Supreme Court Justice Scalia dies on hunting trip

GOP has the majority in both houses and must stop any Obama nominee until the next president
 
Scalia at least claims to be a strict originalist. He's a Reagan appointee, and certainly leans right. Better than most on the court even with his obvious issues.

As much as I feel bad for the loss of a man's life, there are bigger issues at play here. This is a disaster. Obama will appoint a radical progressive. The Court will now be majority wingnut progressive. This will be a serious problem.

I disagree with Scalia's general philosophy on the Constitution. But I honestly have no idea how anyone can be so obtuse to not understand how big of a loss this is. Saying he wasn't much good is beyond comprehension. Because a 45 year old Ruth Bader Ginsburg is going to be so much better.
 
Obama still has nearly a quarter of a term left in office. The SC has never gone that long without having 9 members, as far as I know. The SC cannot establish precedent with its rulings without 9 members. If Obama gets a nomination in the vacant seat, that will establish a democrat majority in the SC.
 
(CNN)U.S. Supreme Court Justice Antonin Scalia has died at the age of 79, a government source and a family friend told CNN on Saturday.

Scalia died in his sleep during a visit to Texas.
A government official said Scalia went to bed Friday night and told friends he wasn't feeling well. Saturday morning, he didn't get up for breakfast. And the group he was with for a hunting trip left without him.
Someone at the ranch went in to check on him and found him unresponsive.
In a statement, Chief Justice John Roberts said he and other justices were "saddened" to hear of Scalia's passing.
"He was an extraordinary individual and jurist, admired and treasured by his colleagues," Roberts said. "His passing is a great loss to the court and the country he so loyally served. We extend our deepest condolences to his wife Maureen and his family."
Scalia's death in an election year sets up a titanic confirmation tussle over his successor on the bench. The already challenging task of getting a Democratic president's nominee through a Republican-controlled Senate will made even more difficult as the fight over Scalia's replacement will emerge as a dominant theme of an already wild presidential election.
"His departure leaves a huge political fight in the offing because this is a court with five Republican appointees (and) four Democratic appointees," CNN Senior Legal Analyst Jeffrey Toobin said.

With Scalia's passage, SCOTUS will have 8 justices, Sotomayor, Breyer, Kagan, Ginsburg, Kennedy, Thomas, Alito, Roberts, divided evenly into ideological camps. This is important because when the Court divides 4-4 the lower court opinion is affirmed without creating any Supreme Court precedent.

More importantly, this means that Obama will now surely attempt to fast-track the appointment of another supreme court justice, although the question is whether the Senate will approve it. Initial indications don't look good for a prompt Obama appointment: the longest vacancy in Supreme Court history was 29 months when the Senate kept rejecting President Tyler's choices.

And as Conn Carroll, top staffer for Mike Lee, Republican on Senate Judiciary Committee just tweeted, Obama's chances to appoint a third Supreme Court justice are not looking good.

Under the Tyler Administration a SC vacancy lasted over two years without being filled. Needless to say, he had a Senate whose spines were made of something other than eclair filling.

I'm not so sure with the Obama rubber stampers, the RINO's serving in the Senate. This is all the more reason we have to vote everyone out, as quickly as possible.
 
For what it's worth, Lindsey Freaking Graham, who voted for Obama's previous nominees, is saying he will block Obama's appointee this time around.
