I checked the docket report on PACER, and it's definately a good case.
It seems all the defendant states have filed motions to dismiss for lack of jurisdiction, but I don't think they'll get it, since each state has a plaintiff attorney who has filed for admission pro hac vice, and I think the court has jurisdiction. The only problem is that the case, while simple and direct, is cumbersome due to all the different parties and the flurry of motions from each.
Plaintiffs (that's us) have filed for summary judgment, and I think it may be granted, if the court finds that it has jurisdiction over the defendants.
The court denied a request for injunction to keep the defendants from going forward with balloting.
The way it looks to be playing out, is that we'll get a judgment and defendants will file an appeal or 50 appeals.
We might get an injunction if we get the judgment, pending appeal, and that would be the only way this election would be effected by the case. The judge may not grant an injunction in the middle of an election.
The case seems to be on solid footing, well supported and demonstrates the inherant flaws in the machine/computer voting. i.e. fraud, error and conspiracy. I think we'll get relief, but I'm afraid it may come too late.
