Citing "significant percentage variances in four voting districts in Hillsborough County", Congressman Dennis Kucinich (D-OH) is requesting that New Hampshire's Secretary of State, William Gardner, "order a complete and accurate recount of all ballots in the New Hamsphire Democratic Presidential Primary election," according to a letter sent this morning, as obtained by The BRAD BLOG.

The letter (posted in full at end of this article) details a number of the discrepancies revealed by the recent post-election hand count in Concord, as paid for by the Democratic Presidential candidate's campaign.

The count was suspended this morning, when "funds ran out", according to the NH SoS website, making way for a Republican hand count challenge by candidate Albert Howard to begin tomorrow, as The BRAD BLOG reported earlier today.

"The magnitude of the variances in the four voting locations raise questions about the integrity of the internal vote accounting procedures in use in Hillsborough County," wrote Kucinich. "A reconciliation of the records of votes cast to voters who signed in and received ballots should have detected these problems; why multiple locations with large over-voting discrepancies went undetected in Hillsborough remains unexplained."

Kucinich's references, detailed in the two-page letter, refer to counts in Nashua Ward 5 where there were variances discovered in the counting as high as 4.9%; in Manchester Ward 5 where tallies varied 10.6% and in New Ipswich, which saw 7.5% differences in the hand count totals from the original count for one candidate. Those districts were all tabulated on Election Day solely by error-prone, hackable Diebold optical-scan voting systems.

As well, the hand counts revealed 100 fewer votes actually existed for Barack Obama, in the town of Wilton, than were actually recorded for him on the night of the election...

80% of New Hampshire's paper ballots are counted on the same Diebold optical-scan system used to hack a mock election, as seen in HBO's documentary, Hacking Democracy (watch the hack live here). New Hampshire has no human verification procedures for the machine counted ballots. The rest of the state's paper ballots are counted by hand at the polling place on Election Night.

It has been reported that the explanation for the large variances in Manchester 5 and Nashua 5 were due to clerical errors when Vice-Presidential write-in votes were mixed up with Presidential votes. Though Kucinich questions the explanation offered by local news affiliate WMUR, in his letter to SoS Gardner.
As of 10:00 PM EST on January 20, the New Hampshire Secretary of State reports 462 Democratic Vice Presidential primary votes were cast in Manchester Ward 5. However, the method by which 462 votes for two Vice Presidential candidates could accidentally have been recorded as 151 extra votes for 5 Democratic candidates for President within the same ward though a manual error was not further explained.

Yesterday, Wired's Kim Zetter tried to clear up some of the confusion about those numbers, as they were explained to her by Nashua's Town Clerk Paul Bergeron. The clerk from Manchester had yet to return her call before she filed her article. We'll refer you over there for Bergeron's explanation.

Whether the explanation for those errors are accurate or not --- we've not confirmed them one way or another --- what's clear is that the many variances in the vote counts discovered in just the single county to be counted so far, would not likely have come to light were in not for the Kucinich-funded hand count.

Despite disparities from the original Diebold machine counts found across virtually all candidates, and in all wards counted so far, the New Hampshire Secretary of State's office has been downplaying the miscounts.

"None of the results, as far as where the candidates finished, changed," Assistant Secretary of State David Scanlan is quoted telling AP today. "There were minimal changes in the different voting precincts. Where there were differences beyond one or two votes, we were able to explain them" as human error, he reportedly said.

Aside from the large errors referenced, there were many wards where tallies were discovered to be beyond "one or two votes," as seen on the NH SoS own "Recount Results" web page. We've posted a graphic snap-shot at the bottom of the article, of the mistabulations discovered for the three leading candidates, as of late last week.

Kucinich concludes his letter by writing that the "narrow margins of the statewide outcome" warrant a "manual verification of the remainder of the votes" before alluding to Gardner's earlier refusal to allow for the counting of the unvoted ballots. The campaign had requested such a reconciliation count before the process even began.

"Whenever there are indications of over-voting, an accounting of spoiled and unused blank ballots is also justified," penned Kucinich in closing, before requesting "thoughtful consideration and determination" on these points from Gardner.

As well, the SoS has failed to supply copies of the Election Day poll books. Counting the signatures in those books would allow the hand count observers to reconcile whether or not there are the same number of ballots as voters in each jurisdiction.

