RFK Jr. won’t appear on New York state presidential ballot after court rules he’s not a resident

Independent presidential candidate Robert F. Kennedy Jr. isn’t a resident of New York and will not appear on the Empire State’s ballot, a lower court in Albany ruled late Monday.

Justice Christina L. Ryba ordered Kennedy, 70, to not appear on New York’s presidential ballot, a move that will likely lead to efforts to remove him from other states’ ballots as well.

“Kennedy’s designation of the 84 Croton Lake Road address as his ‘place of residence’ was a false statement requiring invalidation of the petition,” Ryba wrote in the decision.

The Democratic-backed lawsuit argued that Kennedy was a resident of California despite listing a Westchester County home where he only stayed once as his address in election filings.

WTF?

I have no idea how this works.

Obviously, a candidate cant have a residence in every state.

Is he being disqualified on a technicality?

I don't think that's necessary in New York. He said he gave that address because, despite having his primary residence in California now, he still thinks of himself as a New Yorker. He was silly to give them an excuse.

Absolutely. This was already discussed a little bit in another thread. They're out to make sure He Who Must Not Be Named is named on as few ballots as possible. Subpoenas, yes, ballots, no. They're doing all the exact same things to Trump and him, but with two differences. They're telling everyone they're doing it to Trump; Kennedy, not so much. And they keep doing them to Trump in a ways that never seem to work, whereas when they do it to RFKJr they always seem to do it right.

His 'excuse' included statements like 'I pay taxes to New York', 'I have all my occupational licensing through New York', and 'I've been a New Yorker for 70 years'.
If that's enough to get someone extradited to a state, it doesn't make sense to prohibit ballot access.

It will most likely be appealed to a higher court because this can potentially affect his ballot access in other states.

I just want to know, if he loses based on this, can he get a full refund of his taxes in NY? Or doesn't that count :tears:

to trump it should because kennedy taking dem votes in tight states clearly benefits him

That's why the "OuR DeMOcrAcy" crowd is so anxious to exclude him from ballot access.

From my reading, a number of other states are now going to do the same thing.

Ya Id say the muh democracy idiots know they have a shot without losing all those kennedy votes

If any of you follow Michael Malice on Twitter he’s doing some homework on this RFK communication with Harris and Trump campaign. There’s some major lying going on with someone.
RFK suggesting Trump offered him the VP job months back and swears he would never support Kamala.

Can he not just resubmit his application for the NY ballot as a California resident? I feel like I'm missing something here.

Pays to read the article.

A quirk in the 12th Amendment of the US Constitution bars candidates from receiving a state’s electoral college vote if both candidates are from the same state.

RFK Jr.’s running mate, Nicole Shannahan, is a California resident.

So? It's not like RFK Jr is going to win the state of California. I asked what is prohibiting from resubmitting his NY ballot application as a California resident?

1. His desire to keep Nicole Shanahan as his running mate.

2. The 12th Amendment of the United States Constitution.

3. His desire to keep his veep and the flipping Constitution.

What's unclear about this?
