Also, you're confused. The Federal government is not one of the "enumerated powers." I think you're conflating that idea with the idea of separation of powers (which, of course, is also not found in the Constitution).


That isn't what he wrote. He said it is OF enumerated powers. In other words, its structure is one where all its powers are explicitly listed and nothing is implied.
 
Is this a first for the government? Isn't there other laws that are unconstitutional or is this the first one? The reason I ask is how did the other challenges to the other unconstitutional law as turn out? I think the problem in regards to the unconstitutionality of the health care bill is how each individual interprets the Constitution.