As The BRAD BLOG has reported in great detail over the past week, serious, related chain of custody issues which have emerged since the counting began in New Hampshire.

In addition to the decision to disallow the counting of unvoted and spoiled ballots, photographs and video taken by Election Integrity experts on the ground in New Hampshire have detailed the horrendous, unsecured shape in which boxes of ballots are being transported back to Concord for counting. Photographs detail unsealed boxes, in very poor condition, with openings large enough to easily reach in for the removal or addition of ballots.

It's also been shown that so-called "security seals" used on the boxes, as well as to secure the count room where ballots were stored last Thursday night, can be easily peeled away, removed and then restored without detection.

Also, as we reported when the count began, despite a federal law which requires the retention of all related media for 22 months after an election, Gardner has admitted that he has no idea what has become of the sensitive Diebold memory cards which are used in each machine to read ballots and store vote tabulation. Such a card was used to hack the mock election seen in Hacking Democracy. And it is the totals printed out from data on those cards, at the end of polling, which is used to determine the official state tallies.

The BRAD BLOG has spoken to a number of Kucinich representatives throughout the day, in trying to determine whether or not they will pay for counting to resume at a later date. While we've received different answers from the different people we have spoken to, the answer to that question may lie in Gardner's response to Kucinich's letter.

We will continue to bring you more information, as soon as we can offer any definitive, on the record, statements from the campaign.

I commented on this one in another thread, but I notice they have changed the recount number on their results page to match the original number now. I really want the rep recount to start, but i also agree with DK that they need to recount all the dem ones too.

And we wouldn't want anyone to see how many people came across the state line from Boston, either, would we?

A few weeks to complete the recount? By then, super tuesday will be overwith and the recount will be in vain.

I think if something obvious comes out sooner (remember they release the results every day so far) it should be big news. I would hope that Albert was able to get them to start with the largest county where Rudy got 9.11% as that one smells funny to me.

Total blackout, I read about the recount once in a foreign paper and some of the NewswithViews columnists usually cover it. Nothing else anywhere I've heard.
 
NH BLC/SOS Must Be Held Accountable

NH SOS has not yet posted ongoing Republican recount on http://www.sos.nh.gov? NH SOS has not made Election Day poll books available? (are these not in the public domain in NH?)...

IMHO, and with all due respect, this is nothing less than a public outrage against the citizenry of NH!

What does the SOS have to hide? Who do they work for, if not the People of NH? Who are the political appointees sitting on the Ballot Law Commission that is charged with overseeing SOS elections for the People of NH???

659:97 Secretary of State to Prepare Containers, Sealers. – The secretary of state shall, before any state election, prepare and distribute to each town and ward clerk containers to be used for preserving ballots and sealers to seal each such container. He shall prepare special containers and sealers to be used for preserving any special and separate ballots for questions to voters. IN OTHER WORDS, it would appear that the SOS's office is statutorily required to provide towns with uniform boxes for ballots and seals for said ballots, prior to the election.

Second, coming back to the Kucinich quote which indicates a lack of reconciliatio of unused and spoiled ballots, again quoting statute:

Immediately after the ballots cast at a state election have been tabulated and the result has been announced and the return has been made, the moderator or the moderator's designee, in the presence of the selectmen or their designee,

shall place the cast, cancelled, and uncast ballots, including such ballots from any additional polling places, and further including the successfully challenged absentee ballots still contained in their envelopes, in the containers provided by the secretary of state

as required by RSA 659:97 and shall seal such container with the sealer provided by the secretary of state as required by RSA 659:97.

Where are they? Have they been sent to Concord as required by law? (Note that the polling registration book is not required to be placed in the container).

In terms of running out of ballots, the NH statutes say: 659:24 Unofficial Ballots. – If the supply of ballots shall become exhausted before the closing of the polls, it shall be the duty of the town or city clerk to cause unofficial ballots to be prepared as provided in RSA 658:35. Except as provided in this section and in RSA 658:35, no ballot without the official endorsement shall be allowed to be deposited in the ballot box.

Are municipalities that prepare additional ballots required in any way to supervise and log their creation, log in numbers of additional created vs. used, control the master and inventory, and include any unused additional ballots with the uncounted ballots sealed in the "container"? Is this common sense implicit judgment required to be spelled out?

