Oklahoma House passes 'Constitutional Carry' gun bill

The Oklahoma House of Representatives on Wednesday passed what has been dubbed as the ‘Constitutional Carry’ gun bill in a 59-28 vote.
The bill would allow all law-abiding Oklahomans to carry a loaded, concealed handgun without a permit, permitting handgun owners in the state to carry their weapon in most public places. However, some areas where firearms are already prohibited by law -- such as the ones listed here -- are still exempt.
Additionally, the bill’s author, Rep. Jeff Coody, R-Okla., filed an amendment that would permit handgun owners to also carry in a wildlife refuge or management area.


The Senate is expected to decide on the bill by next week, the representative said, adding that he thinks the chances of it passing are “pretty good.”
If passed, it will be presented to Gov. Mary Fallin for a signature. Stone said he doesn’t expect Fallin to veto the bill.

The Oklahoma Senate on Wednesday night passed the so-called “Constitutional Carry” gun bill in a 33-9 vote. The bill, which passed the state’s House of Representatives about a week ago, will now be presented to Republican Gov. Mary Fallin for a signature.
It’s not yet clear if Gov. Fallin plans to sign the bill, though Rep. Shane Stone, D-Okla., who voted against the bill when it went through the House, previously told Fox News he doesn't expect Fallin to veto it.
Gov. Fallin declined to say whether or not she plans to sign the bill, a spokesperson told Fox News, adding that Fallin does not typically comment on pending legislation “until after the final version reaches the governor's office, and she and her staff have a chance to review it.”
If signed into law, the legislation would allow handgun owners in the state to carry without first obtaining a license.

OKLAHOMA CITY (AP) — Oklahoma's Republican Gov. Mary Fallin vetoed a bill late Friday that would have authorized adults to carry firearms without a permit or training, dealing a rare defeat to the National Rifle Association in a conservative state.
The veto comes after opposition from the business community and law enforcement authorities, including top officials with the Oklahoma State Bureau of Investigation who have said it could erode public safety.

The NRA had supported the bill's passage and had urged Fallin to sign it.
In a statement announcing her veto, Fallin stressed her support for the Second Amendment and the right to bear arms and noted she had signed concealed and open carry measures in the past.
"I believe the firearms laws we currently have in place are effective, appropriate and minimal," she said. But she added that the bill would have eliminated the requirement for a training course and reduced the level of background checks to carry a gun.
The bill is similar to so-called "constitutional carry" legislation adopted in a dozen other states. It would have authorized people 21 and older and military personnel who are at least 18 to legally carry a handgun, either openly or concealed, without a state-issued license or permit.
The state currently requires a license to carry a handgun openly or concealed.
The bureau of investigation, which issues handgun licenses, had said the bill would cost the agency about $4.7 million annually and result in the loss of about 60 full-time positions.
"The impact on public safety is unquantifiable," bureau Director Bob Ricks said in a statement.
Many business leaders, including local chambers of commerce, also opposed the bill, giving the governor — who cannot run for re-election under term limits — plenty of political cover to veto it.
The Legislature already has adjourned its session so lawmakers will not be able to revisit the issue until next year after the election of a new governor.
The hot-button issue of gun rights energizes Republican voters, particularly those in Republican primaries, said Trebor Worthen, a Republican political strategist.
Several Republican candidates to succeed Fallin as governor urged her this week to sign it.
"Republican voters believe in the Second Amendment and they believe they should be able to exercise that right with as little interference from the government as possible," Worthen said. "Especially in more rural areas."
Fallin has vetoed gun bills before. In 2014, she vetoed a bill requiring state authorities to sign off on applications for federally-regulated items such as silencers, short-barreled rifles and automatic weapons within 15 days. But the Legislature overrode her veto and the bill became law anyway. In 2015, she vetoed legislation that restricted businesses from banning guns at parks, fairgrounds and recreational areas, a veto that remained in place.

I'm thinking your wrong on this one, buddy. I don't want a Federally mandated reciprocity. The reason...Federal mandates on it. I'm sure the NRA is ginning up support so their "NRA certified" instructors get top billing once the Federal "Conceal Carry" mandates come down.

That is what I am understanding this bill did.

I know that is what the NH bill did.

Am I missing something here...did it have anything to do with reciprocity?

Other than leaving a "permit" system in place to comply with states that do not have CC and have a permit system with reciprocity applied to OK?

Oklahoma State Senator Nathan Dahm (shown, R-Broken Arrow) and Oklahoma State Representative Sean Roberts (R-Hominy) are vowing to fight back against Republican Governor Mary Fallin’s veto last week of Dahm’s bill, which would have recognized constitutional carry in the Sooner State. Dahm was the principal sponsor of SB 1212, which stipulates that any person 21 and older, and military personnel who are 18 and older, can carry a firearm without a license. The bill passed the Senate near the end of the legislative session by 33-9, after having passed the House of Representatives last month, by a margin of 59-28.

But Dahm is determined not to stop there. He and Roberts are pushing for a special session which will address not only the concealed-carry law, but also other legislation vetoed by Fallin during her nearly eight years as governor. Fallin is term-limited this year.
Because the bill passed so close to the end of the regular legislative session, by the time Fallin killed the bill it was too late for the Oklahoma Legislature to override her veto. While the Legislature could not actually override her veto, the same bill could be passed in a special session, with the Legislature then remaining in session until after Fallin takes some action on the bill. Under the state Constitution, the Legislature can call itself into special session without any action by the governor if enough legislators sign a petition to do so. Two-thirds of the membership of the House and the Senate would be required to force a special session without the governor’s blessing.
