what to do at police 'checkpoints'?

so new year's night i'm betting there will be a ton of checkpoints set up around the nation; what's the best way to handle this situation?

i've seen the youtubes of that guy asking "am i being detained?!" repeatedly; will that work w/o pissing off the pig and leading to a worse scenario (legal or not).

crack the window and inch or two and hand the pig your license/registration/proof of insurance all while answering his questions with ,"i do not wish to discuss my affairs with you officer, but i know i am required to show you my drivers license/reg/poi. would you care to look at them?"

avoid the checkpoing entirely? (are they all required to have an avoidance route?)

also, any good ideas on getting some restitution for the troubles of suspiciousless stops? formal complaints? newspaper contacts? youtubes?
 
Check your local state laws. I believe they're required to announce where the checkpoints will be before they set them up.

they publish a few sentences in the newpaper a few days before the day of the checkpoint, but it never gives a location. something to the affect of 'On Wednesday night police will set mandatory sobriety check points in ____ county.'

2. Be happy and 100% cooperative.

3. Do not start spilling out your rights.

4. Avoid confrontation.

5. Do not carry anything illegal.

6. Do what you are told. If they want to search let them.

7. If cited, do not argue with the officer.

8. Be polite with please and thank you's.

9. Do not speak unless spoken too.

10. If you done nothing wrong, and you are cited, or jailed contact a lawyer.

11. If you are approaching a road block - do not turn away, they will pull you over and you will be under suspicion of hiding something and you will have an unpleasant experience.

Use those steps and you will get in and out of it fairly quickly. Remember the cards are stacked deeply against you - now is not the time to be a rebel - you have no one to back you up.

Be courteous and respectful, follow instructions, don't argue, don't threaten, mind your manners, cooperate, etc..<IMHO>

( ya know, the same things as when confronted by any other armed thug with life and death powers. ;) :D )

Sincerity is the most IMPORTANT thing. When ya can fake that, ya got it made. :)

If you see a checkpoint then high tail it the other direction at a very high speed. This will get the brainless pigs to chase you, then you ditch them by turning real quick into a back alley.

very good response and i agree with most of it (and with the fact that the time of the checkpoint is not the time to fight the constitutionality with the pig).

3) could you politely inform the pig that you have a 5th amendment right not to speak to him, but that you'll happily provide your papers (license/reg/insurance)?

6) same as 3; could you 'protest' with your words but allow the serach to occur? i.e. could you say, 'i don't consent to this search' while getting out of your car?

9) 'i do not wish to discuss my affairs with you officer but here are my papers if you wish to check them'

11)i think checkpoints are required to have a right turn before the checkpoint for one to avoid it. but like you said, they'll probably be waiting for you on the alternate route too. does avoiding the checkpoint impart a reasonable/probable cause to pull you over? i heard they usually bust people on the alternate routes for seatbelts, speed, etc. which then allows them the standing to perform more intrusive searches?

come on LE, they don't read stupid little forums on the net, right? and the DHS? i thought they were supposed to prevent turrurists? wouldn't it be the FBI or CIA?
 
i'll all about not getting killed or rendered to another country. i all about liberty and freedom. how best does one balance this in the midst of an unconstitutional bloackade and search?

i realize screaming "am i being detained!!!" is not the best way, but i want to give up as little as possible all while remaining a mouth breather.

#6: is in direct violation of rights. I agree with everything else except this. It might waste your time and the cops, but now is not the time to be fully compliant either. Just be respectful and don't say anything you don't need to. Don't blurt out your amendment rights until they come under fire. Don't blurt out "you can't search me!" if the cop isn't saying anything. The less you say, the better.

They do studies don't ya know, on this. All the people who do not object to searches will be duly noted in some bureaucratic study. If the results look good, they expand their tentacles and only add more checkpoints. It's your duty as an American citizen to protect the Constitution and reject a search, but only when you come under fire.

#10: Always contact a lawyer anyway. Then, contact the ACLU if it looks like a good case.

And ALWAYS be polite. The majority of police are merely the knights on a chessboard being pushes around by the royalty and bishops. It's their duty to uphold the "law" and it's not their fault if they are stationed at a checkpoint. If they begin to rough you up for no reason, ask for their name and badge number and file a complaint with the local police department, state dept., governor's office and ACLU. Be as descriptive as possible.

You could've shortened your post by simply saying "Pucker up, kiss cop ass then bend over and let them have their way."
