Too bad he was born on foreign soil.
McAfee was born on a US military base, his parents US citizens. It was not a problem for McCain and he was born in Panama on a base as well.
It does not matter, do you think he is going to win? If he does, it will be the greatest thing to happen to the libertarian movement.
A military base in a foreign country is not part of the U.S.
WRT McCain, The Panama Canal Zone was a U.S. Territory.
Constitution ARTICLE II said:No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
Ah I see, obviously the difference between an unconstitutional territory and an unconstitutional military base are clear here:
What is unconstitutional about territories?
I guess in this case nothing, however I don't believe natural born citizen has successfully defined in court to include territories or exclude military bases. Like I said its the least of our worries given that Ted Cruz was born in Canada to non US citizens and is as far as he is.
Too bad he was born on foreign soil.
They have.
The Congressional Research Service concluded in 2011 said:"The weight of legal and historical authority indicates that the term 'natural born' citizen would mean a person who is entitled to U.S. citizenship 'by birth' or 'at birth,' either by being born 'in' the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship 'at birth.'"
A federal district court in California determined that McCain would qualify as a citizen “at birth,” and thus was a “natural born” citizen because he was "born out of the limits and jurisdiction of the United States” to parents who were U.S. citizens at the time
It has not been defined by the Supreme Court.
I believe this article answers the question:
