Texas house to be forclosed upon for Ron Paul paint job

Please don't try to convince me that there is a clause in the contract that she can't paint the house. Please don't try to convince me that there's a clause in the contract that she gives up her right to free speech until the house is paid for. This company deserves everything they get.
 
The mortgage company has no legal stand point and in the current economy they don't want a house back or this kind of fight!

as a real estate investor i can tell you notice of substitute trustee sale has to be filed 21 days prior! 2 weeks isn't a possibility

Personally i would say F-off and just try to take it . The mortgage company would be in breach of contract

That lady has every right to paint her house however she wants. As long as the mortgage company gets their payments I don't see why they should care how she chooses to paint her home. I hope she gets a lawyer and sues their asses. :mad:

It's a shame so many supporters of RP don't understand PROPERTY LAWS.
 
I can almost put money on the possibility that someone local had somebody write a false letter from the mortgage company (or not from the company at all) on company stationary. This kind of stupidity is tried all the time to intimidate customers into doing things the company wants them to do.

I had received a fake letter from my mortgage company that stated we had to be out of our house in 10 days if we didn't pay $10,000. It was sent by an employee at the company, but with criminal intentions. For days we fretted over that letter because we didn't owe anything.

Instead, what has been suggested, is that we make people aware of these stupid actions, if they are real. We suggested that we, the consumers, make the business aware that such actions are unacceptable. Free market economics at work...

You do live up to your name. Other than suggest that the contract be clarified in court--hardly a non-libertarian idea--who suggested anything else?

Thats what I was saying in my post on page 1 or 2! There is nothing socialist about calling a business on something you do not find acceptable - this is what our movement is about, consumers holding business accountable, not the government.
 
I have been a mortgage originator off and on for the past 12 years. Most every mortgage contract I have seen has a clause built into it regarding the general upkeep of a home. The mortgage company can foreclose on her house due to the paint. She doesn't own the home until the last payment is made. The bank owns the house. While I love the paint job on the house it doesn't do much for the resale value of the home.
 
It was a cool idea and worked to get a fair amount of attention. It's been thoroughly recorded and the maximum reward has been achieved. Repaint the house and get on with life.

True enough--except that upkeep is only affected by a lack of paint--so long as there is a solid coat of paint, elements cannot damage the structure, and the elements don't care one whit about the color or scheme of the paint. And while the mortgage company technically owns the house, this doesn't give them all the rights in the world. Even a renter has some rights, and a buyer even more.

While the ends may have been achieved and it may be time to repaint, I would actually like to see them fight until, hopefully, the media is forced to provide some coverage of the event.
 
The only thing I can think of is that the clause states about making any improvements or lack there of that will affect the resale value of the house.

Lets find out how much the remaining balance is for the mortgage and pay it off for them with a chip-in.
 
While I hate that the mortgage company is calling her out on this, I am pretty sure they have legal ground to stand on. The bank still owns the house and the house must maintain a specific value for their loan to still be worth something to them. As cool as the painting is, I doubt it helps to uphold the selling value of the home.

With that being said, I think it would be great to bombard them from the private level. There's nothing socialist about the community complaining about business practices, whether it's in their legal right or not.
 
I would verify that the letter is real if I was the owner. Then check with local laws and maybe the ACLU about the timeline and the wording of the mortgage.

If all else fails repaint it a couple of days before the due date. Just in case there is some accident or paint problems.
 
I'd sooner chip in to fight to protect our rights than to pay off her mortgage.

I have limited time and resources, so I have to call out for your help. I am in desperate need of help over here. If you know of an attorney who can work this case pro bono and save me from losing my house, please let me know. Or maybe you know an attorney who will need fees and I can get donations (that is always harder).

I also want to plan a petition party. Hopefully some people will come and help me canvass the neighborhood for signatures. It would be a nice time to go ahead and tell them about Ron Paul and why we need their vote. I can post that on my meetup group (930) if you can post it to 81.

I will also post a legal defense fund donation button on www.DocFeelgood.us in the general store or under grassroots on the Ron Paul House pages. If I end up getting some pro bono help I can use the money for filing fees and return the rest (unless someone just wants me to give it to Ron or Granny Warrior or something).

In any case I hope the Revolutionaries continue to come to the aid of their fallen bretheren, lest we all be picked off - one at a time.

It is indeed a private property issue / private contract issue, however people can call and show that they don't approve of the actions of the mortgage company. How they are interpreting the terms of the contract and so on. But nobody here except for you has even mentioned government intervention in this scenario. It was her choice to enter the contract, though with broad terms there can be discrepancies over interpretation... interpretation that many might consider unfair.

The paint job is certainly nice though, and now she needs to obey her contract, or face the consequences.
