Irwin Schiff needs our help! An update from Peter Schiff.

Surprise... The court ruled against Irwin. My heart goes out to him and his family. The decision is another injustice from the "Just Us" department.

"Schiff next contends appellate counsel was ineffective for not arguing on direct appeal that the district court erred when it excluded certain legal materials during trial. This claim fails as well. Schiff has failed to demonstrate that he was prejudiced by the exclusion of ... two Supreme Court cases, which were likely to mislead and confuse the jury."

Ya, those court cases SURE WOULD have confused the jury since they are key to understanding that the income tax is a corporate tax and does not apply to us...

Hell, just having anyone talk in court could mislead and confuse the jury. Hell, that's why most people are asked questions in court, is to mislead and confuse the jury. Hell, the closing arguments are all about misleading and confusing the jury, at least from the prosecution side.

It was never ratified by the required number of states.
the reason that happened is because some states ratified an amendment with slightly different language.
but not enough of the states ratified the same amendment.
by that time in history, media was in firm control of the government... so they figured it was good enough. and just put it in as amendment regardless of the failure to get the required number of states to ratify it.

The 16th Amendment is not needed to establish the income tax in the law, but it has served a propaganda purpose in creating the impression that the tax is applicable to everybody, and that the jurisdiction of the IRS is unlimited. What the courts have done since the Pollack and Merchant decisions is to simply ignore the higher court precedents deemed inconvenient to universal (mis) application of taxes, knowing that their own new bad precedents would almost always not be taken up by the Supreme Court to be thrown out. Thus the High Court doesn't explicitly overturn its own precedent, yet allows the lower court rulings stand as the new bad case law.

The Supremes did the same routine relating to sales taxes, as the Supreme Court on Monday declined to hear a case by Amazon and Overstock.com challenging a law that requires online retailers to collect sales tax in states where they have no physical presence. Their own precedent clearly says the companies in that situation do not have to collect the tax, yet by not taking up the appeal, a patently bad lower court ruling stands, so under the new precedent online companies are now supposed to be collecting taxes even in states where they have no presence. The system is not merely broken, it's been deliberated wrecked to get the result the tax gestapo wants.

I've seen the arguments about the 16th not being properly ratified and I really think it's a distraction from the best way to "attack" the income tax. It wouldn't matter if ALL the states did ratify the amendment you cannot "ratify" slavery. Income tax in any form is a form of bondage that cannot be ratified no matter what process they use. Other things that cannot be "ratified" are robbery, murder, or any other violation of basic human rights...
