however, the case for this sort of intrusion on a property owner's rights must be proven and the owner must be fully compensated. for example, I am totally opposed to cases where people lose their property for shopping centers to be built. this is an abomination imo.
Very well, but we have a means to remedy and protect both land owners and the "public good", and that is the Fifth Amendment's eminent domain language that you just alluded to.
Eminent domain, properly used, is a horrible intrusion, but I'll defer to the Founder's wisdom on this.
Seizures that do not follow the Fifth Amendment's language, inlcuding "loss of use" are nothing more than armed robbery by the government, no matter how altruistic the reasons.
