Doesn't mean it is 100% but creating buzz through controversy is the method used these days to bring attention to something. Ya know what they say in Hollywood, there's no such thing as bad publicity. The show is long in the tooth and ratings have been steadily dropping, even to the point of Fox considering cancelling the show entirely. With his story not making much sense, the show on the ropes (pardon the pun....and his paychecks too...betcha he pissed away most of his money already....he's eating at Subway) and new episodes premiering soon, forgive me if I think this reeks of a publicity stunt to get Empire back into the news cycle.

ooooh I forgot about Kamala's connection to the Smollett fakery until today. It still didn't help her 2020 campaign and Smollett ended up in the clink. Smoke and mirrors is her only platform.
 
11 March 2022: Sentencing and jail time


Three years after the hoax attack and first police report, Jussie Smollett was sentenced to 150 days jail time and ordered to pay a fine of $145,000 (£110,000).


His sentence also includes 30 months of probation.

The Illinois Supreme Court overturned disgraced Empire actor Jussie Smollett’s hate crime hoax on Thursday, ruling that he cannot be tried again.

Cook County’s State’s Attorney Kim Fox had initially struck a plea deal with Smollet, requiring the actor to forfeit his $10,000 bond and complete 15 hours of volunteer community service.

“We are aware that this case has generated significant public interest and that many people were dissatisfied with the resolution of the original case and believed it to be unjust,” Justice Rochford’s wrote.

“Nevertheless,” she continued, “what would be more unjust than the resolution of any one criminal case would be a holding from this court that the State was not bound to honor agreements upon which people have detrimentally relied.”
 
Much as I hate to admit it, they do make a convincing case for dismissal based on 5th Amendment grounds.

My question is, why is Kim Foxx not facing prosecution for obvious malfeasance?

I agree.

Smollett is an ass, and he deserves what he's getting - but it was given to him the wrong way.

The state did nothing about Foxx's blatantly unlawful tom-fuckery when she was doing it.

If they're still not going to do anything about it (and it doesn't appear that they will), then they shouldn't get a "do over".

And if that means Smollett would get by with no more than he had already been given, then so be it.

Exactly right.

The state prosecuted him and rendered a sentence.

Just because their system is fucked up like a snake in a lawnmower, doesn't mean they get to call a "Mulligan" and prosecute him again hoping for a better result.

Just so.

Having already imposed a punishment upon him (however inadequate that punishment might have been), they shouldn't get to circle back and say, "Oh, but it turns out we did it wrong, so it isn't legally 'valid' - and that means we get to punish him all over again."

If they really gave a rat's ass about legal "validity", then something (besides mere talk) would have been done about Foxx's shenanigans, and things wouldn't have been allowed to get to this point in the first place.

Even if the defendant is a scumbag like Juicy.

Anarcho-tyranny comes for all.
