what law did she brake? the supreme court made an opinion that same sex marriage bans are unconstitutional but they didnt write any laws saying that same sex marriages have to be performed. only congress can write that law. neither the federal govt or kentucky govt has any law stating that the county clerk is to issue marriage licenses to gay couples.

its a damn good constitutional argument and i wish it was rand that came up with it instead of huckabee. there's a decent legal argument that she is being jailed for violating no law

I spoke with Kim Davis this morning to offer my prayers and support. For those of you who don’t know, Kim is the Rowan County Clerk, a Democrat, who is under fire from the left for refusing to issue same-sex marriage licenses in Kentucky.

I let Kim know how proud I am of her for not abandoning her religious convictions and standing strong for religious liberty. She is showing more courage and humility than just about any federal officeholder in Washington.

Kim is asking the perfect question: ‘Under what law am I authorized to issue homosexual couples a marriage license?’ That simple question is giving many in Congress a civics lesson that they never got in grade school.

The Supreme Court cannot and did not make a law. They only made a ruling on a law. Congress makes the laws. Because Congress has made no law allowing for same-sex marriage, Kim does not have the Constitutional authority to issue a marriage license to homosexual couples.

Kim is a person of great conviction. When people of conviction fight for what’s right they often pay a price, but if they don’t and we surrender, we will pay a far greater price for bowing to the false God of judicial supremacy. Government is not God. No man – and certainly no unelected lawyer – has the right to redefine the laws of nature or of nature’s God. Five unelected lawyers have abused their power by ruling in favor of a national right to same-sex marriage with no legal precedent and with nothing in our Constitution to back it up. They have violated American’s most fundamental right guaranteed by our Constitution — religious liberty.

I stand with Kim Davis and every American of faith under attack by Washington elites who have nothing but disdain for us, our faith and the Constitution.

Her job is not to perform a marriage. She has never officiated over a marriage. She supplies licenses. The supreme court ruled that gay marriage is constitutional. That's the way the system works and it is indeed constitutional. Her office is to follow that law or, in cases like this, be found in contempt of following that law.

there is no law that you can point to in kentucky or the federal govt that says two people of the same sex can marry. all that was done by the supreme court was the striking down of a law. but no actual law has been written allowing for it. the courts cant write laws. only congress and state legislatures can. you show me the law she broke and i will concede. it seems to me that states can get around this ruling by simply not passing any same sex marriage laws. of course once that's written into law then you have to supply the license but as long as they dont put on the books they dont have to do it.

The guy in Taftfan's video is a lawyer who is making that case. are you a lawyer? I'm not but it seems like a reasonable argument to me and more importantly a constitutional argument. we dont want the supreme court to legislate now do we?

Kim Davis can have her opinion on gay marriage. She doesn't have to participate in it herself. But to deny two adults what straight people think they should have a monopoly on is crazy. Special straight rights have got to go...

As Rand has said, two adults should have the right to contract. Whether you want to call it marriage or a union or whatever to be recognized by the state does not matter, it's a contract in the end. I don't find it odd that Huckabee is supporting her since you know, he is a right wing fascist who wants to force his moral views on everyone.

And two adults have the right to contract whether they are same sex or not. You can't have a law denying that either because of your religious beliefs. That is was LAW is in most cases - to suppress and oppress. The state laws that denied gay marriage were unconstitutional. Now all of a sudden Ron Paul and Rand Paul supporters are against the constitution and bill of rights and creating special rights for straight people only? Shame on you...
 
Gay marriage is law now and there is no going back, Rand needs to stay the hell away or condemn Davis for not doing her job while maybe questioning why the government needs to license marriages at all.

He should do no such thing. I think he needs to stick to this middle of the road stance that he has at present. Huckabee is going down there and parading around out of desperation because Cruz has grabbed more of the Evangelical vote than he has and he's splitting the rest with Walker. Personally, I'd go down there and give her a vocal vote of confidence, but I'm not running for office nationally and thus wouldn't care what the hardcore left thinks of me or says about me through their media shills.

I 100% agree. Rand should have beaten Huckabee to the punch. This is a golden opportunity for Rand. It's the biggest news of the day and it's all on his turf geographically and politically. He doesn't need to make it personal about Kim Davis the woman. It's a states versus feds issue. And that should be precisely where Rand runs circles around all the others.
