"We're setting the dogs on your car!" What's the proper response in this case?

The best thing to do is just cooperate. If you piss off the cops they will find BS reasons or make stuff up to bring you in to jail. The charges might be dropped with no proof on their part, but you will still be out of thousands of dollars to defend yourself and probably out of a job unless your employer likes you missing 2 weeks of work because you're in jail. It's not worth the struggle. Just comply.

I suppose you could take this route. Then again this route is what has left us exactly were we are. Fooked.
 
Sounds like many people on a forum where the primary purpose is the discussion of a strong Constitutional candidate are willing to comply, cower, and/or not understand/defend their rights.

Just comply? Like my friend did when we were 18, and the cops stuffed a 1/2 ounce of pot in his car? That Felony conviction hasn't gone away.

Or how about the time I complied when I was 20-and lost my job because of it, because the assholes kept me held up for over an hour tearing my car apart?

Do not "cooperate" but do not "resist" either. As a previous poster said, cases can and do get tossed if the dogs take too long to arrive. However, if they happen to have dogs with them, then they can search your car if they have probable cause of drugs. They may not need probable cause if dogs are not defined as a search in that state.

This is usually documented with standardized phrases, such as "red, bloodshot eyes" and "slurred speech". Recording, if legal in your state, can help here to dispel these claims. Beyond that, the police will search your car if they have probable cause.

However, searching the car after an arrest for evidence on a separate charge does not work though unless the police had probable cause for that offense. This is the Arizona v Gant case.

You may notice the one word I have not said is warrant. Unfortunately, there is a warrant exception for automobiles. Scalia, who normally is NOT libertarian or pro defendant, helped us out in Arizona v Gant. He also is big on having a real confrontation clause but that's for another thread.

When the man utters this little trick question it actually means "your f****D and we're bringing the dogs to give a false hit and probable cause".

The only current defense is to roll your window down only enough to slip your ID and registration through and answer all inquiries with "I can't answer that in fear of incriminating myself" but this doesn't always work. Some will even say they smell the odor through a rolled up window.

Until more citizens sue the police and their tactics of lying and relying on false k9 alerts this is going to be reality.
 
Use that against 'em... keep a duffel bag in the trunk full of kinky sex toys and lingerie... Tell 'em they can look over your car as long as they don't open the bag in the trunk... Make a big stink over it...

They will do a cursory look over everything else but insist on opening the bag for a thorough probing. When they finally get their way... and they will... act embarrassed, insulted, let your tears well up etc. and ask,

"that was so unnecessary, are you through now? now that I have been completely violated, can I please get on my way now?"

They don't run the dog through ever vehicle, do they ?
 
What is it about your lifestyle that causes you to get pulled over in the first place ?

Could be you simply have out of states plates and they have a ticket quota to fill. Maybe because you took a wrong turn in an unfimiliar town and ended up on the wrong side of the tracks. Could be that the cop is going through a divorce and is pissed of at the world.

I wasn't a cop like your thinking(look at my username), all the same just Federal and on the water, but I had all the powers a regular cop did-and then some.

You asked what kind of lifestyle causes one to be pulled over and searched. Lemme see, I was active Federal Law Enforcement the last time I was searched, and have been searched several times years previous, and I was LE then, too. This alone should tell you something about "lifestyle", and how they could give two shits about it, even if you do.

When I was pulled over I did nothing. First they said my passenger (ex-wife) wasn't wearing a safety belt. She was. Always did. When she showed him the strap across her chest he back stepped and said I crossed over the line. I didn't. Excuses are easy to come by. Could have just as easily said I was speeding. I wasn't.

Such a mistake can easily happen ... Did they search your vehicle because of the claimed "not wearing a seatbelt" ?

I wasn't speeding, nor violating any other traffic laws. I identified myself as off-duty Law Enforcement,and that I was carrying a pistol and have a license to do so, as required by state law. The idiot changed his story three times of why he pulled me over, and searched without my consent, causing over $500 worth of damage to my car's stereo system. The fact he searched me, another LEO, violating my rights should be a pretty clear indicator that it doesn't matter who you are or what "lifestyle" you choose.
