If this guy had 44 prior arrests to this incident, why was this person still being released? knowing the person would still get arrested and released?

I can only assume it is done intentionally. They release the dregs of society back onto the streets hoping for an outcome like this, that can be used to curry political points.

I agree. The marine probably feels like shyt over this and will regardless of what happens to him legally. The real villain here is the City of New York for not having adequate security on the subway. And they don't have to be cops. Paul Blart Mall Cop would do.

The real villain here is the State of New York for denying sane rational people the tools with which to defend themselves.

In this case, a good OC spray, backed up with a lethal force option, would have neutralized Neely without having to go hands on.

Our defender would not be facing life in prison for controlling Neely, Neely himself would have still been alive.
