Judge Boasberg Allows Tren de Aragua Migrants to Appeal ‘Alien Enemies’ Deportations

Interesting ruling.

My read of it says that if I hold up a liquor store, and I deny that I did it, then I cannott be detained until my trial.
My read of it says that if you hold up a liquor store, and I aid and abet your crime by driving a get away vehicle, it's fine as long as I am a District Court Judge from DC, who opposes the laws on the books that makes your and my actions illegal.
 
"WHOO BOY: In an order filed last night, Judge James Hendrix--the judge in Texas presiding over latest Alien Enemies Act case which prompted unprecedented intervention by SCOTUS--accused ACLU atty of violating federal code of conduct rules by calling his chambers AFTER Hendrix denied the 1st emergency temp restraining order on April 17.

This was noted on the docket after Hendrix filed his order. Now it makes me wonder if Lee Gelernt did not do exactly the same thing with Judge Jeb Boasberg--which could explain Boasberg's quick action on March 15.

What are the chances he left the same message with Boasberg in the wee hours of March 15? In fact (and I will look at transcript), I believe Boasberg admitted to being "in communication" with ACLU prior to issuing any order or setting hearings.

Hendrix denied the emergency motion bc Trump adm said the 2 anonymous Venezuelan illegals cited in the lawsuit would not be removed. But--just like in the Boasberg case--that was not enough.

ACLU was demanding the case be converted into a class action suit covering ANYONE in the jurisdiction that might be subject to the Alien Enemies Act--which is what Boasberg did before his "return the planes" stunt.

ACLU was hoping for same outcome here. Hendrix was not playing their game. Even so, he was advancing the suit on Good Friday--but that wasn't good enough for ACLU, which is used to running roughshod over the courts.

They immediately appealed, taking the matter out of Hendrix's hands. Then they cried to SCOTUS, who bailed ACLU (and the illegals) out.SCOTUS just got involved in what looks like a very dirty case from the start. Good to see at least one judge stand up for himself and for the process."


 
As unlawful as the leftist judicial moles can be, the Trump Admin made a mistake with the whole "terrorist" and "foreign enemies" angle. It was destined to result in exactly what is happening with the corrupt judicial branch. It was novel, making it an easy target.

If they had just stuck with standard deportations, what could the left do? Rule that 100 years of deportations were illegal?

If illegal immigrants are sent back to their home country, or any country, it is up to those governments to decide if they should be released there, or tried for a crime. Not a US problem.

The Alien Enemies law is a legacy from our revolution.

He said that the revolution was in the minds of men.

He wrote to Thomas Jefferson in 1815:

“What do we mean by the Revolution? The war? That was no part of the revolution; it was only an effect and consequence of it. The revolution was in the minds of the people.”

He understood that people who live under the rule of a king or dictator require a change in their minds to oppose such a rule and to refuse it.

A democracy doesn't just appear and fill a power vacuum if a monarchy government is removed from power or a dictator is deposed.

The people have to form that Democracy government and the people must keep electing new governments and changing it.

Standard deportation mechanics are too slow to clear the illegals that were here before Biden threw open the gates, now it's insane.
Trump had to do what he did and he has to see it through until the leftist judges are put in their place.

Calling people alien enemies also forces people to question what makes a citizen a citizen.

He has done "free speech", "rule of law", "due process" and he has taught people to question everything even the "fake news".

No, I would be demanding that he do whatever it took to deport more faster, I most certainly would not be arguing with anyone who said he should make this particular move.
 
I agree with Rand Paul in that the Bill of Rights apply to everyone in the US and under the jurisdiction of the US.

That being said, it is not a contradiction with deportations. If someone is here illegally, they can be deported. They can not continue to break the law. That would be a contradiction!

Trump has muddied the waters by claiming the Alien and Enemies Act. While it might apply to Tren de Aragua, it opens a whole slew of legal options for the leftists to attack.

Just deport them as deportations have always been done. And if leftist Judges want to claim there is some change to how it has always been done, ignore them until it goes to the Supreme Court. The courts can't magically create laws out of thin air.

There's BIG, BIG money to be had. I don't think a lot of folks understand the money that's involved, and will facilitate erecting a full-blown surveillance apparatus. Now that the border has actually been "militarized", it is only a matter of time before it spreads like communist cancer. The Globalist-Technocrat-Corporations love the American people for their undying support.

Trump will win the AEA fight, he would have been tied down in red tape without it.

The best legal path for Trump would be to just point to Obama. He deported a lot of people. It would at least be entertaining to watch the Democrats attack things done by Obama.
