The Department of Justice would not be required to have to prosecute Hillary Clinton even if the FBI were to recommend charges be filed against her for the use of a private email server when she was secretary of state, Attorney General Loretta Lynch has indicated.
The Washington Examiner reports that the nation's top law enforcer — answering a question from Sen. John Cornyn, a Texas Republican, as to whether her agency would be "required" to pursue criminal charges against Clinton — responded:
"It would not be an operation of law, it would be an operation of procedures," Lynch said.

As well, according to Lynch, a decision to pursue a criminal case would be "done in conjunction with the agents" involved in the probe, and would "not something that we would want to cut them out of the process."

The FBI is currently investigating the circumstances of Clinton's use of a private email server, on which some classified government information was reportedly passed.
Donald Trump has said he would pursue charges against Clinton if he is elected president.
 
DC does not prosecute their own. That should be a given by now. It's like in the USSR where the inner circle gets to play by its own rules.

Maybe they don't have to take FBI advice, but they do have to look at the evidence presented and follow the law. That requires charging Hillary Clinton with very serious crime when the evidence suggests she committed very serious crime.

I'd wager someone has a dead man's drop already prepared if they reject a well-founded recommendation to prosecute.
 
Quite a few of the GOP CONgresscitters may have some very serious questions about that for you, Loretta.

You just may want to get prepared for the hearings.