Where is the original number of ballots received in each municipality (from the SOS) recorded in NH and is this number available to the candidates requesting the recount? where/how?

A comparison of the SOS records on "number sent" and municipalities' stated "number received" is probably also a good chain of custody piece of information."

Mr. Albert Howard, We the People Foundation, BlackBoxVoting and many others are depending on grassroots participation to see this through to fruition. On Monday, New Hampshire's Union Leader editorialized as follows...
Whatever the recount's results, [NH Sec. of State Bill] Gardner has opened the process to observers so there can be no question about the integrity of the count. Doubters on both sides should let this settle the issue. If they question Gardner's integrity, then we'll know for sure not to trust anything else they have to say.

While The BRAD BLOG has reported, in some detail, on the incompetence of New Hampshire's Secretary of State, Bill Gardner, his failure to track Diebold memory cards, and many more issues revealed during the course of the Election Contests following the state's recent Primary Election, we've yet to question his integrity.

However, if this report from today's Nashua Telegraph accurately quotes Gardner, then its time to begin questioning him on that score, because now it would appear he is simply out and out lying to the media about the hand count results, and Dennis Kucinich's position on it, at this hour, as stated clearly in a letter sent yesterday to the SoS.

Tucked at the end of the Kevin Landrigan's Telegraph piece today on the latest "recount" news, are the following, virtually inexplicable, comments from Gardner...

"[Kucinich is] satisfied at the integrity of the recount, and it has concluded," Gardner said.

The recount revealed no evidence of irregularities in cities and towns that used electronic voting machines, Gardner said.

"There were only two examples of a significant change in the vote in Nashua and Manchester, and both were cases of human error," Gardner said.

Those statements are simply lies on a number of levels. But since the 2nd and 3rd sentences are little more than inaccurate spin, that we've countered with reality (as based on the actual numbers) before, allow us to just focus on the first comment of Gardner's.

If he's being accurately quoted there, and if his comments were made any time after yesterday morning when Kucinich sent his letter to Gardner, and on the presumption that Gardner actually bothered to read a letter from the candidate requesting a full state hand count of ballots as would be his job, then the SoS knows full well that Kucinich is not "satisfied at the integrity of the recount."

As we reported late last night, along with the posting of the complete Kucinich letter to Gardner, the Ohio Congressman wrote to request that the SoS, "order a complete and accurate recount of all ballots in the New Hamsphire Democratic Presidential Primary election" after "significant percentage variances in four voting districts in Hillsborough County," were revealed during the counting.

The complete letter, and details on those "significant variances" and many more such disparities, were posted last night right here.

It's likely that Landrigan had no idea about the letter when he filed his piece, since we were the only ones to have reported on it, exclusively, late last night. We've called him to find out for sure, but haven't yet heard back.

It's much less likely that Gardner was unaware of Kucinich's letter when he made those comments to Landrigan. We've tried to reach Gardner, but he and the Dep. Sec. of State are currently unavailable as they are presiding over the Republican-requested hand count that has begun this morning.

We hope he return our calls, and that he has an explanation for the obviously misleading (we'd say wholly incorrect) statement that he gave to the Nashua Telegraph.

The people of NH deserve an explanation for this kind of dishonest, deceptive behavior from their Sec. of State. As if the previous spin from his office --- sucked up and repeated by the majority of the corporate mainstream media, too lazy, apparently, to examine the evidence for themselves --- that "all is well" and no problems were found during the hand counts, hasn't already been outrageous enough.

We would like nothing more than to retract and/or add an update/correction to this article, if the NH SoS cares to call us back with an explanation. We'll even be happy to apologize if we're wrong. That would be very welcome news.

On the other hand, short of an explanation, we'd hope that even the Union Leader would join us in "question[ing] Gardner's integrity" if no such explanation is forthcoming."

Well here's my side of the story;

Fri, Jan. 11- Presidential candidates Dennis Kucinich (Dem) and Albert Howard (Rep) file papers and give $2,000 dollars each to start the recount process.

Wed, Jan. 16- Democrat recount starts, Kucinich only has to pay $25,000 up front, and can pay the rest later.
Howard must pay the whole $55,600 up front. The counting room is full with lots of Hillary and Kucinich observers. No problem getting all the help they need.

Wed, Jan 23- Kucinich runs out of money and stops the recount. They got about 30% of the Democrat ballots counted.

