Paypal has frozen the fundraising account of the Granny Warriors, a Ron Paul supporters group who had been pushing for a recount in New Hampshire, causing a 3pm Tuesday deadline to be missed and the application rejected for lack of payment.

The Granny Warriors had raised the necessary $55,600 deposit for the recount but at the last minute before it was transferred to the New Hampshire Secretary of State, Paypal blocked access to the funds.

No explanation has been forthcoming from Paypal as to why the corporation froze the account.

"Emergency efforts by our folks on the scene in New Hampshire to push the recount through the Secretary’s office were not successful and a lot of frustration has been expressed on both sides as a result," writes a recount volunteer on the RonPaulWarRoom website.

"The problem was not with the Secretary of State for New Hampshire, it was with PayPal. I understand that the matter may remain unresolved and a recount may still be possible. I am hoping for additional information early Wednesday, January 16th."

However, The strict 3pm deadline for funds to be transferred imposed by Secretary of State William M. Gardner doesn't seem to be in accordance with the law, as Dennis Kucinich's Attorney Manny Krasner pointed out, only a written guarantee of payment is required to secure a recount.

On the Democrat side, Kucinich did transfer the funds in time for a recount and this will start today.

We just got word from Paypal after a all night battle with them sending them tons of information and verifying my legality and things that had absolutely nothing to do with this event. Anyway a very nice lady at Pay Pal realized the seriousness of this and looked into the whole thing and has unfrozen the account. The only thing that is frozen still is that questionable donation of $1000 that started the whole affair.

THANK YOU GUYS SO MUCH FOR YOUR CONCERN AND CARING FOR US. It really makes me feel so special to think people all over the country care about what happens to us. I am so priveledged to know this group and to be a small part of it.

The money was borrowed and we have the recount paid for and ready to go. The Secretary of State has the money and Mr. Howard has the signed receipt.

Now all we have to do is pay back the loan which we will do with the lady at Paypal so there are no more mishaps and we are good to go.

We are between Atlanta and Greenville SC now headed for the Blimp site for tomorrow if the ice storm holds off. Brrrrrrrrrrrr and I left that warm state of Texas for this? I must be nuts. But if Ron can take the cold surely I can too and he will warm us all up with his appearances.

South Carolina elections are unconstitutional? How could that be? Surely, no one in our government would conduct any election which violated the Constitution, and if any scheme threatened to undermine the very foundation of our government, our power to elect our leaders, the press would expose it, wouldn’t it?

After all, our government was founded upon the principle that all of its actions must comply with the Constitution. In fact, Article VI of the Constitution of South Carolina requires all of the State’s officers to swear an oath to "preserve, protect, and defend the Constitution of this State and of the United States." So, they would probably at least read it before enacting any new law, right?

Well, you would think so, but as most people now realize, far too many in power in our government believe that they are the law. I’ve had judges tell me that, but I’ll save judicial arrogance and lack of respect for the law and the facts for another day.

Of course, other government leaders may just think that if someone else in government has proposed something, then it must be Constitutional because of course, they would have checked that before proposing a new law or program. Besides, there is so much important work to do in the halls of government that there isn’t time to go reading everything and the Constitutions all of the time. After all, there are lunches, dinners, press conferences, and fundraisers to attend.

Whether it is because some think that they can ignore the law because they are above it or whether some don’t bother to read the law because they just assume that the one who proposed it did, a lack of respect for the law causes serious problems. John Locke said that without respect for the law, there is tyranny. We all understand that when the law is not applied equally, it is unfair, unjust. Obviously, when the Constitution is ignored, fundamental rights get trampled.

Our Founders understood that people would not devote time, effort, and resources to productive endeavors if the fruits of their labors could be taken from them at the whim of someone with power. They understood that any government which allowed its leaders to ignore the law, change the law at their whim, or trample fundamental rights harmed everyone and put everyone at risk. They risked their lives and fortunes in order to throw off the burdens of a government that could and did ignore their fundamental rights.

Our Founders understood that the people had the power to abolish any government which acted in a manner which harmed the public welfare, and they endeavored to give us a peaceful means of controlling our government. To prevent tyranny and the violence of oppressions and revolutions which flow from it, they designed a system of checks and balances which includes the three branches of government, the press, and the public through elections, the right to assemble, the right to freedom of speech, the right to petition for a redress of grievances both civil and criminal in nature, and through service on both trial juries and on grand juries.

