The TN Department of Homeland Security, in conjunction with the TN Highway Patrol, will be setting up "no-refusal" checkpoints throughout Tennessee this holiday season. If you are stopped at one of these checkpoints you will be asked for your papers, and likely administered a sobriety test which could include a forced blood sample!!! If you think you have nothing to worry about, keep in mind that TN DUI Officers have in the past have been warned to arrest more people "or else" which means they have every incentive to meet their quota. Once your blood and DNA is forcibly extracted from you it gets stored in a government database.

Heh, at first thought from the title that they were actually checking to see if people are vampires.

Unbelievable. My 18yo is down there tonight at the University of TN. Will be using that ramp on I-140 after the game during this tyranny heading back to the rental home. He'll be down there for the next 3 days with this fodder too. Will certainly report back.

I'd like to see someone get caught in this trap and then sue to run it through the courts. These clearly violate the TN and US Constitutions.
 
I am thinking I seen something about Tennessee doing these types of blood tests a while back. Some articles I found about it.

It wasn't Kenneth Guyer Jr.'s first time behind the wheel allegedly drunk.

When the 40-year-old man got pulled over in September, it was his third time being stopped on suspicion of driving under the influence.

And law enforcement knew about his 1994 and 2003 DUI convictions.

When a police officer in Benton, Tenn., asked him to take a breath test or consent to a blood draw, he refused. When his case got to court, prosecutors didn't have enough evidence to charge him as a three-time DUI offender, so the charge was reduced to a lesser, included offense.

But if DUI-related legislation awaiting Gov. Bill Haslam's signature gets the go-ahead, defendants like Guyer will no longer slip through a loophole.

The legislation, which would go into effect Jan. 1, 2012, will require police to force a blood draw regardless of whether the driver consents to it if they have a prior DUI conviction or if they have a child in the vehicle with them under the age of 16.

In Tennessee, if you get pulled over for a DUI (driving under the influence) and the officer asks you to take a blood, breath, or urine test, do you have to take one? What happens if you refuse?
Implied Consent

Tennessee law requires you to take a blood, breath, or urine test if you are arrested for a DUI. Tennessee’s “implied consent” law says that if you are lawfully arrested by an officer who has probable cause to believe that you have been driving under the influence, then you consent to taking a chemical test of your blood, breath, or urine for the purpose of determining your blood alcohol content (BAC). The officer gets to choose which test you take and may ask you to take more than one. The test or tests must be taken as soon as possible from when you were last driving and you cannot refuse without penalty.

This makes it sound like you have to get arrested first.
 
Junior called and said he didn't see any checkpoints. I don't know where on I-140 he got on but he was coming from the Lady Vols game in Knoxville. Anyhow, he's home. I'm kind of glad I didn't go down this time. I probably would have went looking for the darn thing.
 
I've been watching alot of similar videos for a while now. Especially the ones by 4409 and sanderson on the border checkpoints that are 50 miles from the border. Also the open/concealed gun carry vids and others. You really pick up on what and what not to do.

Regarding these TN checkpoints, I think the supreme court deemed it Constitutional for you stop at a checkpoint. But I'm pretty sure there is no law that you have to answer all there questions or comply, unless they think you're under the influence or happen to think you're acting in a suspicious manner. Not answering their question is not suspicious, its a right. That one video sums it up pretty good, "Am I being detained, or am I free to go." ....if they happen to say you're being detained, then you ask, "under what suspicion." I carry a small camera with me at all times now, since my 80 yr old father was stopped, searched and handcuffed, roughed up, and put in the back of the car for no reason whatsoever. It was just a pirate trying to look for something to ticket him on.

It looks like the I-140 roadblock was at its terminus point near Maryville, TN. Cut and paste these GPS co-ords for what (as near as I can tell) would be the exact location of the roadbock: 35.805563,-83.940472

Whatever you do, make sure you email him the entire list of stops:

Someone (or a group of someones) at the U of T Knoxville might find it a good liberty project to photocopy these and paste them up around the campus, as well as any off campus drinking spots.

Yep. I did that when I first noticed shane's thread with the info. That's right near where we rented the house for the week too. I don't know. Perhaps it was a late night thing. He was in pretty early.

Yep... awhile back, the Court ruled that people must have an avenue of lawful escape. In other words, they can't just bottle neck people into check points... they must have a way to lawfully avert it.
 
Here is what the legislator who sponsored the bill e-mailed me about it:

that bill was strictly scrubbed against the Constitution. The previous law did a double take and made it appear that the Legislature intended for a person to deny forever, even with a constitutional warrant, signed by a judge, no sample could be taken if first refused. We researched and determined that 1) the current interpretation was not what was intended, and 2) with probable cause, a constitutional warrant is sufficiently justified and the sample is taken. In fact, it was determined that an innocent person of a diabetic emergency for example would be 1) proven innocent of DUI, and 2) would be then treated emergently for a diabetic problem - a good thing. If someone is worried about this law, do nit drink and drive. Is that what you are asking about?

I am not worried about drinking and driving. I don't do it. What I am worried about is some government thug being able to "lawfully" stick a needle in my arm and remove part of my body.
