Who would you appoint to the Supreme Court?

With 3 justices likely retiring soon...who would be your choice to replace them?

I think Napolitano is obvious, though I wish he wasn't 62. Another is Randy Barnett, and too bad he is 60. I am aware of many notable strict Constitutionalists out there, other than those two.

Mike Lee would by my choice. I liked the Judge for the next Supreme Court justice, until I heard him say that he believes there's a right to "gay marriage" in the Constitution. That's the same view of the Constitution that liberals have; they believe in making up rights which don't exist.

Which justices are "likely" to retire soon? And what is "soon"? The oldest judges are only in their 70's and only one is older than Ron Paul, by a year. I don't agree with your opening premise.

Randy Barnett is a hardcore anarchist, and the Judge is pretty much one himself. So, yeah..., not 'Constitutionalists' in the sense you use it (authority of argumentation, end goal, etc.). Randy would never give up his Law position for a Government-robe on that damnable bench. I doubt he would ever get past the process in the first place. Could you imagine the Government-Media cohorts running his articles and papers 24/7? Actually....that would be interesting to watch on second thought.

There are NO "rights in the Constitution". The Constitution merely guarantees pre-existing inalienable rights. The Constitution begins from a baseline of inalienable rights and carves out very specific powers for government. Gay marriage and eating radishes enjoy equal Constitutional protection, as no power limiting either exists in the supreme law.

Unless you appoint five people who are ok with reversing previous decisions, you won't get anywhere. And anyone who admitted they would overturn prior decisions would never get confirmed, unless the congress was mostly liberty people.
