For Immediate release - NCEL - All 50 states are being sued to prevent the use of computerized voting systems during the 2008 primary and general elections and beyond. The lawsuit seeks to halt the use of machine-based voting systems and vote counting procedures that hide the ballots and the counting of votes from the People.

The NCEL complaint challenges the constitutionality of current voting procedures in the states, claiming that they "heighten the possibility of confusion, deception, frustration, and fraud." It contends that the existing practices are constitutionally deficient and prevent open, verifiable, transparent voting, and that the use of discredited electronic voting machines and flawed vote counting procedures drastically increase the likelihood of error and election fraud. The lawsuit calls for a visible chain of ballot custody with paper ballots kept in full public view throughout the voting, counting, and tallying process. The lawsuit asks the Court to prohibit the states from conducting elections that are not open, verifiable, transparent and machine and computer free.

The US Supreme Court has declared the meaning of the Right to vote, as guaranteed by the US Constitution. Individuals not only have the Right to cast a vote, they have the Right to cast an effective vote, meaning they have the Right to have their vote counted correctly. "We need to bring transparency and accountability to the voting process throughout the states," said Bob Schulz, who wrote the brief and is spearheading the nationwide effort. "We need to reclaim our vote and ensure that our voices are heard and that our votes are accurately counted. The only sure way to do that is to have the People, in the light of day, observe, verify, and secure the votes cast on paper ballots and to count those ballots before the public by hand."



Since at least 1988, the ballots in 49 states and half of New Hampshire are hidden from the people and counted in secret by computers. This procedure violates two Supreme Court rulings. NCEL was filed in all 50 states to remedy this freedom threatening problem.

NCEL was filed to restore hand-marked, hand counted paper ballots that never leave the sight or custody of the people until the ballots are counted and the results posted in each neighborhood polling place. This means machine-free, computer-free counts in our elections once again.

Haha yeah. But we still don't know 100% fraud happened. There could just possibly be a few stupid people in America believe it or not! I swear thats not a conspiracy theory lol. I do think vote fraud needs to be looked into.
 
you people just dont get it, this will never get past the few places for people who really care, and you are in the minority.

Just like they do with income tax, they jhust wont let it go to court and no one will give a shit.

Isn't it kind of late for this?? By the time that gets resolved, we'll already be in Pakistan and Iran with Hillary as the acting president.

sometimes i worry more about 'stockholm syndrome' in this "neoconned" MIC/banking takeover of republican party & country ... recount is easy ... pay for it it [ peanuts ] ; won't be first time voting fraud is exposed ... then advertise paper ballot as one of our policy changes and ask ~ you decide !

put best experts on this to do it in genius fashion ... great name recognition for the money !!!!!!

I checked the docket report on PACER, and it's definately a good case.

It seems all the defendant states have filed motions to dismiss for lack of jurisdiction, but I don't think they'll get it, since each state has a plaintiff attorney who has filed for admission pro hac vice, and I think the court has jurisdiction. The only problem is that the case, while simple and direct, is cumbersome due to all the different parties and the flurry of motions from each.

Plaintiffs (that's us) have filed for summary judgment, and I think it may be granted, if the court finds that it has jurisdiction over the defendants.

The court denied a request for injunction to keep the defendants from going forward with balloting.

The way it looks to be playing out, is that we'll get a judgment and defendants will file an appeal or 50 appeals.

We might get an injunction if we get the judgment, pending appeal, and that would be the only way this election would be effected by the case. The judge may not grant an injunction in the middle of an election.

The case seems to be on solid footing, well supported and demonstrates the inherant flaws in the machine/computer voting. i.e. fraud, error and conspiracy. I think we'll get relief, but I'm afraid it may come too late.

We've got this election by the ass, if everybody hangs tough. I saw a talking head on C-span II awhile ago, he has been in SC the past week, and said every other person he talks to is for Ron Paul, and they have a 62% Rep majority, and Independents are around 20%, leaving Hitlerybama a slim loss. They also have been right in the past 8 elections, sending the nominee thru.
 
The main problem is machines. NO more machines. Just say No.

BTW, there is no issue with the ability to hand count. We did it for a long time. Even the biggest populations are divided into precincts. Votes can be counted in one evening, easily.

Lawsuits need to happen now. The general election is a ways off. IF ron doesn't get the primary, there is plan b(search my name for the thread).

Either way there are plenty of local and state elections that are using machines. So once again, machines are the problem. Just say No to machines.
