Portland, Maine citizen hassled by Police Officer for Open Carry

I only wish I could say that it was me. :)

Portland has been a major problem for a while in Maine. While open carry is perfectly legal, the previous Police Chief illegally enforced a ban on it and shut down citizens for it. So the policy appears to have lingered. But people like this guy are hope for the future.

That is O.K. The video was worthy of the rep. Which was why I gave it. Well informed individual. Completely legal activity. Knew his rights. Cited court cases. Video rolling. It is a shame it has come to this in Amerika. But it is what it is. As far as Portland I think the gun owners need to pick an O.C. day each month and overwhelm the L.E.O.s with 'SWATing' calls.

That was outstanding! Kudos, rep, and feel the LOVE. He was polite. He was informed. He was rightfully intransigent. He put those cops in their places with nothing uglier than the truth.

Bravo and may we all take heed of this performance and learn from it.

In NYC and much of NJ, he would have been taken to the ground, possibly beaten, possibly shot/tazed, and possibly ended up dead or in the hoosegow. So the word of caution here is to be very careful not to give police in places such at these any plausible reason to let loose on you. Be polite at all times no matter what sorts of jackasses they may be.

I have to say that there IS still something that grates on me. He relinquished his sidearm to the L.E.O.. Without warrant. I have incessantly debated what I were to do in similar circumstance. I come from an 'open carry' state. However, as the law is written it is 'open carry' unless it is 'to the terror of the people.' Now originally this meant actually 'terrorising' people. These days it can mean that someone is appalled that someone is carrying a weapon.
For myself I have decided this.
" No. I will not relinquish my sidearm. Unless, you are putting me under arrest. I will peacefully relinquish my firearm if you are doing so. Before I relinquish my firearm I would like to know the charges you are accusing me of. If you are not arresting me than I would like to know if I am being detained? If I am not under arrest or being detained am I free to get on with my day?"
 
rep worthy - in an OC state, I would tend to ask what section of the penal code prohibits my carrying a firearm?

However, a word of caution about putting too much faith in laws, court cases, and the Constitution (this isn't directed specifically toward the OP). We all need to remember that what government and its enforcers, or we as individuals, can or can't do isn't determined by anything written on any paper or any decision made by any court. It's determined solely by how much force we have at our disposal and how much of that force we're willing to use to get our way. Politicians and their enforcers can ignore the Constitution and the law whenever and however they wish as long as they have the physical power to do so. Our goal should be to make sure they never gain the power to do that with impunity.
 
Employees who argue about shop rules with their bosses and who are clearly in violation of policy should be let go on the spot
-they are guilty beyond a doubt as the video shows, they are in clear contempt of store policy and are therefore a liability to the store and it's mission.

Looked to me like the cop took his gun, while he was saying he did not "consent to any siezure". I wouldn't call that "relinquishing".

I open carry daily in warm weather, never had a police encounter.

Yeah, I think any physical resistance would have had a much uglier outcome.

Relinquish: To give over possession or control over. In every sense of the word he 'relinquised' his firearm. +rep for open carrying. More should.

At which point does one decide that 'the uglier outcome' might be the best course of action? When one is loaded onto a train?

I was thinking the same. If he had grabbed his gun when the officer reached for it, it could have been a horrible encounter.
