Compliance Assistance - Fair Labor Standards Act (FLSA)
Overview
The FLSA establishes minimum wage, overtime pay, recordkeeping, and youth employment standards affecting employees in the private sector and in Federal, State, and local governments. Covered nonexempt workers are entitled to a minimum wage of not less than $7.25 per hour effective July 24, 2009. Overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.

  • FLSA Minimum Wage: The federal minimum wage is $7.25 per hour effective July 24, 2009. Many states also have minimum wage laws. In cases where an employee is subject to both state and federal minimum wage laws, the employee is entitled to the higher minimum wage.
  • FLSA Overtime: Covered nonexempt employees must receive overtime pay for hours worked over 40 per workweek (any fixed and regularly recurring period of 168 hours — seven consecutive 24-hour periods) at a rate not less than one and one-half times the regular rate of pay. There is no limit on the number of hours employees 16 years or older may work in any workweek. The FLSA does not require overtime pay for work on weekends, holidays, or regular days of rest, unless overtime is worked on such days.
  • Hours Worked (PDF): Hours worked ordinarily include all the time during which an employee is required to be on the employer’s premises, on duty, or at a prescribed workplace.
  • Recordkeeping (PDF): Employers must display an official poster outlining the requirements of the FLSA. Employers must also keep employee time and pay records.
  • Youth Employment: These provisions are designed to protect the educational opportunities of minors and prohibit their employment in jobs and under conditions detrimental to their health or well-being.
 
The very simple question that I have never gotten a satisfactory answer to is this:

If you assume to know what a business can pay to get a job done and you assume that government has the authority to make somebody pay that amount and no less, why not stop pussy footing around and set the wage at $100 per hour?
 
About two percent of the population will get an extra about ten percent raise before taxes.

but...isnt the money they are being paid with worth less?
So technically, they are getting nothing more...with the increase they still lose money:D :p
 
I believe that the minimum wage in most states is greater than $7.25 already, so this change will probably have a rather limited effect.

Still, between this, Cap & Tax, and other changes the administration has been ramming down our throats lately, i'm starting to wonder if their goal really is to destroy jobs in the short term in order to pave the way for another porkulus bill.

Seems like that is the case, but I live in a very expensive State (that is also going bankrupt!). Who knows about all the States?

This just doesn't hit me as something to get aroused about. Probably very little effect, and TPTB could give a crap about circumventing the min wage law and paying illegals less than minimum wage. And they also don't care because they know it isn't keeping up with their inflation anyway.
 
I'm in different. Not all people who are on minimum wage are teenagers living at home. Some really do need an increase in their minimum pay to keep up with inflation. Double Cheeseburger at McD's is up to $1.20 now, used to be 99 cents not long ago.

I understand the arguments, I just prefer to focus my battle towards ending the fed. Once that is out of the way we wouldn't have to worry so much about inflation and whether minimum wage earners are falling behind or not.
 
I honestly don't care about minimum wage cause companies are always gonna pay the minimum for most unskilled laborers.

This number $7.25 is just another fake number the government puts out based on bullshit economics.

I am more concerned about other wage related issues, like the wage caps being put in place on highly skilled workers and business owners.
