It's true that "they" won't, but his defense attorney might. The difference between Terry Nichols getting life in prison and the death penalty was that his jury didn't believe the government was telling the truth about John Doe # 2.

He was also a graduate student before all this. Even afterward he acted "rational" enough to voluntarily surrender to police. There is more to this story. Graduate students just don't go planning a massacre for months and then carry it out with the methodology of a trained soldier.

Apparently he was on his way to becoming an "ex" graduate student. The Remington 12-gauge shotgun (retail price: $319) and another Glock handgun ($600) were bought at a Bass Pro Shop in Denver, police said. Authorities said all guns were purchased legally and within the past 60 days.

Colorado law allows a person to carry a firearm in a vehicle, loaded or unloaded, if its use is for the lawful protection of the person or another person or property, according to the Colorado State Police website. Colorado law also allows a person to possess a handgun in a dwelling, place of business or automobile.

Here is an oddity. The shooting range proprietor said he was phoned up by a fellow identifying himself as James Holmes but his voice was garbled and was altered to a low depth unrealistically. I am conjecturing that was not James who called the place. His friend claimed him to be fine a few days back. He could have gone to the range just by being normal..so what is that all about.. It is a part of the setup to create a crazy man patsy is my conjecture. Too many loose ends in this. The perp may have split and left a drugged on scopolamine and vicodin Holmes to take the rap convinced it is a movie he is in because that is what he was "told".
