NYC - The chokehold death of Jordan Neely [VERDICT: Daniel Penny not guilty]

I get the feeling that this one isn't going to grow legs.

I don't know why, but protests now land on the Biden admin, plus I think most black people know that Neely was being annoying and could have easily been choked out by a brother with the same results.
 

I watched the entire video. Daniel Penny lied his ass off. He didn't "restrain" Jordan Neely. He choked him to death. Watch it here for yourself.



Note at 2:10 seconds in a second man his holding Jordan's hands so he can't defend his neck. Note at 2:29 seconds in Daniel Penny turns on his side. At that point the "restraint" became a choke. Daniel Penny kept the choke on for 51 SECONDS AFTER NEELY WAS NO LONGER MOVING! At 3:50 in Daniel Penny, in response to the question if Jordan Neely had any weapons on him, says "I don't know. I put him out." The officer asks "You say you just put him out?" Jordan Neely says "I JUST PUT HIM IN A CHOKEHOLD ON THE FLOOR!"

It wasn't until after being charged with murder that Daniel Penny changed to story to "I was just restraining him."



And this disgusting liar (Daniel Penny) claims he was in the vulnerable position because he was on his back? And when the murder happened he was no longer on his back, he was on his side. And there was a second man who has been holding Jordan's arms. Also Jordan was unarmed the entire time. You know who was armed? Ashli Babbitt on January 6th!



I held off judgment on this case until I saw the entire video. Now I have seen it. Daniel Penny got away with murder. He never should have "restrained" Jordan with his arm around Jordan's throat. He should have kept restraining him instead of cranking on a chokehold. There was no reason to use a choke or even a "neck restraint" when there was another man there holding Jordan's arms. He shouldn't have kept the choke on for 51 seconds after Jordan was no longer moving. Was this first degree murder? No. I don't think he intended to kill Jordan. But he absolutely killed Jordan Neely and lied about it after the fact and it absolutely was not a justified use of lethal force when there was a SECOND MAN there holding Jordan's arms right before he turned on his side and put the chokehold on.

I don't know how you can guarantee it but I do agree. There's a reasonable expectation that a chokehold will render someone unconscious before it kills them, but stimulants tend to keep people going past the point where they would otherwise pass out. I don't see where Penny had the luxury of a great deal of time to work that out.

Negligent homicide is still homicide. He shouldn't have kept the chokehold on that long after Jordan was no longer moving. In fact he had no justification to use a choke at all...which is why he lied about it after the fact. This isn't the worst thing in the world to happen, but facts are facts. Compare keeping Jordan in a choke hold for 53 seconds after he was no longer moving with Nate Diaz immediately letting go of a chokehold in a street fight as soon as the other person passed out.

Nearly a minute after someone has stopped moving after you had him under complete control for 6 minutes with someone else holding his arms seems a bit excessive.
