Hell has frozen over. Anderson Cooper just torched Letitia James for her selective prosecution of Donald Trump.

"The day after she was elected in 2018, Letitia James was asked by a community activist if she was going to sue President Trump. And she replied, quote, 'oh, we‘re going to sue him. We‘re going to be a real pain in the... He‘s going to know my name personally.'

I mean, that‘s not a great look for somebody who has just been elected, who has just been campaigning, who hasn‘t even looked. I guess, at at deeply at any evidence."

Not trying to make a political point here.

I spent years as a mortgage banker at Quicken Loans (now Rocket Mortgage), the number one mortgage lender in the country, before I ever went to law school. So when I see stories like this, I look at them a little differently.

Here’s the deal. How you classify a property as a primary, secondary, or investment home changes everything about the loan. The down payment, the interest rate, the underwriting, all of it.

Primary or secondary homes can get by with as little as 3 to 10 percent down.

Investment properties usually require 25 percent or more.

So if you’re a brand new real estate investor with limited cash, there’s a big incentive to call something a “second home” instead of an “investment property.”

But that’s why lenders make you sign a Second Home Rider, a separate document where you specifically promise you’ll use it as a second residence, not rent it out.

You also assert like NINE times in the application process it will be owner occupied…

Could this kind of thing ever be an honest mistake? I doubt it.

The facts, at least as reported, look pretty bad.

You buy a house, say it’s a second home, immediately rent it out, tell your insurer it’s owner-occupied, and then report rental income on your taxes.

That’s not a misunderstanding. That’s a pattern.

By the way guys, taking home owners insurance under the misrepresentation that it’s a primary for better rates is a great way to have a claim denied when your house burns down.

Very shortsighted mistake that many make...

Would a bank ever catch this on their own? Probably not.

Banks rarely dig that deep unless there’s a default or an insurance claim.

They just don’t have the infrastructure or frankly the desire to chase it down.

So yes, it’s definitely selective prosecution.

The amount of money at issue is small, and most people would never be charged for something like this.

But still, if the facts are accurate, it’s just a series of really bad moves.

And the wild part is that she’s a lawyer.

She’s the Attorney General of New York.

She’s prosecuted the former president for similar financial misrepresentations.

You’d think someone with that background would fully understand what those documents say and what it means to misstate intent on a loan.

It’s going to be a tough case for her to defend, unless she’s able to present additional information that clarifies the situation.

It’s possible…

In the meantime, there are lots of financial and life lessons in this story for all of us.

There has long been a tacit understanding in this regard that politicians would not take advantage of this with regard to mere “footfaults” on nonsense laws.

RE: The Letitia James Indictment

Honestly, I think this may be the most important thing that Trump 45 or Trump 47 has accomplished thus far. It may have reset us to the baseline of comity.

You see, for many years now Democrats have believed that they could do basically whatever they wanted to Republicans, whilst Republicans were still bound by the Old Rules of comity and respect.

Those were the New Rules. (Hat tip, Kurt Schlichter.). They thought we would never adopt the New Rules.

We did.

The James indictment says to Democrats:

“You no longer can assume that we will let you do whatever you want to us. We will do to you what you did to us. And we will be merciless until you prove you will never do it again.”

The particular beauty of the James indictment is that she brought the most scurrilous and ridiculous of charges against Trump, while the record shows that James clearly committed the basic federal crimes she has been charged with.

But Democrats decide to abandon that too. New Rules. That we now follow. Suck on it, Democrats. You get what you paid for.

(But to repeat; James charged Trump with nonsense; Trump charged James with a verifiable crime.)



I broadly agree with this person's assessment of the dysfunction of democracy (especially at scale), but I strongly disagree with the characterization that "we are fundamentally on the same team, and that our differences are merely over how to arrive at a mutual goal".

Even when democracy is able to achieve and maintain a stable equilibrium, it is not because everyone is "on the same team". It is because the players have agreed to abide by the same rules, despite the fact that they are on opposing teams with conflicting objectives.

IOW: To use a sportsball analogy, the players are not on the same team, with their differences being merely that they disagree on how best to score a touchdown ("run the ball!" ... "no, pass the ball!" ... etc.). The players are on different teams, and each team wants to beat the other teams by scoring touchdowns (i.e., achieving their objectives) while preventing the opposing teams from doing the same.

This can work, but only as long as all the teams regard playing by the same rules to be worth the cost of suffering losses. Observing the rules of the game can mitigate or limit occasional losses, as it offers the prospect of future wins (which opposing teams will accept and respect, even though they don't like it).

But once self-aggrandized entitlement sets in (under which the prospect of ever losing at all becomes intolerable), then the rules will no longer be perceived (correctly or not) as useful or "fair". At that point, the rules will fall by the wayside, and things like cheating and winning "by any means necessary" will become the norm rather than the exception.

Grand jury declines to indict N.Y. Attorney General Letitia James, less than two weeks after the first case was dismissed
The Justice Department on Thursday failed to secure an indictment against New York Attorney General Letitia James, a person familiar with the matter told NBC News.

The presentation to the grand jury came less than two weeks after the original criminal case against her was dismissed.

Lindsey Halligan, the acting U.S. attorney for the Eastern District of Virginia and a former personal attorney to Trump with no prior prosecutorial experience, presented the case to a grand jury on her own in the first go-round — and that case was declared void on Nov. 24 when a judge found Halligan’s appointment was unlawful.

The Justice Department initially vowed to appeal the ruling by U.S. District Judge Cameron Currie, but ultimately decided to seek a new, untainted indictment against James, a source familiar with the deliberations told NBC News earlier this week.

The new case was presented to a grand jury in Norfolk, Virginia, by different prosecutors.

The failure to secure an indictment on Thursday does not bar prosecutors from attempting to do so again in the future.