In order to help guard against abuses of power, elections were required to be held on a regular basis. Of course, great care was taken to protect the power of the people to control their government through elections. Our Founders understood that without frequent and reliable elections, a government of and for the people would not endure for long. They understood tyranny, oppression, and revolution, and they wanted to protect their children and grand-children from such horrors.

They took care to make sure that our power to control our government through elections was protected from fraud and undue influence. They required that the polls be open to observers and that the ballots be collected, stored, and counted in public in order to minimize the chance that an election might be stolen. They understood the need to protect the integrity of elections long before Joseph Stalin said, "Those who cast the votes decide nothing. Those who count the votes decide everything."

So, how could it be that the government of the great State of South Carolina, one of the original States, would institute any system of elections which would violate fundamental principles? Wouldn’t the press raise an alarm if an election system was proposed which violated the Constitution?

The people wouldn’t stand for anything that would undermine their most fundamental right to control their government, or would they? If the vast majority of the people didn’t know what was going on because the press was controlled by a small cartel which chose to divert their attention away from changes which threatened to undermine their fundamental rights, would an alert minority be able to protect against erosion of our control over our government?

If very few people even understood our own history or studied our Constitutions because they were educated in a system which lacked any real competition, would an alert minority even exist? If so, would it be so small that it could not alert and educate the masses in time to protect our fundamental right to control our own government? Would it be able to overcome the beliefs, the assurances, and the illusion that our leaders are working to spread democracy, that we have an ability to control them, and that they are fighting for our votes?

Certainly, those people in our government are good, honest Americans, aren’t they? Those people on TV who bring us the news wouldn’t keep us in the dark, would they? Those people in the press have to search for news about movie stars and even bake sales. Certainly, they would want to tell us if someone were taking away our fundamental right to elect our leaders, wouldn’t they?

Well, for a very long time, I also thought so, and until Friday, January 11, 2008, at about 4:00 PM, I would have said that it was unlikely that the government of South Carolina would implement a plan to conduct its elections which blatantly violated its Constitution. I said unlikely because I have handled more election contests than any other attorney or former attorney that I know of, and I have first hand experience with proof that the official results of elections in Florida are false, as in not true. This means that these elections were most likely fixed, fraudulent, stolen. Of course, the votes were counted in secret.

Unfortunately, I know that for far too many judges who sit in our courts, the law and the facts mean nothing. The evidence we gathered meant nothing because the Florida state court dismissed the Congressional election contests saying it did not have jurisdiction even though a United States Supreme Court case said that a state court does have jurisdiction to entertain an action for a recount. I know that nine members of Congress who serve on the House Committee on Administration were willing to ignore the law and the facts in order to cover up for election fraud in Florida. I wonder if the voters in their districts know that they don’t care about respecting the will of the voters.

On Friday afternoon, I got a call from a concerned person in South Carolina. She told me that the upcoming Presidential primary would be conducted on touch screen voting machines and that she was worried that votes may not be counted accurately, or even worse, that votes may be stolen. That’s right, stolen. Many are worried about our elections being stolen. In fact, a Zogby poll from August of 2006 indicates that 92% of Americans are worried about our votes being counted in secret. (As mentioned in previous items, I'm now on the road, and doing my best to keep up while moving. So apologies for the terse reports for the moment, as I continue to roll and have limited time online.)

LATEST OUT OF NH: Disparities being found during hand-counts of ballots, in many wards, many candidates. Diebold op-scan memory cards unaccounted for at the moment, Secretary of State (SoS) doesn't track them after elections, doesn't track error reports during elections. LHS Associates (see below) handles all of it instead, according to reports on the ground. Public records request reveals hundreds of ballots in one area scanned as blank due to incorrect ink used on ballots, and other problems on LHS problem report forms.

Numbers are now being posted from both the Democratic and Republican hand-counts in the NH Primary Election contest. So far, only wards in Manchester (Hillsborough County) have been hand-counted, and disparities between the original counts from the Diebold optical-scan machine and the hand inspections seem to be occurring in many wards, and for many candidates.

