A judge has ordered hate crime hoaxer and disgraced actor Jussie Smollett be released from jail on bond pending his conviction appeal. The move comes after Smollett’s lawyers filed for the actor to be released as he appeals his conviction.

An appeals court ordered the release of Smollett from jail on bond on Wednesday as the appeal of his conviction is pending, according to a report by Associated Press. Appellate Court Justices Thomas Hoffman and Joy Cunningham signed the order, while Justice Maureen Connors dissented.

Smollett’s attorneys argued that he would have completed the sentence by the time the appeal process was completed, and that the actor could be in danger of physical harm if he remained locked up in Cook County Jail.

On Thursday, Smollett was sentenced to 150 days in Cook County jail for lying to police after orchestrating a racist and homophobic attack against himself.

The actor, who is now a convicted felon, was also sentenced to 30 months of probation, and order to pay a restitution of $120,106, and a fine of $25,000.

In January 2019, Smollett had claimed he was physically attacked by two men wearing red hats who put a rope around his neck, poured bleach on him, and shouted racial and homophobic slurs at him, before eventually yelling, “This is MAGA country!” — referring to former President Donald Trump’s campaign slogan.

During Smollett’s trial, prosecutors showed how the former Empire actor had gone through extraordinary lengths to stage the attack against himself, and how he hired and paid Nigerian brothers Abel and Ola Osundairo $3,500 to carry out the attack.

Jussie Smollett’s Fake Attackers Recreate Hate Crime Hoax for Fox Nation: ‘This Is MAGA Country!’

The brothers who helped stage actor Jussie Smollett’s infamous hate crime hoax recreated the scene for a Fox Nation docuseries on the incident.

Former Empire actor Smollett claimed in 2019 that he was attacked by two men in the early morning in Chicago. According to the actor, the men tried to pour bleach down his throat and put a noose around his neck. He also claimed they yelled derogatory insults at him and declared it “MAGA country.”

The story fell apart rather quickly and Abimbola (Abel) Osundairo and Olabinjo (Ola) Osundairo soon came forward to say they were paid by Smollett to help stage the crime. In 2021, Smollett was convicted on five felony counts over what prosecutors described as Smollett’s master plan. The actor was sentenced the following year to 150 days behind bars, but he was released while his legal team appeals his conviction.

The Osundairo brothers told Fox Nation for Jussie Smollett: Anatomy of a Hoax they saw Smollett as a “fraudster” when he denied the existence of a hoax to the press.

Those lawyers are grasping at a straw in the form of a statement describing the sentence pronounced at the invalid trial. Someone said, he was punished by...

Well, he hadn't been yet. He still hasn't spent but two days in jail. His to-be fine is still just his bail bond until all this is settled. Both sentences were longer than that. A second trial is not considered punishment, no matter how expensive, time consuming and punishing trials have become.

That's why everyone is saying without saying that this appeal will only benefit his lawyers.

It's Chicago. They don't ask, is there some corruption in Chicago. It was corrupt for a century before any black people were allowed to hold any office in the city. They only ask if they're getting any of it.

Smollett is an ass, and he deserves what he's getting - but it was given to him the wrong way.

The state did nothing about Foxx's blatantly unlawful tom-fuckery when she was doing it.

If they're still not going to do anything about it (and it doesn't appear that they will), then they shouldn't get a "do over".

And if that means Smollett would get by with no more than he had already been given, then so be it.

Having already imposed a punishment upon him (however inadequate that punishment might have been), they shouldn't get to circle back and say, "Oh, but it turns out we did it wrong, so it isn't legally 'valid' - and that means we get to punish him all over again."

If they really gave a rat's ass about legal "validity", then something (besides mere talk) would have been done about Foxx's shenanigans, and things wouldn't have been allowed to get to this point in the first place.
