My school is going to breathalyze students to enter Prom

Hogwash. Just because it is "optional" doesn't mean your rights no longer apply. If that was so then "optional" driving would mean your rights to unreasonable search and seizure don't apply. "Optional" shopping means you could be searched without cause. Etc etc.

School administrators are government employees and generally have to afford you your rights. There are court cases that delineate exactly what your state allows when it comes to school intrustions of privacy, like suspicionless locker searches and bookbag searches. These same standards would generally apply to breathalyzers. But what if prom isn't on school property? Lots of issues to look into if you really want to know the answer.
I personally think it's a violation regardless of what some judge may have said. But the question becomes what are you going to do about it?
 
Sounds like a great opportunity for a capitalist to create an alternate dance environment.
 
I am a junior at a high school in Illinois (get to vote next year). Prom is coming up and I just ordered tickets. I was given guidelines for Prom and on there it stated that EVERYONE has to take a breathalyzer test to enter prom and anyone who fails the test will be arrested. I am strongly under the impression that this violates the 4th amendment as there is no reasonable suspicion. The only way I believe they can do this is if there is a judge writing warrants as the students take the test which I highly doubt will happen. How should I handle this situation? I am thinking about going to prom and handing the cop a copy of the constitution and tell him how he is violating it.

I could make an alternate dance so easily. All I would have to do is convince the club I'm in to host one and then we would. However, not enough people care about their freedoms. I asked some seniors about their opinion on the breathalyzer and the one thing I keep hearing is "yeah, they did it last year. So what?" It's as if no one cares and it's quite sad really. I haven't encountered one person that is even nearly offended by the fact that they are doing this. They're not even offended by the fact that our administration is stereotyping all of us as drunkies who don't care about anything other than parties. I am in many accelerated classes and the general consensus there is that it's a good thing. I swear these people deserve to live in a police state. It is absolutely ridiculous what the public schools do to the minds of our students.

This would have been considered insane when I was that age.

It would seem that if you have never been free, you don't know how important it is to be free.

I spend at least part of each day wondering when the shooting is going to start, because it can't be that much longer.

I've known guys expecting the shooting to start for almost 30 years now, but it has reached the point at which I'm convinced there is not that much time left.

I was reflecting on this in another thread and commenting on how much freedom has been lost, just in the past 30 years, how far down in the Panopticon we are.

And how, during the passage of time, what would be regarded as a outrageous violation of freedom and personal liberty by some people is accepted as a matter of course by youngers.

There is not much time left, it's roll this back now, or truly doom our posterity to a high tech global prison.

There was no breathalyzer tests when I went to prom, but there was was metal detector wands and pat-downs.

I was at Ft. Knox when they put in a self service breathalyzer at the Fiddler's Green Bar at the Officer's Club. We would have contests to see who could get the highest score.
 
Dont people drink after prom, not before?

I never went to prom. Waste of money.