Here is the SoS Recount page with the totals, that I haven't yet been able to review in full.

While sources on the ground at the counting today have told me that officials were not announcing the originally counted results at the counting room, the SoS web page lists what they claim are the original counts --- previously verified by nobody --- versus the recounted numbers.

The disparities, as I've quickly been able to review them, are small, but consistent, in ward after ward, across almost all of the candidates. I'm told that the manufacturers of the optical-scan machines (in this case, Diebold) have estimated an expected error rate of 1% on this type of tallying device which, as noted by one of our contacts in NH, is ridiculous, if you consider that most states and counties only kick in "automatic recounts" when the margin between the two leading candidates is less than .5% or so.

ADDITIONALLY...Public records requests are being made on the spot, for errors and malfunctions at various voting precincts. An early review of the error forms turned over from the public record request made by Election Integrity experts overseeing the counting, has revealed that in Stratham there were some 550 ballots that were not read by the op-scan at all. They were seen as blank ballots. Officials there noticed the problem, and then hand-counted some 3000 ballots after the error was discovered.

Apparently, as we've seen elsewhere, voters were given the wrong pen to use and the op-scanners did not "see" this particular type of ink.

Some of the election day error and incident reports, as read to me over the phone just now by Susan Pynchon of Florida Fair Elections Coalition and Paddy Shaffer of Ohio Election Justice Campaign, both of whom are on the ground in NH overseeing the counts, and assisting Republican contest candidate Albert Howard...
(Town of Stratham, 9:00pm)

PROBLEM: Printout indicated 550 "blank voted" ballots which indicated that bad pens were used.
SOLUTION: Went to Stratham to confirm that approximately 15 bad pens were used on election day. The town had, by that time, hand counted and announced those results as official.

PROBLEM: Too many blanks, used wrong marking pens
SOLUTION: Sent Gerry and Tina with lucid machines.

PROBLEM: Corrupt Count.
SOLUTION: Shut off and back on. Count back to 155.

PROBLEM: P/U 3rd Bad Machine per John S. (likely refers to John Silvestro, owner of LHS)
SOLUTION:

I spoke with Bev Harris of BlackBoxVoting.org, who is also on the ground in NH, and she asks: "If it wasn't 550 ballots, but just 55 or so in some places, would they even have seen it and known to recount ALL of the ballots?"

She also noted that the error report came from LHS Associates, the private company (with the, um, less-than-reputable background) that is the sole Diebold vendor, programmer, operator and service provider in NH and most of the other New England states.

LHS, apparently, is the one responsible for tracking (or not) and reporting (or not) any such errors, rather than the Secretary of State or local election officials, it would seem. That tracks with previous BRAD BLOG reporting on LHS, and how they operate in Connecticut, where there are similar concerns for whether or not the SoS even knows what the error rates are for the system they use, since problem reports are given to LHS instead of to public officials.

The BRAD BLOG has reported within the past few days machine problems during the election in a number of towns. In fact, of the first four towns we called that used the Diebold machines, all four reported machine failures of one type or another.

FURTHER...Voting Rights attorney John Bonifaz, legal director of VoterAction.org, was on the scene today, and just told me that he has great concerns about the transparency of both the initial election and the hand-count auditing process that got under way in earnest today.

"I'm very concerned that this is not a fully transparent process that is happening there," he told me.

The sensitive memory cards containing the programming and tabulation from the Diebold optical-scanners are apparently "missing in action" for the moment. Those cards, as viewers of HBO's Hacking Democracy know by now, may be used to hack an election, such that only a proper hand-count of the paper ballots afterwards will reveal the hack. (See the video of that hack for yourself right here. The same exact machine being hacked in that film was used across the state to count 80% of the ballots in NH in last week's primary.)

And yet, says Bonifaz who spent time today speaking with New Hampshire Secretary of State, Assistant Secretary of State and Deputy Attorney General, nobody seems to have any idea where those cards are and what has become of them.

He says he was told by Secretary of State William Gardner that his office doesn't get involved in tracking what happens to those memory cards. Some have reportedly been returned to LHS, and may have had their memory erased already.

