Trump resumes Canada critique of Cruz

I'm not even convinced Ted Cruz is a citizen *now*. Every Way we have looked at it, Cruz is not a natural born citizen. But if it is true that Cruz's mother gave up her US citizenship - then Cruz was never properly naturalized, and isn't even a citizen now.

Interesting. But, either way, he is not a natural born citizen. He just isn't and that is the constitutional requirement to become President.

Never mind, all a big misunderstanding. It does not matter if the Cruz birth certificate
is found in Hawaii (on the same microfiche page as Obama's with the nice Photoshop font).

If Cruz was born in the United States, like Hawaii or Texas it would of course make a difference.

Rafael E. Cruz was born at Foothills Provincial General Hospital in Calgary, Alberta on December 22, 1970.
The hospital was built in 1966.

The child of Canada is listed as Birth Record No. 70-08-032264 by the
Province of Alberta, Edmonton Department of Health - Division of of Vital Statistics Certificate of Birth 332834

--------------------

Rafael Sr. left the United States at age 28 - he was late in applying to the Selective Service by 10 years (?)
- a criminal charge then for a resident alien - not sure when he became a Canadian citizen but certain
it was before Ted became an inhabitant in the USA to begin the child's naturalization in the United States
as a dual-citizen born in a foreign nation.

Under Canadian law at the time - she would have become a citizen if her husband was one -- something to add to the other thread and I haven't yet - but we speculated on it. so the argument she wasn't one falls flat. Plus she likely already gave it up in britain to her first husband. Yet it doesn't matter. Ted Cruz is not a natural born citizen so many other ways (like all of them).

Marrying a foreigner does not mean you give up your own citizenship. Cruz's father became Canadian in 1973- three years AFTER Ted was born and long after he got married.

Eleanor's other actions would make the US think she gave up her allegiance to the United States - left the country to reside abroad for the 14 years before her 5 year old second son to a foreigner came to the US.

Rafael and Eleanor were Canadian citizens before Ted ever became a child inhabitant of the USA to start his residence requirement under US law.

When did Eleanor become a Canadian citizen?

US law will be interested in when she first started accepting social services in England and then in Canada with
the two babies born to foreigners in two different foreign nations - neither natural born US Citizens btw.

Seems both Rafael Bienvenido and Eleanor Elizabeth could have become Canadians before little Ted became a US inhabitant . . . he entered the US with Canadian citizen parents . . . oh my!

I see. What sorts of social services was she accepting and is accepting social services proof of becoming a citizen of another country? If I used the National Health Services while in London would I have suddenly become a UK citizen?

Under Canadian law at that time, a wife automatically becomes a Canadian citizen. You don't need to apply for it, it just is - like being born.

Both of Cruz's parents were Canadian citizens, not just one.

It should be noted that most naturalization laws - we aren't even talking natural born now but any claim to citizenship - do not kick in if the kid is born outside the country and the parents don't remain Americans.

I'll have to look it up later this week for all the effects this might have, but the fact that both parents were Canadian citizens drastically changes the last little sliver Cruz could make as an argument. You will remember the representative of the family and mother lied and evaded that question. How they answered it might be telling. I suspect it was "did not apply" - but you didn't have to apply in that case - and becoming a citizen is quicker as a spouse. I'm sure Cruz's mother knows she was a Canadian citizen, she was on the election roll. And I'm sure just as equally that Cruz knew he had a Canadian birth certificate when "he renounced it" - legally meaningless - right before he ran for president.

Correct.
But a child born in Canada to a Canadian father means the child is not a natural born US citizen. Please show me where you can find that this scenario equals natural born ... Either in historical documents talking about the term natural born, or modern day. Show me where this scenario can equal natural born citizen of the USA.

You don't need to be a natural born citicen of the USA to be in the senate. Only the president.

You do need to be a Citizen for 9 years to be eligible for the US Senate . . .
if a dual-citizen with your birth right nation (Canada) that nation actually has international recognized rights
to conscript to the military in event of war,
and the dual-citizen would not be entitled to protection from the US Embassy while in their birth right nation, as a dual-citizen of both nations.

So, if Ted Cruz gets into a hot tub that happens to also be a time machine,
and he goes back in time on a Most Excellent Adventure to transport his own
mother across the US/Canada border only moments before he was born,
then everything's fine and Trump still has a chance to become POTUS, right?

If so, I'm all in for this time travel idea. Anyone but Clinton!

Another thought:

Does this make the best use of the B&T's MEA time machine, or should we concentrate on
something more pertinent to our times, and mess with... say, a young Abe Lincoln instead?
e.g., A $20 older hand-held video game could prevent him from ever learning to read.

Very true about the 9 year citizenship

They got married in 1969. Ted was born in 1970. Cruz's dad became Canadian in 1973- four years after they were married and three years after Ted was born. Canadian law would not have made her a Canadian citizen since he wasn't one either at the time they got married. Neither was Canadian at the time of Ted's birth.

http://www.ibtimes.com/why-did-ted-...enator-says-eleanor-darragh-makes-him-2266436

The Texas senator’s mother, Eleanor Darragh, was born to a Irish-Italian family in Delaware and was the first in her family to attend college, the National Journal reported in June. She worked as a computer programmer in New Orleans and Texas, and married Rafael Bienvenido Cruz, a mathematics graduate, in 1969, according to a big story published Wednesday in Maclean’s, one of Canada’s top magazines. Cruz’s parents moved to Canada to process seismic exploration data for oil companies in Calgary, and he was born there in 1970.

By 1974, the family moved back to Houston.

His father didn't become Canadian until three years after he was born. That scenario does not apply to Ted Cruz.
