Libertarian philosophy fails because of this example of attempting to build in a government protected zone, no real property rights (as there wasn't any real property sold), and there isn't any agreement about how to get around this obstruction to actually begin constructing the community?

Yeah, obviously it's because they couldn't negotiate water and roads in this "libertarian utopia" that never manifested in the first place.