Thurs, Jan 24- Republican recount starts, there are eight tables set up with two counters(paid staff) per table. Observers(volunteers) sit across from the counters to verify the votes. We should have two observers per table, but only have one per table. The counters can only go as fast as the observers can verify the votes.

Fri, Jan 25- Dennis Kucinich officially drops out of race.

Day two of the Republican recount continues on, we have ten observers today.
Everything is wide open in plain site in the counting room. The counters do a great job, and are very helpful to us ( the observers). This part of the recount is very open and honest. Other things are going on behind the scene. Bev Harris with Black Box voting is investigating what happens where the ballot boxes are kept, how does the chain of custody work, what kind of security is there concerning the ballot boxes?
Bob Shultz (We The People Foundation) is here with camera crew, he is concerned with what happens after the votes are recounted? The counters fill out a form with the recount tally when they finish the box they have, then move on to the next box. If these sheets get changed somewhere along the way, who would know? We are getting copies of the sheets so that this can’t happen.

So far we have been doing all the precincts that the Democrats stared with, I think we’ll have this finished by Monday.
When the ballot boxes come in, the ballots are all mixed up, just the way they are fed into the machine. Dem and Rep ballots are mixed, upside down, reversed, and every which way but loose. The democrats had to spend a lot of time separating them before they could start counting.

It will be interesting to see what we have when we start getting fresh ballot boxes. Now the secretary of state Bill Gardner is telling us they have to stop counting after Monday for a few days to get some work done in the House. Schultz is saying this recount is the most important thing the state should be doing right now.

I’m not into conspiracies, but why would they not let us count while the Democrat count was going on? Why will they not let us continue counting fresh ballots when we finish these? Why do they need to stop at this point?

EXTRA! Just found out that the recount is not going to be stopped! Someone gave Gardner lots of pressure I bet.

Due to the obvious fraud which occurred during the New Hampshire primary earlier this month, the fabulous Granny Warriors mobilized and not only found a GOP candidate who cares about the actual vote count, but raised an enormous amount of money in record time to get a recount underway in the state. It would take several columns to go over step by step what a phenomenal job the Granny Warriors, Eric and Mr. Albert Howard have done to get the recount officially sanctioned. We all owe them a huge thank you and we also need to do our part NOW because what's happened since the recount was set to begin, has not only been reprehensible, those responsible in the Secretary of State's office need to be held accountable.

I was on the road from January 15-25th and fully expected the recount to be completed by the time I returned to Texas. On January 25, 2008, I spoke with a true American patriot named Eric, who has been on the ground since the beginning and has sacrificed a great deal for all of us. During our conversation, Eric informed me that the recount had been repeatedly delayed and there was a problem with the chain of custody with the ballots among other possible violations of the law. While listening to Eric as I was driving, had my rental vehicle been steam driven, I could have powered it the rest of the way home I was so incensed.

Mr. Albert Howard, the GOP candidate whose challenge made this recount possible, has sent a letter to the SOS informing them of what many of us already knew: the continued delay of the recount destroys we the people's ability to stop and challenge primary outcomes in other states for obvious reasons. There's no doubt in my mind these delays have been deliberate on top of the other shenanigans, i.e., while the Kucinich people only had to pay the $2,000 fee for the recount to begin right away, Mr. Howard's request for the recount was met with a demand by the Secretary of State (SOS) that $55,000 be raised within 48 hours or the recount was kaput.

As I said in my January 14, 2008, column, there's no question the office of the Secretary of State does not want the light shined on their ability to conduct fair and impartial elections. However, what they've done is patently un-American and they should be ashamed of themselves. Of course, they aren't because this is the moral rot that has been creeping into the American landscape for decades. Paychecks are more important than honesty and integrity. Party loyalty now takes precedence over truth. If the actions of Secretary Gardner of any of his personnel have violated election laws, they need to be prosecuted because no one is above the law.

Where do things stand as of today? According to what Eric was told on January 25, 2008, the process will move forward with no delays. This from personnel who have done nothing but play games for one day shy of three weeks from the pretend primary while the clock is ticking. There can be NO more delays. The horse and pony production called "Super Tuesday," February 5, 2008, where 22 states will be participating is closing in on those of us who want Ron Paul to win the GOP nomination this summer. We cannot take the SOS's (Secretary of State) word for anything at this point, we must act now.

