What has Judge Napolitano said about SCOTUS Obamacare decision?

Does anyone have any video or commentary from the Judge? I would be interested in seeing his take.



There is a theory floating around (Ben Swann) about how it is now invalid since it is a "tax" and was introduced in the Senate. I would like to know his take on it?
 
Not really related to OP but I just read an article on CNN that praised the decision as a "proud day for bipartisan deliberation." I just thought that was funny.

Wow, that's interesting. So Roberts has stated that he will do everything he can to rule acts of Congress as Constitutional?

Perhaps his true secret agenda is to end (or limit) judicial review? If he states upfront he will rule everything Constitutional, that pretty much takes them out of the business of judicial review.

It doesn't matter. What yesterday proved was that there simply is no longer a Constitution or rule of law. The leftists have taken over and are now capable of getting anything they want with any absurd excuse they care to use. They no longer even care if the excuse is superficially plausible.

What Judge Napolitano thinks no longer matters. Votes no longer matter. Opinions are just so much noise. Whoever is elected in November is irrelevant. The very best that can happen is that the march to a completed totalitarian state might be delayed a few weeks or months. The die is cast and the collectivists have won. It is over.

The founders of this nation warned us not to fall asleep at the switch and we ignored them. The only remaining options are to refresh the tree of liberty or forever be slaves to our own government. Buy yourself a gun.

Votes do matter, who is elected and who governs matters. But the state level is where our focus needs to be IMO.

CNN is as much in the tank for Obama as MSNBC; christiane amanpour called the decision a great victory for all Americans

Matt, I used to think so too. And BTW I was/am a big RP supporter. Doesn't matter. I have been watching this for more than half a century. Votes only matter if someone like Ron Paul could get elected. He can't. They won't let it happen. There has to be someone real and genuine for whom you can vote. There never is. All they ever present is puppets. And if you look carefully, the puppet master has one puppet on each hand; right and left. There is no real choice except to take one more step toward slavery. Yesterday our fate was sealed by a genuine traitor to the Constitution and more importantly, to liberty. You may not see it now. Many people won't. But the game is over. Your vote in November will count for nothing, regardless of who wins.

A whole 'nuther NEW court action will now have to start to make the case that the Obamacare TAX originated from the Senate, which is blatantly unconstitutional.

You are making the same mistake we have all made for years. It doesn't matter what the law or Constitution say. They will simply move the goal posts, as they JUST DID! Truth, freedom, justice, none of it matters. The only thing that matters is what they want: your freedom. Lots and lots of people tried to use the law and German constitution to stop Hitler. There was no possibility of success because the game was rigged. No doubt they made dozens of completely valid legal arguments to stop Hitler's actions. They wasted their time because they made the erroneous assumption that victory was within the realm of the possible.
Our country has be taken over by leftists and there is no possibility they will willingly give us our freedom back.

Perhaps so. The Supreme Court is not granted the power of judicial review by the Constitution. They just assumed power that was not granted to them. This move clearly shows that they do not intend to use that power now. It also fits the narrative that Judge Andrew Napolitano mentioned in his response. "... it (the court) thinks of how generations later and even centuries later ... lawyers and judges, obviously as yet unborn, will look back on this day, and ascertain their intellectual honesty".

The time is ripe for the people and the States to reclaim what is rightfully their Constitutional power.

I believe Peter Schiff said that this tax is not Constitutional as the only direct tax is the one layed on income.

All politicians react to pressure in very specific ways. If you put enough pressure on a politician, at the right time, and on the right issue, you can get them to change their vote. On the state level, it's very easy to do (compared to the federal level) most state legislators will change their vote if they hear from a dozen of their constituents on most issues.

If you can get them on record saying something bad or voting poorly, then if you can communicate that to the voters in the district, you can cause them immense pain and thus change their behavior. If you do that enough they will eventually start voting the right way.

It's incremental change we are working for, not quick immediate gratification. It took over a century to get here, it's going to take us close to that to deconstruct it. Before we can destruct the skyscraper we have to stop building it.

What state do you live in? Is your local CFL active? Do you know who holds the power in your state legislature? Do you know your State Rep and State Senator? What legislation will be focused on in the 2013 session? Have you worked to get any bills killed?

Yes, by ruling it a tax, and it originating in the Senate, it is BLATANTLY unconstitutional, but that question was not put to SCOTUS so they did not rule on it. A whole 'nuther NEW court action will now have to start to make the case that the Obamacare TAX originated from the Senate, which is blatantly unconstitutional.

By ruling it a tax based on the amount of money changing hands it is by definition an income tax. By now everyone should understand that an income tax applies to everyone but the people.
