It's a state and local issue. Beyond that -- business owners should decide how their business will handle the issue inside their premises.

and i dont smoke, have never smoked, lived with people that have been smoking their wholes lives, hate the stench, smell, and layers of tar it leaves after years of use on a building.

but i dont see how I, a consumer, have any right to tell Joe, the business owner, how to run his property, OTHER than by using the free market and not spending my money there...
 
LOL! Reading through this, it just occurred to me that people are debating two entirely different things on this thread:

1 - Banning smoking/cigarettes completely, like prohibition on alcohol.
2 - Banning smoking in enclosed public spaces, as many State have already done.


I bet that everyone here thinks that idea 1 (prohibition) is a bad idea...

The non-liberty lovers are arguing they have the right to regulate private property. These non-liberty lovers argue places that serve food and bars are somehow public spaces and not private property.

Smokers across the country are covertly scheming and will move en masse to a state near you and pass laws to regulate your living room in ways you don't like :)

Then you can be the one bitching about government regulating your use of your private property.
