury finds Trump guilty is difficult to predict. Trump is being tried in New York state court, where judges have broad authority to determine when sentences are handed down after convictions and what exactly they will be, according to former Manhattan prosecutor Duncan Levin. That differs from federal court, where there's typically a waiting period between a conviction and sentencing.

"It's much more informally done in state court. I've had cases where the jury comes back and says, 'guilty,' and the judge thanks the jury, and excuses them, and says, 'Let's sentence the defendant right now," said Levin. "Obviously, everything's a little different about this case than the typical case."

Each of the 34 felony falsification of business records charges that Trump is facing carries a sentence of up to four years in prison and a $5,000 fine. He has pleaded not guilty.

Norm Eisen, an author and attorney, recently analyzed dozens of cases brought by the Manhattan District Attorney's Office in which falsifying business records was the most serious charge at arraignment. He found that roughly one in 10 of those cases resulted in a sentence of incarceration.
But he also cautioned that those prosecutions often involved other charges and noted the dynamics at play in Trump's case make his sentence particularly hard to forecast.

If Trump is found guilty, Merchan would have fairly wide leeway in determining a punishment, including sentencing Trump to probation or house arrest.

Levin said the option of confining Trump to his home, followed by a period on probation, might be appealing to Merchan, who has repeatedly indicated he's concerned about limiting a presidential candidate's ability to speak freely. Such an option would allow Trump to do interviews and access social media from his home.

From the day Trump was first arraigned, on April 4, 2023, Merchan has said he was loath to interfere with Trump's ability to campaign.

"He is a candidate for the presidency of the United States. So, those First Amendment rights are critically important, obviously," Merchan said that day.

And on May 6, he opined more broadly on the additional people who would be burdened by jailing Trump.

Merchan called incarceration "truly a last resort for me," saying, "I also worry about the people who would have to execute that sanction: the court officers, the correction officers, the Secret Service detail, among others."

Still, that day, he cautioned Trump that jail is not out of the question.

"I want you to understand that I will, if necessary and appropriate," Merchan said.

It's a possibility that officials in state and federal agencies have begun preparing for, according to a New York corrections source, who said the Secret Service has met with local jail officials. As a former president, Trump is entitled to Secret Service protection for the rest of his life, wherever he happens to be. Behind bars, corrections officers would in turn be responsible for protecting those agents assigned to Trump.

Where Trump might serve any sentence jail or prison sentence is one of many factors that remains up in the air. Shorter sentences can be served at the city's Rikers Island Jail Complex, which has two wings that are typically used for high-profile or infamous inmates. (Neither, of course, has ever held someone who comes with his own security detail.)

Officials must have a plan in place, just in case, said Levin.

"He could be remanded on the spot," Levin said.

Your unexamined assumption in life is this: that the powerful have it all under control, that whichever way events zig or zag, it was all war-gamed and every potentiality has already been accounted for. That is the assumption that I challenge in almost every single discussion we have. What if the entire Trump trials are, just as Trump said, utterly fake news? Have you considered that possibility? If, as you yourself would admit, we're living in a Truman-world echo-chamber, then why are you attributing ultimacy to the superficial? The enemy is Christof, and every agent is just another agent of Christof, that is, of the devil. While I pray that Trump himself is saved by Jesus, I don't know what's in his heart, and it is not my place to judge (Luke 6:37). That said, what I do know for sure is that Jesus has already destroyed the devil at the Cross and, through the Gospel, he is sifting through the wreckage of a dead world to seek and to save that which was lost. Thus, Trump or no Trump, Biden or no Biden, POTUS or no POTUS, the Gospel will prevail. The only question I am trying to solve in watching the signs (including earthly signs like POTUS) is "What is the Lord going to do next?" And not out of idle curiosity, but so that I can set myself about executing whatever orders from headquarters are apparent through God's action within the world. Thus, while you are existentially invested in seeing to it that Trump is never again in POTUS, it makes no difference to me one way or the other. A Trump victory in 2024 is a word from the Lord, and a Trump loss in 2024 is just a different word from the Lord. Either way, Satan is doomed and soon to be hurled into the flames, praise God.

All of this is trash and nonsense to get buy-in from "republicans". RFK Jr. has been speaking about legitimate concerns which few people are paying attention to. The other part that folks are not realizing is that with all of the pathetic Records among all politicians, the only solution is to forget about high level office [federal and state], and to instead return to localization,,, and like Tom Massie states: "Noncompliance is more effective than voting."

Though, there is little expectation there either.

Old ground. I'm invested because these people are inflicting suffering and I'd like to stop that, or at least ameliorate it. We've had this conversation I still believe we're to fight evil, not just wink at it and wait for God. I brought up Matthew 25 and you started sprouting dogma about how if I don't start with Matthew 24 I'm taking things out of what your favorite Pharisees consider the proper context for it and blah blah booyah just to avoid addressing my point. If you ask me Matthew 25 needs no context, it has it in the Parable of the Talents, and are you burying yours? But whatever.

Now. What does it have to do with the subject you seem to be trying to hijack the thread away from, to wit: Is this unprecedented persecution of a former president real, or just part of a psyop? And if it isn't just part of a psyop, why did they choose to gig him over something that isn't even illegal in this case, pit a DA against him who is completely compromised in that case, and just generally make sure they're all obvious clown shows guaranteed to fail?

Either answer is equally terrifying. If you get charged with a crime, and convicted, you're going to do real time, even if you're innocent of the original charges and simply couldn't successfully defend yourself. So, if the Trump trials are a PSYOP, then what court proceeding is not a PSYOP?! And if we're locking people in cages for decades on the basis of PSYOPs, then we are an insane culture. I'm not naive, I understand that this kind of activity has always gone on. But the difference is that, previously, the fig-leaf that was placed over it was real. And anyone who didn't want to participate in the dirty underbelly of the nation could stick to wearing the fig-leaf by just staying clear of DC and politics. But in Clown World, they have made everything politics, so there is no opt-out anymore, and the fig-leaf is now just a piece of cellophane.

So, in Clown World, perhaps the solution really is to fight fire with fire. PSYOPs are a game that two can play. Just because one side lives and breathes lies doesn't mean they're the only ones who know how to use camouflage and set an ambush. If anything, our side is better at their own stupid game than they are, we've only refrained in the past out of ordinary self-respect. They have miscalculated more than anyone has ever miscalculated anything.

Have you considered the possibility that there is literally no one else crazy enough to go after Trump on 100% fabricated nonsense? The Mar-A-Lago NARA case is basically DOA after the judge acknowledged the Trump team's arguments regarding evidence-tampering. That was a 100% known-variable from the day the charges were filed and nobody in their right mind would want to participate in that kind of no-fig-leaf, kangaroo-court lawfare. So yeah, the dementeds are the only kids left on the team. And if Q-theory is correct, then these maniacs are the core kernel target of the counter-PSYOP. The goal was to fish them out because they are truly the Deep State's last line of defense. They had to be pushed to the brink in order to force them to play their Ace-in-the-hole. They've done that and of course it's insane.
