Rick Santorum Says He'll Crack Down On Pornography

I want to know if that quote is even accurate.

Is he really saying that PPV porn on cable or in a cheap hotel room is illegal under current law? Or watching XTube? Or subscribing to Hustler?


Anyway this should be cause for concern. It seems like every time someone like Santorum goes on a crusade after some part of society they view as immoral it means they have some skeleton in their closet they're over compensating for.


I think way deep down he could be like Eliot Spitzer. He probably has a secret porno dungeon in one of his houses.

He kind of reminds me of the Patrick Swazy character on Donnie Darko. The guy ended up having a child porn dungeon.

I don't know of any current statutes (maybe someone can expand,) but the Supreme Court has left open the regulation of hardcore pornography. Roth v. U.S. rejected Hicklin (1868) and said that sex isn't synonymous with obscene but it does become obscene when it appeals to the prurient interest; there are statutes against using the mail to send obscene materials. Miller v. California went further and laid out a 3 part test for obscenity and basically said that hardcore porn can indeed be regulated.

I'm not sure exactly what Ricky was talking about, but there are some interesting legal questions brought up by this.

Really! We actually have prohibition of alcohol at the county level in this country? Wow. Crazy stuff.

Not prohibition, just no public sales.

I can drive 15 miles to the next county and buy all the alcohol I want, take it home and drink myself blind and share it with my friends, and that's not illegal.

But no bars, no liquor stores, even no beer/wine in stores or restaurants.

There are some localities that allow restaurants to serve beer/wine but otherwise prohibit alcohol sales.

Again, my support for such is not because I think alcohol should be banned for consumption, but I do think local communities should be allowed to vote on their on laws to a great extent.

Just like I don't have much problem with neighborhoods having regulations as to how the properties in that neighborhood are maintained, if I don't like it I won't buy a house there.

If local laws are untenable for me I can always move, and it gives citizens more control over their communities than if all Laws were from the State, or the National government.
 
Someone please explain to me how you would go about defining "pornography"? What is porn to some people might just be the JC Penny underwear catalog to others...You pretty much have to ban everything or nothing at all. (and I'm not talking about obscene material, just pornography. The supreme court has defined "obscene" in law).
 
Not that I've ever seen this sort of thing but I believe the courts have ruled that it's legal (at least according to Wikipedia). It can be illegal based on "obscenity laws". They watch it and judge how obscene it is on a scale. But you have to be doing something god awful to have your film banned and you go to jail for it...maybe something involving Santorum.