"When you have a private company counting 80% of the votes, and you later learn that the memory cards are unaccounted for, you have a serious question about the transparency and accountability in that process," Bonifaz said.

He notes that federal law requires all materials from elections be preserved for 22 months after the election. So if those materials have already been lost, destroyed, or over-written, there are legal questions that must be addressed.

Bonifaz also noted that while representatives and observers for the Hillary Clinton and Dennis Kucinich campaigns were on site, nobody at all seemed to be there from either the Barack Obama or John Edwards camps. (Incredibly enough, I might add!)

The following document contains Andy's course notes for the class he gave at the CASE-Ohio "Teach-In" on May 7, 2005. This course basically contains the complete instructions for auditing an election conducted on a Diebold Optical Scan system, however Andy said that most of these instructions could also apply to ES & S or other vendors' equipment.

AUDITING YOUR ELECTION 101

What does that mean when I say "audit an election"? Well, an election audit looks at the election results to ensure that all proper procedures were followed, and that the votes were recorded correctly. In an audit, you can see if any votes are missing, or if any votes have been tampered with. While you're auditing, you will need to look at every document that the system produces, from the audit log, to the poll tapes, to the numerous reports that are generated during the election. It may sound like a difficult process to audit an election, but really it's quite simple. It comes down to following certain procedures, gathering the right materials, and taking good inventory of your records. It's a methodical and detail oriented task that takes some time and energy, but other than that, it's not that hard to manage. By the time you leave here today, you will have all the tools you need in order to audit your local election successfully.

Part One: Background information regarding electronic voting and terminology.

Electronic voting occurs in nearly every state to some degree. This might not be directly evident when you visit your polling site. Most ballots are counted electronically, whether the votes were cast on a touch screen computer or on paper ballots.

Election night procedure:

Once the polls have closed, paper ballots are collected and then counted with an optical scan machine. The optical scan machine then records all of the data onto a memory card. Absentee ballots are also recorded on separate memory cards. The memory cards are then delivered by hand to the central tabulator, or the data is uploaded remotely into the tabulator by modem. Then reports and vote totals are generated, and sent to the canvassing board. The canvassing board is a group of about 5-13 appointed members, who service the election. The canvassing board then certifies the results of the election, and makes them official.

Terminology:

There are a number of terms that I will be referring to in today's presentation regarding voting equipment, and voting reports. Here I'll give you a brief explanation of some of these terms.

Voting Equipment:

GEMS: Global Elections Management System. "GEMS is a state of the art election management software package that runs on Microsoft's Windows operating system." (let me editorialize a bit here...HAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHA)

Unity Election System. This is the central tabulator software. ES&S product

The ES&S Model 100 is a precinct-based, voter-activated paper ballot counter and vote tabulator. Utilizing advanced Intelligent Mark Recognition (IMR) visible light scanning technology, the Model 100 is a proven mainstay for jurisdictions worldwide utilizing precinct-level
voting and tabulation.

The AccuVote-OS Tabulator: The tabulator is a multi-functional terminal that counts and tabulates the ballots at precincts on election day and communicates with the host computer at Election Central for accurate and timely jurisdiction-wide results.

Voting Reports:

Statement of votes cast (SOVC): It is a breakdown by precinct of the number of votes cast in each race in every election.

Audit Log: is equivalent to the "black box" on an aircraft. It contains everything that happens in the voting system, and tracks the times and dates of all activity that takes place within the GEMS server.

Modem Log: Records the dates and times that any external communications commenced with the server.

Windows Event Log: Shows if any changes or patches were made to Windows, which could affect the operations of voting software.

Poll Tape: A printout, similar to a cash register receipt. Zero tapes are printed before the election, showing zero votes on the machine, and at the end of the election, the tape is run again to show the results of each race in the election. Zero tape and poll tape is signed by elections workers after they are run.

Interim Report: A report printed each hour on the hour during election night, that shows the breakdown of votes cast in each precinct. These are usually timed and dated stamped automatically.
Printing of this report will create an entry in the audit log.

Part Two: Overview of the public records disclosure laws'

Freedom of Information Act (FOIA)/Public Records Request: State and Federal laws that you will use to obtain the documents you need for an audit.

