Virginia Primary Ballot Challenge: Judge Rules Against Rick Perry, Newt Gingrich, Rick Santorum & Jon Huntsman

RICHMOND, Va. -- A federal judge has refused to add Texas Gov. Rick Perry and three other candidates to Virginia's Republican presidential primary ballot.

U.S. District Judge John Gibney ruled Friday that the candidates should have challenged Virginia's primary qualifying rules earlier. Gibney said they knew the rules months ago.

Perry sued last month after failing to submit enough signatures to get on the ballot. Newt Gingrich, Rick Santorum and Jon Huntsman also failed to qualify and later joined Perry's lawsuit. They asked Gibney to declare Virginia's law unconstitutional and add their names to the March 6 ballot.

Only former Massachusetts Gov. Mitt Romney and Texas Rep. Ron Paul qualified for the March 6 primary ballot.

Unconstitutional? They throw the word around so much.

Any powers not specifically enumerated in the Constitution...
 
This needs to be an epic battle !!!!! Ron Paul against Mitt Romney.... we really need to come in first.

They don't even follow the constitution themselves! Then they turn around and use it in their favor.

I could be wrong, but they may have been talking about the Virginia state constitution. I'm not familiar with it though.
 
This is the plain black letter of the law, and has been for more than long enough for any candidate to have challenged it well in advance. To rule otherwise would have been a lawless act.
 
Also, I hope everyone here can recognize that if Paul were one of the the candidates who failed to get on the ballot, and instead Gingrich or Perry had gotten on, this would still be the correct decision, right?

I don't think it's right now, and don't think it would be right then. I think we agree on that.

The Virginia requirements are both an object lesson in party silliness and a good example of runaway regulation. It's obvious they set the bar too high when 5 (Bachmann, Gingrich, Perry, Santorum, and Huntsman) out of 7 candidates couldn't even make it through. Whatever we think of them, millions of people accept these candidates as viable contenders.

I'm not shedding a tear for any of those candidates, and I do hope it is publicized to discredit their Presidential campaigns and relatively poor organization. But do I agree with it? Absolutely not!
 
it begs the question, if Ron and Romney were able to meet the requirement, whats the other candidates excuse?

All the major candidates managed to do it in 2008. What's changed since then to make the bar too high?
 
The interesting part of this is that we will finally get a clear gauge on the GOP. Paul v. Romney. A direct head to head comparison of radically different approaches to government. I hope the hard questions are asked. There will be no other candidates on the stage. This is an awesome opportunity.
 
this is how i see it, too. if romney slips, Virginia could be the key to an easy convention victory.
