Guilford Official Challenges NC Marriage Law
GREENSBORO, N.C. -- The Guilford County Register of Deeds has filed a lawsuit seeking to put North Carolina out of the marriage licensing business.
The News & Record of Greensboro reported that Jeff Thigpen's lawsuit contends the state has no constitutional authority to either require marriage licenses of heterosexual couples or forbid them to same-sex couples.
Thigpen, along with ministers and other residents who signed on as plaintiffs, say the current laws make members of the clergy agents of the state by requiring them to obtain licenses when performing marriage ceremonies.
The complaint says the state should have virtually no role whatsoever in marriage.
A spokeswoman for Attorney General Roy Cooper, who represents the state in lawsuits filed against it, said Wednesday the office has no comment on the lawsuit.
