"Don't talk to the police"

Or are you saying, just because they're ticking you off with silence you then have right to harass or do violence to them? what are you getting at?
The longer you stay silent the longer you are going to be in the questioning room. If you're innocent, you can just tell us what you know and be off in time for dinner, or you can sit there like a little teenage rebel trying to make a point.

If you're not talking, you're hiding something, sorry. Maybe you're not, but you are sure making it look like you are. And we are going to to keep digging until we find what you are hiding. If you're not hiding anything, why put yourself through that?

That's just not common sense... fails logic and defies reason.

I would never want to put an innocent man behind bars, it's the last thing I want to do. But I'm sure as hell not letting a guilty man go free. If you are being quiet, you are looking guilty. If it walks like a duck, looks like a duck, and quacks like a duck... you're not going to be going free until we are sure you're innocent...

This is the new mentallity we live in. GUILTY until proven INNOCENT....

Have some CCT cameras everywhere!! WHY? If you have nothing to hide why do you mind?

Sacrifice your freedoms everyone!!! You are innocent you have nothing to hide!!!

Freedom is Slavery

A right to remain silent........it's a good right.

Any doubts we live in a police state?

This thread is definitely worrisome... well, that is, if this is a real cop, and if he's inferring this how all cops think. Then people, we are on a very dangerous road here.

And no, I'm not against cops, I think most are out there doing their jobs in a proper and peace keeping manner. Naive? Perhaps, so be it. I have two family members that were in law enforcement, just so you know, I know they were out there doing their jobs well.

But if this "cop" fella here is indicitive of the mentality of the majority out there, yikes people, we are in deep doo doo.

That is all.

No. It doesn't.

The point of the 5th amendment is for you don't testify as a witness for one crime, which while testifying could incriminate your for another crime that you personally committed some other time.

Call any lawyer, judge, police officer, anyone that is a professional of law, and they will tell you the same.

Hey, you're not a lawyer, but you do play one on the internet! :D

So I guess you haven't been on the force long enough to have ever given the Miranda Warning? The Fifth Amendment is not limited to testimony, officer. Get real. Two weeks and a test, eh? I've been studying the Constitution at regular intervals and watching the Supreme Court interpret it since, in all likelihood, before you were born. And I have beaten your brothers in blue in court when they have failed to respect it, and by extension, me. With and without a lawyer.

No tax on welfare checks, eh? Where the hell do you think you are? I know presumption and provocation are all the rage as police tools in this day and age, officer. I have also never known a time when police-general public relations have been worse. Do you suppose presumption and provocation could be a large part of that problem, putting the icing on the cake of ridiculous laws? Has your presumption that this isn't the libertarian, truly conservative forum it appears to be gotten you anywhere or promoted a positive image of law enforcement to the public? Grow up.

LOL. Hey, do you even know what the 5th amendment is?

More people who have absolutely no clue how law or the justice system works, giving out advice... sigh.

The constitution is great, if you actually know what the amendments are...

Exactly. So, why are you attempting to justify breaking the Constitution by spying on your fellow Americans? This is clearly unconstitutional and you know it. Or, at least you should. :(

Well you see, when someone is running from us, especially someone who just committed murder, we want to find them. They know they can't outrun us, they they like to do something... it's called hide. You know, it would be a little bit too time consuming to search every single house in a 300+ house neighborhood looking for the criminal... you know, much easier and cost effective to use technology. But I guess that never crossed your mind.

What are the chances that this "cop" is here to disgrace good cops? That he is only here to incite us to discredit ourselves by riling us up against the obvious arrogance?

I love the irony of his silence to my replies in light of his statement

If you're not talking, you're hiding something, sorry
lulz

So how can a person who committed the crime, also be a witness, brainiac?

Notice how this statement is worded?
As it reads, the person is already guilty at his own trial.

Strange how someone who claims to know the law doesn't understand a person is innocent till proven guilty.