What to ask for in your public records request:
1.Zero tapes and poll tapes, date and time stamped, from the precinct you are auditing.
2.Statement of votes cast
3.Modem logs
4.Audit logs: from two weeks prior to the election, to two weeks after

7."Key" log and names of everyone who had access to the central tabulator
8.Names of all pollworkers
9.Copies of all "trouble tickets": any recorded malfunctions, reported by pollworkers.
10.Copies of absentee totals and provisional totals
11.Copies of all e-mail and correspondence between elections office and hardware/software vendors, and their contractors.
12.Certification documents for the AccuVote and certification documents for the GEMS software being used in the county.
13.Lists of all precincts

Part Three: Auditing the Election

Steps:

1. Inventory the materials obtained from your public records request/(FOIA). Look to see if anything is missing. Any missing materials are most likely your most important ones. Look at the audit logs for any gaps or lapses in time. Check poll tape totals against the statement of votes cast. Check the statement of votes cast against the interim reports. Check poll tapes against the interim reports. Regarding interim reports, they can be obtained through FOIA, but it is best to obtain one from the central tabulator on election night. That way it establishes a benchmark, and if any changes take place later in the process, you will have a document to compare to. Also,
look at the modem log to ensure that the modem was functioning properly on election night. Look at the trouble tickets to see what kind of problems were encountered on election night. Pay particular
attention to hardware issues such as modem errors, memory card failures, and transmission problems. Transmission and hardware failures will appear on the audit logs and modem logs.

Note any and all discrepancies.

2.Find errors, make a list of the problems that you found. Present this information to the candidate you are working for, and recommend further action. This action includes investigation of precincts where anomalies have been found, and a hand recount of the ballots from the

Recount is ongoing (Democrat first, then Republican)...NH SOS has accepted payment for NH recount (though NH SOS has not made statement on official website yet (only listing "Democratic"), which they promised in their initial press release below)...

..."Secretary of State Gardner announced that the recounts [note plural] will start Wednesday, January 16, 2008. The time and location for the start of the recount process will be announced after the estimate has been completed and payment of the estimated cost has been received"...

What is needed NOW is Patriot convergence on Concord, NH demanding transparency and accountability in the entire elections/recount process! Government is to serve the people, and the people must and will hold them accountable. Of the People, by the People, and for the People!

The more people, video cameras (with extra batteries), legal assistance and election expert witnesses for Liberty in NH, the better for America. There needs to be AT LEAST one (preferably more) public citizen(s) overseeing each official working in the recount process, especially in the tallying and other sensitive areas.

Pay Pal has been sending apologys but now has decided that I am a political campaign and now want documentation of my pac status... my lord what a mess they are. I have one of the supervisors private email address and wrote her, she didn't answer but did not stop me from transfering the money to our lender.. Thank Goodness that is done.

We sent Albert, $2,000 for the filing fees, $2,500 for living expenses and $3??.00 for the airplane ticket. I cant remember the exact amount the plane fare is but it is fairly close.

We just left Spartanburg where Chuck Baldwin spoke for Ron. There were some Rudy supporters standing in front and Chris ( who by the way is a radical) was yelling at them on the PA system which is very loud.... { hey guys why don't you take off those suits so people won't know Rudy paid you to stand in the cold) I dont think they answered back.

Chris also took our mobile radio set up and went to the Marriot where the event was going on and broadcast from there interviewing some of the other candidates supporters. Kind of funny and they really are not up to par in the brains dept.

Americans Reject Secret Vote Counts

As courageous and dedicated Americans like Mr. Albert Howard, Mr. Dennis Kucinich, Bev Harris http://www.blackboxvoting and their growing team on the ground in NH continue to fight the good fight in the NH Recount, the integrity of fast approaching Presidential Primary elections remains in question...

In a recent Zogby poll, 92% were against elections counted in secret (such as by machines):

Equal Treatment Under Law at the Polls...Restorable Overnight

"Ask yourself, what do you think Martin Luther King and those who worked for years in the civil rights movement would do? Would they stand by and let the fundamental right to equal treatment under the law and at the polls be taken away by a regime that wants to count their votes in secret? I think that Dr. King would be leading the effort to demand public vote counting. Some of his disciples are still around, but I haven’t heard their voices on this issue yet...
