If there's a real 'bad guy' or gangsters in town,can't the Chief of Police get on the local radio and a hundred armed men would show up as a posse? That's my internal view of America (as a foreigner).People supporting their neighbours in freedom.
My view is this: no police departments. Sheriffs only and they hold only the direct authority to investigate - none to arrest. When investigation produces sufficient cause for a warrant, it is issued and that alone authorizes the sheriff to call up a posse of citizens who are the ONLY people authorized to arrest another citizen. Period.
Sheriffs are elected and can be recalled for failure to perform as per their sworn oaths. Every sheriff's deputy would be up for public reinstatement - no more lifelong guarantees. If they misbehave they can be recalled or voted out. This should have been in place in 1789. Shame on them for not having seen this.
Any such investigator sheriff found to have violated his oath of office with intent spends not a nano-second less than 5 years at hard labor, and it goes up dramatically with aggravating factors. Such persons I am tempted to say should forgo the RKBA while on duty and when off duty may in no manner whatsoever discharge any function of office save to serve as a witness in the event he encounters a crime in progress.
This places firm handcuffs on all investigators and places responsibility squarely upon the shoulders of the Meaners for upholding the Law. This will have the effect of nullifying law people find extraneous or otherwise objectionable because nobody will volunteer to apprehend suspects. When a call is made for the teens smoking joints on the courthouse steps, chances are fair to middling that nobody is going to respond, especially when the subjects of such warrants retain the right to defend themselves against unjust arrest. If those boys, all well armed, are likely to get into a shootout, the incentive to volunteer passes vanishing smallness. For a wanted murderer... that is a whole other kettle of fish because even Meaners have enough sense born into them to know that murder laws are righteous.
Give me this nation for just 18 months - let me architect the future of liberty for America and I would gift the world with something nobody worth their guano would ever relinquish. We would be free to pursue our passions, regardless what they might be save for those that involve trespass. My world would crush the whipmasters under its hobnailed heel as it would those whose corrupted nature proved obstinate against the fiat of non-trespass.