What's next? I cannot go into details at this time, but there will be legal consequences to the actions of the Secretary of State's office and this is being worked. I will do an update when I have the details. These public servants have NO right to cheat the people of New Hampshire on this recount, but that's exactly what all this stalling and jumping through hoops has been about. As I said above, this delay has crippled the people's right to challenge the vote in other states and if this isn't resolved this week, the fraud will continue and Ron Paul's run will have been for nothing, cheated by electronic voting/counting machines and career bureau-rats. While organizations like BlackBoxVoting.org have done remarkable work over the years in fully documenting the fraud of the presidential elections in 2000 and 2004, the vote still stood even though massive fraud took place. We cannot let this happen with Ron Paul's run for the White House. Every primary means delegates for that convention this summer.

The obvious fraud prompted Mr. Howard to request this recount, but he has been stymied at every turn and time is of the essence on this recount which should have been finished ten days ago.

Additionally, certain individuals in the office of the Secretary of State have likely committed violations of New Hampshire's election laws and you are requesting the Governor do two things: (1) Step in and direct the Secretary of State William M. Gardner, to get the recount done this week, and (2) direct the Attorney General for the State of New Hampshire to open an investigation into likely violations of New Hampshire's elections laws, i.e., chain of custody of the ballots, slits in the ballot boxes and unlawful transport and security of the ballots:

NH Election laws including RSA chapters 39 & 40: 660:5: Conduct of recount. If directed by the SOS, the State Police shall collect all ballots requested from the town or city clerks having custody of them and shall deliver them to the public facility designated by the SOS.

Instead of the ballots being transported by the State Police, they were transported by Butch & Hoppy. Butch & Hoppy? As far as I can find out at this time, B & H are not personnel of the SOS, but something akin to independent contractors. BIG red flag for chain of custody and we have to get to the bottom of this travesty.

If you are a citizen of the sovereign state of New Hampshire, be sure to make that known when you contact the governor and AG's offices. I've been in this arena going on twenty years and I can tell you flat out that elected officials hate getting heat from outside their state, but they pay extra attention if the heat comes from a citizen because the governor and attorney general are statewide elected offices.

Call and fax the Attorney General's office. Tell State Attorney General Kelly Ayotte, you insist her office open a criminal inquiry into the actions of the Office of the Secretary of State regarding the recount requested and paid for by GOP candidate, Albert Howard. Irregularities include chain of custody of ballots, tampering with the ballot boxes, transporting the ballots, irregular security of the ballots, stalling and preferential treatment for the Kucinich people in allowing them to pay only the initial fee to begin a recount while requiring Mr. Howard to come up with $55,000 within 48 hours.

One note about Kucinich's recount: it has been stopped allegedly due to lack of funds. According to the SOS, Kucinich's people are "happy" with the recount that did take place. It is my understanding that the Kucinich people are not happy with the outcome of the limited recount. If Rep. Kucinich, even though he's dropped out of the race, is unsatisfied, then he will have to fight his own battle with the SOS. You can send email, but these offices get so much, most likely all you'll get back is a form response. A fax is something their office staff will physically receive and we need to bury the Governor's office and the Attorney General in faxes.

The phone call is equally important because their staffs will be overwhelmed and I say so be it. We CANNOT allow this type of malfeasance govern our political process.

Only tens of thousands of faxes and phone calls will motivate Governor Lynch and Attorney General Ayotte to move on this, so I would ask you to please take a few minutes out of your schedule today and tomorrow to flood the state house with phone calls (please be polite) and faxes. Eric, the Granny Warriors and Mr. Howard have given up so much for this recount; misery and headaches they should not have to endure. The least we the people can do is back them up with our action to make sure that recount is finished in a few days because the upcoming primaries will produce more fraud. Make no mistake about it and all our efforts and financial sacrifices to get Ron Paul the GOP nomination will be stolen from us.

Because of the mucking round by the SOS's office, Mr. Howard's expenses have increased. Another by-product of the under handed tricks by Secretary Gardner and his people.

NH SOS Recall?

Good idea:

Start a recall petition for the SOS and if possible, anyone connected to him.
You have to be there to do it, and I am sure people there are ready to go. Just look up how to do it and get started collecting signatures, it doesn't take a big group of people.
You need a honest SOS to regain your original birthright, so it needs to be done anyway.
