DOJ files lawsuit accusing SpaceX of hiring discrimination against refugees, asylum recipients

The Department of Justice (DOJ) on Thursday filed a lawsuit against SpaceX accusing the company of discriminating against asylum recipients and refugees in its hiring decisions.

The DOJ alleges that SpaceX "routinely discouraged asylees and refugees from applying and refused to hire or consider them, because of their citizenship status, in violation of the Immigration and Nationality Act (INA)." According to the suit, SpaceX wrongly claimed that federal regulations related to export controls restricted the company to only hiring U.S. citizens and lawful permanent residents, also known as green card holders.

"Our investigation found that SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law," said Assistant Attorney General Kristen Clarke of the DOJ's Civil Rights Division. "Our investigation found that SpaceX recruiters and high-level officials took actions that actively discouraged asylees and refugees from seeking work opportunities at the company."

Seems to omit who determines the qualifications.

Does a company get to determine what the qualifications are for hiring?

Couldn't a company determine that U.S. citizenship be in part, a qualification for hiring?

Government already made that a mandatory requirement (qualification) for Space X. See Musk Tweets above.

On Wednesday, Elon Musk threatened to sue organizations funded by left-wing financier George Soros for falsely claiming "hate incidents" are on the rise, in order to justify censorship. Less than a day later, Biden's 'not weaponized' DOJ slapped SpaceX with a lawsuit for not hiring asylum seekers and refugees.

According to the lawsuit - which has been brewing since 2020, the DOJ found that "SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law," according to Kristen Clarke, assistant AG of the DOJ's Civil Rights Division.

The Biden administration's lawsuit seeks to win "fair consideration and back pay for asylees and refugees who were deterred or denied employment at SpaceX due to the alleged discrimination," along with civil penalties and policy changes from the company.

Will the DOJ go after Northrop, Lockheed and Boeing for the same thing?

Whatever the DOJ is smoking, they need to stop.

At this point the citizens would be better served if the DOJ and FBI were eliminated all together . You could re visit it a yr later to see if a smaller replacement of a different type was needed to replace DOJ.

The US Justice Department filed a lawsuit against SpaceX on Thursday over its hiring practices, accusing Elon Musk’s rocket company of discriminating against asylum seekers and refugees.

“Our investigation found that SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law,” Assistant Attorney General Kristen Clarke said.

“Our investigation also found that SpaceX recruiters and high-level officials took actions that actively discouraged asylees and refugees from seeking work opportunities at the company,” Clarke added in a statement.


Of course, that's all bullshit.

It's a political hack job, punishement for what he has done at "X".

ROFL. He's pretty much mandated by law (ITAR and I'm sure others) to only hire US citizens.

Are they gonna sue Lockheed for following the same laws? My guess is no.

It is not about right or wrong or win or lose it is about tying a person up in court or taking them off the playing field.

What is happening today is like having a Super Bowl game and a referee ejecting the star quarterback and his coach out of the game for no reason. It creates a controversy. All the replays..... It is obvious that neither the QB or Coach did anything wrong.... But their team lost the game.

Manhattan federal prosecutors are investigating Tesla’s use of company funds on a secret project that had been described internally as a house for Chief Executive Elon Musk, people familiar with the matter said.

The U.S. Attorney’s Office for the Southern District of New York has sought information about personal benefits paid to Musk, how much Tesla spent on the project—which called for a spacious glass structure to be built in the Austin, Texas, area—and what it was for, the people said

The Wall Street Journal was the first to report in July that Tesla board members had investigated whether company resources were misused on the secret effort, known internally as “Project 42,” and whether Musk was personally involved. The outcome of Tesla’s internal investigation couldn’t be learned.

The Securities and Exchange Commission has also opened a civil investigation into Project 42 and is seeking similar information from the company, one of the people said.

The SDNY and SEC investigations are in their early stages and may not lead to formal allegations of wrongdoing.

Tesla didn’t respond to requests for comment on this story or the Journal’s previous reporting about Project 42. Spokesmen for the SEC and the Manhattan U.S. attorney’s office declined to comment.

Employees were working on Project 42 last year, and plans called for a spacious glass building to be erected near the automaker’s Austin-area headquarters, the Journal reported. At one point, the building was envisioned in the shape of a twisted hexagon. Other images showed an expansive glass box that appeared to include a residential area.

Tesla lawyers and board members scrutinized the project after employees became concerned about how the company planned to use millions of dollars in specialized glass that it had ordered.

The status of the project and whether the glass was ever delivered to Tesla couldn’t be learned.

Federal prosecutors also have sought information about the driving range of Tesla’s electric vehicles, people familiar with the matter said. Reuters reported in July that Tesla had inflated the projected distance its vehicles could travel on a single battery charge.

SEC rules require public companies to disclose transactions above $120,000 in which a related party, such as an executive officer, has a material interest.

The regulations also require that any perks or other personal benefits worth more than $10,000 paid to the senior-most executive officers be disclosed to investors. The SEC in recent years has brought a series of civil enforcement actions against public companies, including Hilton Worldwide, over failure to report perks given to CEOs or other officers.

The Justice Department and SEC have also each opened an investigation into whether Tesla misled customers and investors about the performance of its advanced driver-assistance system known as Autopilot.

Tesla and Musk have repeatedly clashed with the SEC since they each paid $20 million in 2018 to settle the agency’s fraud lawsuit, which alleged the CEO misled investors when he tweeted funding was in place to take the automaker private.

In the years since, Musk has tried to unravel the settlement, saying the SEC used the deal to continue peppering Tesla with frivolous demands for information. A federal judge last year denied Musk’s request to vacate the settlement.