We know how you're not a fan of the fifth amendment. How do you feel about the second? How about the first?

Ding Ding Ding! I believe we have a winner!:D

If this guy is a true RP supporter, then I'm voting for Obama! :D:p:rolleyes:

It's not the first thing we learn in police academy but we do spend 2 weeks straight studying it and have to take a test on it, I guess you still know more about it than me though.

Two weeks to learn the constitution? How long does it take to teach you the location of the bathroom?

The point of the 5th amendment is for you don't testify as a witness for one crime, which while testifying could incriminate your for another crime that you personally committed some other time.

What language are you typing here?

So how can a person who committed the crime, also be a witness, brainiac? It's obvious it does mean for another crime. It doesn't matter how you interpret the constitution, and we can all interpret it differently. What does matter is how the courts and judges interpret it.

And since 1776, they haven't once interpreted it the way you are saying. So nice try.

If a person committed a crime, I'm pretty sure they witnessed it. At these things called trials, they can be questioned on the stand. They could be cross examined.

"Did you commit the crime?" They don't have to answer. Same works for questioning by any officer of the court because you might as well be in court when talking to one of them.

You or the person teaching you what the constitution says can interpret the constitution in any manner. Does not make it the correct interpretation. The people tell the courts and judges how to run the country, not they other way around. If they interpret something incorrectly, the people should let them know promptly.

So you will ultimately put an innocent man in jail for not talking. I can only imagine the lawsuit. What was the purpose of false imprisonment? He wouldn't talk to us.

What are the chances that this "cop" is here to disgrace good cops? That he is only here to incite us to discredit ourselves by riling us up against the obvious arrogance?

Have been suspecting troll behavior, but I could actually hear some cop making these exact statements. It makes my heart hurt.

Yeah, mine too. I can understand a mediocre cop thinking the Constitution is just a stumbling block, but without it how much harder is it to have a civilized yet free society under the rule of law? Down South here we have a popular old saying-- Any job worth doing is worth doing right.

We like it when people cooperate with us... being a stubborn ass isn't going to help your cause. By not talking, it creates more unnecessary work for us. If you want us to extend courtesy to you, you must also extend courtesy to us. We are just trying to do our job, and when someone makes our job harder, it doesn't exactly make us happy. Just as no one, on any job, would be happy if someone was hindering their work.

Cops, where do you work. We want to know what force you are on because whoever is in charge is obviously not doing a good job. We think they may be violating the constitution in a habitual manner. If your force is harrassing people just for exercising their constitutional right not to talk to you we have a need to know so we can do something about these criminals.

Will you cooperate or will you be uncooperative and make our job harder? We don't like uncoopoerative people. What's it gonna be, boy? Put up or shut up.

What? I'm enjoying counting the minutes of Constitutionally guaranteed silence that he and RPH are getting for turning the tables.

Cop's increasingly questionable knowledge of the Constitution may be cause for concern, but I've got no burning desire to encourage sratiug to go off on one of his benders.

Message to CopThatSupportsRonPaul :

TITLE 18, U.S.C., SECTION 241

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same;...

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnaping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

And finally:

The Constitution of the United States of America
Article 1 Section 8:
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repeal Invasions;

So please let all the other cops know that they need to decide with side to be on, that of liberty, or that of tyranny.

And accept the consequences. If you side with tyranny, don't be all victimized and feeling sorry for yourselves when the consequences come. I know how it goes: stupid cop enforces stupid law with thuggish attitude, stupid cop gets capped, all other stupid cops go into "boo hoo poor us " mode for a week, black bands on badges and bagpipes all around. Stupid cop who did not do his homework is then deemed "a hero" and of course more laws are clamored for to protect more stupid cops.

That used to work, but not anymore. We are onto it.

Brain up, and pick a side. There is a reason why they won't hire people above a certain IQ.

But we all know that Sauron likes his orcs to be mindless, don't we?
