Tax Fraud Case filed against US Gov.

Government Being Sued for Tax FraudBy Jaye Ryan on October 23, 2013 Subscribe to Jaye Ryan's Feed@wordsmithworkerTweet Pin It

One private citizen in Georgia has reportedly filed a civil suit recently against the government for tax fraud. No attorney contacted has accepted an assistance request, saying,

have never heard of this kind of suit.”

…if any response was given at all. The plaintiff who has not commented publicly is rowing the boat on a pro se — for self — basis.

The complaint reads that the government is not utilizing income tax dollars as it is supposed to, what constitutes something called constructive fraud or using funds in a manner other than its expressed intent. The second and larger complaint is that the government has no legal authorization to tax wages and salaries.

To prove tax fraud, the plaintiff must present all five conditions to be present:

A false statement of a material fact,
Knowledge on the part of the defendant that the statement is untrue,
Intent on the part of the defendant to deceive the alleged victim,
Justifiable reliance by the alleged victim on the statement, and
Injury to the alleged victim as a result.
The Department of Justice, Civil Division, has not yet received the notice of suit, but the plaintiff expects to have it served some time this coming week. The government will then have 60 days to respond.

The plaintiff, who chooses to remain anonymous at this time, stated:

”The government will never charge itself with fraud, so the only recourse the American public, the people, have is through the civil court system. It’s up to the people to hold the government accountable.

“It’s well beyond time for that to happen, especially in light of the recent government funding fiasco and operations shut-down. The politicians got paid while they continued to act like spoiled four-year-olds throwing hissy fits while forcing innocent victims to suffer for it.

“The executive branch and an entire political party forgot one very important fact: They are our employees, not our lords or gods. They ignored repeated studies, polls and surveys that reflected falling public opinion and dislike of ‘ObamaCare.’ They cannot get away with that, and elections have proven ineffective in driving home the point that they…work…for…us, not the other way around.”

This law suit is obviously in its early stages, but Downtrend will keep atop the situation as it develops and will report its progress in as timely a matter as possible.

Hmm, perhaps Civil Forfeiture? Maybe I'll just seize Yosemite Park in liu of taxes paid. Then we can call it even.
