U.S. District Judge Tanya Chutkan sided with prosecutors on Monday to place a gag order on former President Donald Trump in the case related to January 6.

The gag order blocks Trump from comments “publicly targeting” the judge, Special Counsel Jack Smith, and “any other court personnel.” Trump is “absolutely prohibited as well” from issuing statements about their families, the Washington Post reported:

Even before the order was issued, Trump’s lawyer John Lauro said they would appeal any such order, as it would affect important free speech principles, particularly for a leading candidate for president.

Trump “can argue that this prosecution is politically motivated,” the judge said, but he cannot disparage the prosecutor by calling him a thug or “vilify and implicitly encourage violence against public servants who are simply doing their jobs.”

She is also barring Trump and all parties from making statements about witnesses in the case.

Special Counsel Smith brought four counts against Trump in the case on August 1. They include:

Count 1 – “Conspiracy to Defraud the United States”- 18 U.S.C. § 371
Count 2 – “Conspiracy to Obstruct an Official Proceeding” – 18 U.S.C. § 1512 (k)
Count 3 – “Obstruction of and Attempt to Obstruct an Official Proceeding” – 18 U.S.C. § 1512 (c)
Count 4 – “Conspiracy Against Rights” – 18 U.S.C § 241
Trump could serve a maximum of 55 years in prison, and could technically face the death penalty under Count 4.

Smith has aimed for a January 2, 2024, trial date during an election year and less than two weeks before the Iowa caucuses.

“Today’s decision is an absolute abomination and another partisan knife stuck in the heart of our Democracy by Crooked Joe Biden, who was granted the right to muzzle his political opponent, the leading candidate for the Presidency in 2024, and the most popular political leader in America, President Donald J. Trump. President Trump will continue to fight for our Constitution, the American people’s right to support him, and to keep our country free of the chains of weaponized and targeted law enforcement,” the Trump campaign said in a statement in response to the judge’s decision.

I feel he has no choice but to not comply if he intends to win a presidency

She probably helped Trump. He has a tendency to rage tweet things that either hurt his defenses in the various cases or further incriminate himself.

She definitely helped him. He would be expected to rage tweet and make the usual ass of himself, and now he has an excuse not to do it.

Doesn't change the fact that doing all this to a presidential candidate is unprecedented and a threat to the republic. Also doesn't change the fact that he's charged with doing things that a great many Democrats have also done.

What's also unprecedented is a presidential candidate with multiple indictments, especially one who has threatened to "come after" anyone who comes after him (which could easily be construed as witness tampering). Just because someone's a presidential candidate doesn't mean he is immune from gag orders that would apply to anyone else.

I have no love for Democrats, but what Trump is accused of goes way beyond what the Democrats may have done and is a far greater threat to the Republic -- e.g., urging Vice President Pence to unilaterally throw out electoral votes, sending false elector slates to Washington, badgering state officials to "find" votes to throw out, or otherwise attempting to overturn a presidential election by continually and knowingly spreading false claims of election theft, some of which resulted in a mob storming the Capitol.

Goes far beyond?

You cannot possibly know that, you're just repeating the indictment like a parrot. You cannot possibly know his claims were false, any more than I'm likely to sit here quietly if you claim that the fact judges threw out cases on technicalities proves something about anyone's guilt or the "integrity" of that "election".

So I pray you'll forgive me for disallowing your hearsay testimony, given that you are clearly no expert on elections.

Nope... He asked Pence to send it back to congress to investigate the vote fraud, to determine if the alternate elector slates should be used. That's not exactly unilateral.

He asked state officials to find illegitimate votes, not legitimate ones. That's kind of important.

Which party establishment does Trump represent? AFAICT, the R-swamp hates him as much as the D-swamp does. Is it all fake? Perhaps, but that's one hell of a show to keep up for so long. You would like us to believe that Mitch McConnell secretly supports Trump?

What he is accused of, yes. In a world where definitions are stretched beyond limit and words are butchered so much as to be meaningless . . . a charge, a loaded jury, and a highly partial judge will suffice.
