A "unique situation"? There will probably be a lot more "unique situations" popping up as the police state grows.
 
The search lasted between an hour and a half and two hours, and it wasn’t until the final car was searched that police apprehended the suspect.

I guess that's a ray of sunshine. They didn't keep detaining people after they actually found a real criminal.
 
First I would have refused. Then when they forced me I would own the city after my false imprisonment lawsuit.

I wonder how far the police would have "felt it necessary" to escalate the situation if one of the innocent people had exercised their right to not allow a search to occur without a warrant?

Aurora police stopped dozens of cars and pulled out their drivers at gunpoint looking for a bank robbery suspect Saturday afternoon.

I don't want to endure having a gun pointed at me for standing up for my rights, or for simply being in a particular location. You only point a gun at someone you intend to use it on. To point a gun at someone you do NOT intend to use it on is the greatest insult to them and it literally threatens them with death. It's not some cute little "protocol" that you just do. You don't point a gun at someone like that. Everyone who grew up in a rural family knows this. To do otherwise is to assume we are slaves that can be threatened with death casually.

Police detained and handcuffed forty innocent bystanders after a bank robbery in Aurora, Colorado, on June 4. Nearly two dozen cars were stopped near a Wells Fargo Bank and the occupants held without probable cause as police searched for a suspect.

Police Chief Daniel Oates demonstrated his ignorance of the Fourth Amendment when he told CBS in Denver “the ends justify the means” after the illegal round-up snared a suspect. He described the mass detainment and handcuffing as lawful and necessary.

“The law is clear that investigative detentions are lawful for a reasonable period of time,” Oates said. “Reasonableness is determined by the facts and circumstances at issue, and the facts and circumstances were the suspect was in one of 19 cars.”

Oates then apologized to the innocent bystanders who were terrorized.

Probable cause under the Fourth Amendment is in effect when a person is detained or arrested and is not free to leave. Police can only detain a person when facts are sufficient to warrant an arrest or seizure of an individual.

In Gerstein v. Pugh, the court found that judicial determination of probable cause is required following an arrest. Evidence of crime and that an individual was involved in a crime is required.

A person arrested without probable cause may sue the government and the police.

None of the illegally detained in the Colorado case complained, according to Oates, although people with a better understanding of the Constitution and the Fourth Amendment called the police and objected to the gross violation of liberty.

The incident reveals that many police do not have a rudimentary understanding of the Constitution they are sworn to uphold.

I agree with your sentiment. However, I doubt that there is a high court in this country that would uphold a judgement these days. A case like this would be a wet dream for the police state to establish new precedent for a whole new level of handling the masses.

Yet when a plumbers tools get ripped off, the cops are nowhere to be seen. Wait... could it... it must be... the cops are the elites private army and the banks their piggy....errrr... bank.
