The Trump Administration said he was scheduled to be deported but a judge said he couldn't be deported to El Salvador because his lawyer told the judge he was fleeing gang violence.
Homeland Security is supposed to give paperwork to the judge that he is a gang member and thus is ineligible for the safe haven he was granted by the judge.
Instead of giving the judge that paperwork and then deporting him they deported him because he was involved in human trafficking and part of ms13.
So technically he was using the loopholes of the justice system to avoid deportation and receive safe haven that he wasn't eligible to receive and was always going to be deported eventually.
He came here illegally as a teenager. He's 29 now. He's married to an American.
Anyway, Trump is NOT defying the Scotus because the Scotus DID NOT RULE.
All Scotus did was decline to block a lower court's order. That is not a ruling.
They also asked the lower court to "clarify" its directive and to work with "due regard for the deference owed to the executive branch in the conduct of foreign affairs", --- and that Judge Xinis may have exceeded her authority when she required the Trump administration to "effectuate" Mr Ábrego García's return.
Scotus is basically asking the lower court to BACK OFF and not usurp the rightful authority of the Potus here.
Illegally.
The divergence in reporting on this is amazing.
According to the left-wing media, he is an American citizen and good family man, here legally. He came over on the Mayflower.
According to the right-wing media, he is here illegally, and an MS-13 gang member, and a terrorist engaging in human trafficking and chopping off the heads of babies.
