She did have to apply for a Visa because she no longer qualified for the Visa waiver program because she violated the terms of her last Visa and it was revoked, I posted the rule that says that and you just ignored it.She didn't need to apply for anything if she simply wanted to visit the US.
She was previously granted a work visa.
When she went to renew, she was denied.
She went to Canada.
She then returned to the same office to reapply for a work visa.
She was following the same procedure as before and had no reason to think that she would be subject to being kidnapped, even if her WORK visa was denied...
She had to apply for a Visa in Canada, she was not allowed into the US again without one.
